Abstract

Fakultas Hukum, Universitas Brawijaya Email: aisyahdindakita@gmail.com  ABSTRAK Perkembangan sistem hukum Indonesia dipengaruhi oleh suku, bahasa, agama dan ras, oleh akibat beberapa faktor tersebut, maka hal ini dapat dikatakan sebagai bentuk pluralisme hukum. Salah satu bentuk konsep pluralisme hukum di Indonesia yaitu salah satunya adalah hadirnya hukum Adat. Hadirnya UU Desa, telah menempatkan kedudukan masyarakat hukum Adat sebagai subyek hukum publik, yang menjadi bagian dari pemerintahan. Desa Adat memiliki hak-hak asal-usul berupa hak untuk mengurus wilayah beserta segi kehidupan masyarakat hukum Adat yang disebut sabagai hak Ulayat masyarakat hukum Adat. Namun hadirnya Permen ATR/KBPN No. 10 Tahun 2016 telah melahirkan hak Komunal dimana mengatur tentang kepemilikan bersama atas tanah yang kemudian didaftarkan untuk perlindungan hukum terhadap penguasaan hak atas tanah dalam rangka kepastian hukum dan mewujudkan tanah untuk sebesar-besarnya kemakmuran rakyat. Hal ini memiliki perbedaan konsep dengan hak ulayat milik desa Adat dan dapat berdampak pada status tanah yang dimiliki oleh desa Adat, yang awal mulanya berstatus tanah ulayat, yang di barengi hak Ulayat atasnya. Tetapi harus diganti dengan hak Komunal, yang hanya sebatas hak atas tanah akibat terbitnya sertifikat sebagai bentuk pengesahan tanah tersebut. Sehingga, hak Ulayat atas tanah ulayat yang lebih dahulu dimiliki desa Adat, kini menjadi tidak jelas akibat hadirnya hak Komunal. Kata Kunci : Pluralisme Hukum, Hak Ulayat, Masyarakat Hukum Adat, Desa Adat, Hak Komunal   ABSTRACT The development of legal system in Indonesia is affected by tribes, languages, religions, and races. All those factors are deemed a form of legal pluralism, one of whose concepts in Indonesia is related to adat (customary) law. The emergence of Law concerning Village has set the position of the people of adat law as a public legal subject in the government. Villages have the rights of origin such as the right to take care of a certain area along with all walks of life of adat people, and this right is known as ulayat right of the people of adat law. However, the issuance of Government Regulation ATR/KBPN No. 10 of 2016 has encouraged the emergence of communal right that regulates shared ownership of land that is further registered to obtain legal protection for control over rights to land for a legal certainty and to provide the land for the greatest welfare of the people. This concept is different from the concept of ulayat right held by the people of adat village and this difference can lead to the status of land owned by customary people, where the land under the status of ulayat right, with the ulayat right above it, has to be transferred to communal right that is only restricted to the right to land due to the issuance of the certificate in the form of land validity. The land under the ulayat right that is initially owned by adat village has become murky in its status, eclipsed the existence of communal right. Abstract

This research aims to determine the relationship between hope and quarter life crisis in final year students in West Sumatra. Hope is the ability possessed by an individual to create a strategy in achieving a goal with the overall motivation he has to recognize the strategy chosen in achieving a goal. Meanwhile, the quarter life crisis is a process of high instability, drastic changes, too many choices and feelings of panic and helplessness. This phase appears in individuals aged 18 to 29 years. This research uses quantitative methods with a quantitative correlational research design. The population in this study were final year students in West Sumatra with a total of 195 students as subjects. The sampling technique used was purposive sampling. The data collection tool uses the quarter life hope and crisis scale. Data analysis uses the product moment correlation coefficient. The results of the research show that there is a negative relationship between hope and the quarter life crisis in final year students in West Sumatra (r=-0.514: p=0.00). A significant negative relationship means that if an individual has high hopes then the level of quarter life crisis for the individual will be low, and if the level of quarter life crisis is high then the level of hope experienced by the individual will tend to be low.

Abstract

Education is very important in shaping the good and bad of the human person. Realizing this, all educational units, both schools and madrasas, need educators and education staff according to the requirements and regulations in force so that they can carry out educational activities as they should. In this regard, the role of administrative staff is very important to support the smooth and successful administration of schools. Comprehensiveness that involves all parties to create a shared goal of realizing a higher quality school, administration is very important for each respective school from matters of curriculum, student affairs, staffing, finance and others. Administration in a broad sense is administration, administration is an all-encompassing process that involves all parties who realize common goals, while administration is a process of cooperation of all forces to create quality schools. While the administration of education is the guidance, supervision and implementation of everything related to school affairs.
