Abstract

Poverty is an important issue in this digital era and has a great impact in social element of human being. Islam is a complete religion has attention in tangible and intangible aspect of human to reach Allah’s will and has solution to alleviate poverty till human feel a good life in here and hereafter. Waqf as one from many Islamic solutions could alleviate poverty that can saw from historical lesson since prophet Muhammad r and his companions which developed by various program and tools like digital platforms in this era. The purposes of this research to snapshot a poverty situation and detail a grand design of waqf in poverty alleviation through digital platforms in Indonesia and good governance principles used in waqf management. The research used qualitative methodology based on document analysis and observation of all instruments related to waqf. In the end of research, the authors conclude that waqf has an important advantage to decrease poverty and using digital platforms with a good management make waqf spread widely and easily to collect the asset of waqf from Muslim in Indonesia.

Abstract

AbstractCopyright is the right of Intellectual Property (right over the wealth of Intellectual). The rightover the wealth of intellectual, is the right to enjoy economic result of some intellectual creativity. Inthe terms of copyright in Copyright Act No.28 year 2014 explained that “copyright is an exclusiveright of the creator or the right recipient to announce or reproduce the creation or give permission for itwithout any reduce a limitations or restrictions according to the applicable law”. In this case, copyrightcan be transfer to the inheritor or to the other parties. This research aims to know the division ordinancesin inheritance in the concept of mawaris and copyright Act No.28 years 2014. This transfer is aimsto respect the struggle, thought, creativity of the creator, and to keep the benefts felt by society and hisinheritor. The fnding of study are according to copyright act, the creation that get a copyright is all ofcreation in art and science that metioned in copyright act. In Islam not all of creation get a protectionby copyright but it must to have some of requirements as pure, halal or legal, thayyib or good, and itdoesn’t damage a moral of society. The copyright division in inheritance is regulated in civil law bookand mawaris concept. Takharruj system or mutual agreement system is allowed be use after the divisionin the concept of mawaris.Keyword: Copyright, Mawaris, Intellectual property, Sharia

Abstract

Today, poverty is a crucial issue and has a great impact in social and economic development. Waqf (charitable endowment) is one of the sources of Islamic economic system, which refers to the voluntary charity. Waqf has a unique presence in Islam and could potentially alleviate poverty. It was reflected in the historical lesson since prophet Muhammad (PBUH) and his companions developed a system where rich people could donate their wealth for the society development. This concept, nowadays, is adopted by developing a Waqf system that integrates digital technology. Concerning on this issue, the present study aims to snapshot a poverty situation and portray the grand design of digital Waqf system in alleviating the poverty in Indonesia. Under the procedure of qualitative approach, this study employs document analysis and observation of all instruments related to Waqf. The results show that Waqf plays an important role in decreasing poverty in Indonesia. By utilizing digital platforms, the collection of Waqf funds is effective and widely spread to the Muslim community within the country. The results suggest that digital Waqf system has a crucial role and potentially contributes to the sustainable economic development of a developing country, particularly Indonesia. This study can be used in financial inclusion through the application of digital Waqf to alleviate poverty.

Abstract

The protection of songwriters’ economic rights in Indonesia faces significant challenges, particularly with respect to royalty payments in commercial public spaces and digital platforms. The main regulatory frameworks, Law No. 28 of 2014 on Copyright and Government Regulation No. 56 of 2021, aim to establish a “one-stop system” through the National Collective Management Organization (LMKN). Nevertheless, royalty disputes continue to occur, indicating gaps in transparency and dispute resolution mechanisms, as reflected in conflicts involving concerts and commercial venues. This study aims to (1) analyze the challenges and opportunities in implementing the principles of transparency and accountability within LMKN, particularly in relation to the Song and Music Information System (SILM), and (2) evaluate the effectiveness of non-litigation mechanisms (mediation and arbitration) as primary solutions for resolving music royalty disputes compared to litigation. This research adopts a normative-juridical legal method, employing a statute approach, conceptual approach, and case approach. Primary legal materials (Copyright Law and Government Regulation No. 56 of 2021) and secondary legal materials (literature, academic journals, and court decisions) are analyzed using a qualitative-descriptive method. The findings indicate that LMKN has not yet achieved full transparency and accountability due to limitations in the comprehensiveness of the SILM database. Mediation emerges as the most efficient dispute resolution mechanism, as litigation tends to be time-consuming and costly. Accordingly, LMKN should take a more proactive role as a mediator. In conclusion, legal certainty in royalty management requires institutional strengthening of LMKN and a cultural shift in dispute resolution from litigation toward non-litigation mechanisms.
