Abstract

In Indonesia, cash waqf began to emerge in recent years in line with the passage of the act of the Republic of Indonesia no. 41 Year 2004 About Waqf. But, in the act, money that can be donated as waqf property is almost certainly based on its nominal value rather than the real value. This article discusses how nominal or real value is contained in the currency when it is used as a waqf. The research approaches in this paper is qualitative description method through content analysis. This research analyzing the contents of various complexities between the opinion of fuqaha about cash waqf and its relevance to the act and economic empowerment of the ummah. By considering real value contained in the currency, cash waqf can only be executed with gold and silver criteria, not paper money criteria due to fluctuations in value. Thus, it is necessary to establish standardization of real value to gold and silver in the cash waqf.

Abstract

Apabila kita perhatikan secara seksama, postulat al-Quran dan hadits mengenai ibadah, khususnya ibadah mahdhah, amat banyak dan tersebar pada berbagai tempat di dalam al-Quran dan hadits nabi. Sehingga tidak memerlukan kaidah-kaidah khusus mengenai ibadah mahdhah itu. Sebaliknya, postulat al-Quran dan Hadits dalam bidang muamalah tidak begitu banyak dan hanya mengulas kaidah-kaidah umum saja. Hal ini menunjukkan bahwa wilayah muamalah adalah wilayah dengan ijtihad yang begitu luas. Sehingga membutuhkan  beragam  kaidah  khusus  dan  partikular  yang  mengaturnya.  Pada  sisi  ini, dimensi kemanusiaan dan otoritas manusia sebagai khalifah Allah di muka bumi ini harus diberdayakan. Pada gilirannya nanti, wilayah muamalah menjadi wilayah ‘kekhalifahan’ manusia yang bertanggung jawab pada tata kelola bumi menuju kemakmurannya. Al- Majallah al-Ahkam al-Adliyyah adalah salah satu himpunan perundang-undangan hukum perdata Daulah Utsmaniyyah yang disusun oleh team ahli fiqih dan ushul fiqih yang otoritatif lewat seleksi yang ketat dan seksama sekitar lebih dari satu abad yang lalu. Al-Majallah memuat kaidah-kaidah dalam hukum muamalah—disamping jinayat dan kekuasaan kehakiman—yang  luas  yang  masih  sangat  relevan  dan  aplikatif  dalam  istinbath  hukummuamalah dewasa ini.

Abstract

Consumer decision making in selecting the financing of the dominant consumerbehavior, where consumer behavior is a process, and decision-making is one of the stages. There are many influences that underlie the consumer in choosing a murabaha financing at BMT. Decision-making customers in selecting the financing murabaha in BMT Al Hidayah influenced by several factors, including cultural, social, personal and psychological factors. This study aims to determine the influence of consumer behavior partially and simultaneously against the decision of the customers choose murabaha financing and which variables most affect the customer's decision to choose financing murabaha in BMT Al Hidayah KawaluTasikmalaya. The analysis showed that the variables of consumer behavior (cultural, social, individual, psychological) influence the customer's decision in choosing a murabaha financing amounted to 95.7% while the remaining 4.3% is influenced by other variables outside the research model.

Abstract

Zakat is maaliyah ijtima'iyyah worship, it means worship in the area of property that has a very important position in the development of society. Zakat is purification treasure for muzakki and develop the economy for mustahik. Thus, zakat can contain two effects at once; spiritual impact and economic impact. The impact of issuing this treasure should be able to motivate muzaki to continuously purify the treasures with regular charity which, in turn, have a direct impact on the level of welfare of the mustahik. However, in reality, poverty is still notmoved. During this time, the government's efforts to reduce poverty are many initiated and pursued to be realized. Among others, by formulating standards and draw up a map of poverty pockets of poverty. By looking at the reality of poverty, tackling problems and solutions offered Islam, required laws that defend the rights of the poor and poverty reduction procedure itself. In the context of the laws of the Republic of Indonesia, the government's efforts to accommodatethe interests of Muslims and efforts to eradicate poverty is by enacting two laws product zakat management. Legislation in question is Act No. 38 of 1999 and Act No. 23 of 2011 on the management of zakat. However, the legislation needs to be reassessed its effectiveness because until today the empowerment of zakat is still far from expectations

Abstract

In choosing the right competitive advantage strategy to be applied by a business,businessmen need to look at market conditions and assess their position in the market. This can be done by analyzing the business environment, both the external environment and the internal environment, usually called SWOT analysis. The purpose of this research is to formulate the most appropriate competitive strategy for to be applied in the future. In this research the author uses descriptive qualitative method with data collection techniques through interview, observation and documentation. Primary data collection is done through in-depth interviews with informants in this study, namely including Madina managers, Madina employees, Madina consumers, Madina suppliers and local governments Purbaratu Tasikmalaya. While secondary data is collected through literature studies, research journals and an overview of research objects, the structure and vision and mission of the company obtained directly from the Madina Purbaratu Tasikmalaya minimarket. The research method used is a qualitative descriptive analysis method with SWOT anlysis. From the results of the IFAS and EFAS analysis the company position is in quadrant 1. From the quadran the recommended strategy is an aggressive/progressive strategy. Then from matrix SWOT the right alternative strategy options that can be applied in Madina in the future is the SO strategy by maintaining the company’sstrengths, minimizing weaknesses and avoiding threats seen from the company’s internal and external factors analyzed through the SWOT matrix
