Abstract

This study aimed to find out how the law of touching Mushaf of the Qur'an for people who are in hadas according to the Syāfi'ī and Hanbali schools. The type of study was descriptive qualitative research that focuses on retrieving data sources from library research using a normative juridical approach. The results showed that the sects of Syāfi'ī and Hanbali both viewed the prohibition of touching Mushaf of the Qur'an without wudu for the person in hadas. As for the law of touching or carrying a mushaf wrapping sheath (which has a hanger) or a box in which there is a Mushaf of the Qur'an, the sects of Syāfi'ī and Hanbali differ. The Syāfi'ī sect thinks it is haram because it is made for mushaf and converted to it like a mushaf cover skin. The Hanbali sect argues that it is permissible not to touch the mushaf because what is forbidden is touching, while carrying does not mean touching. This difference arises because of differences in views on the basis of qiyas in the source of the law of its sect.

Abstract

This study examines the concept of al-ḥiyal al-syar'iyyah (permissible legal stratagems) from the Ḥanafī school of thought perspective and its application in contemporary financial transactions. The research aims to analyze the Ḥanafī scholars' views on al-ḥiyal al-syar'iyyah and explore its implementation in financial contracts (mu'āmalah māliyyah). Employing a qualitative approach with normative and sociological perspectives, this study focuses on textual analysis of classical and modern Islamic jurisprudence sources. The findings reveal that the Ḥanafī school considers al-ḥiyal al-syar'iyyah as a legitimate method to navigate religious matters without violating Islamic law, categorizing it into permissible and impermissible stratagems based on their objectives and alignment with maqāṣid al-sharī'ah (objectives of Islamic law). The study also demonstrates the application of this concept in various financial contracts, including sales, leases, loans, gifts, and contemporary Islamic financial products. This research contributes to the ongoing discourse on Islamic legal theory and its practical implications in modern Islamic finance, providing valuable insights for academics, policymakers, and practitioners in the field.

Abstract

The Community Service Program (KKN) Batch VII of STIBA Makassar in Lekopancing Village, Maros Regency, is a form of field-based academic activity aimed at implementing the Tri Dharma of Higher Education. Based on the condition of the community with minimal religious guidance, this study aims to assess the extent of student contributions to society through religious programs conducted during the KKN period. The implementation method of the service program began with mapping community problems and needs using SOAR Analysis. Subsequently, work programs were designed according to the community's needs. From the analysis conducted, several religious activities were organized, including a 20-Day Quran Memorization Course, Ramadan Short-Term Islamic Boarding School, Gemar (A Movement to Promote Modest Dress), Funeral Management Training, Muslimah Study Circles, Taklim Sakinah, Sunnah Cupping and Sharia-Compliant Ruqyah, Grand Islamic Lectures, Quranic Improvement Circles (Halaqah Tahsin/Dirosah), Teaching at Early Childhood/Children’s Quranic Education Centers (TK/TPA), and other activities. These activities successfully had a positive impact on the Lekopancing Village community, particularly in the religious aspect, aligning with the objectives set for the KKN program.

Abstract

The research aims to understand the concept of hijab among the female cadres of Wahdah Islamiyah Makassar and from the perspective of Islamic Law. This research uses field research, which is a systematic study that collects data in the field and is correlational with a quantitative approach. The research findings presented in this thesis are as follows: First, the concept of hijab among the female cadres of Wahdah Islamiyah Makassar in terms of knowledge and understanding falls into the category of knowing and understanding the concept of hijab. As for the level of agreement from the perception and attitude of the cadres, it shows that 67.38% or equivalent to 527 people disagree with the currently trending hijab concept, while conversely, 32.62% of the cadres agree with the currently trending hijab concept. Secondly, the concept of Muslim women's hijab in the perspective of Islamic Law is a hijab that must adhere to the conditions that must be met in the use of Shari'ah-compliant hijab. This writing is expected to contribute to society, especially for Muslim women, and to assist the Wahdah Islamiyah Institute in Makassar in understanding the extent of its cadres' knowledge, understanding, perception, and attitude towards the concept of Shari'ah-compliant hijab.
