Abstract

This research examines the application of the law to criminal acts of premeditated murder involving high-ranking National Police officers with a case study of the Ferdy Sambo case based on Supreme Court Decision Number 813 K/Pid/2023. The focus of the research is directed at two main aspects: first, the legal mechanisms applied in handling criminal acts of premeditated murder involving high-ranking Polri officers; second, the effectiveness of imposing sanctions in increasing public trust in the image and reputation of the National Police. The research method used is normative juridical, with an analysis-based approach to statutory regulations, court decisions, legal doctrine and related literature. This research found that legal mechanisms have been implemented according to procedures, although they face challenges in ensuring transparency and accountability. Meanwhile, imposing sanctions on Ferdy Sambo is seen as a significant step in enforcing the law, but its impact on increasing public trust still requires further strengthening through institutional reform and improving the internal monitoring system.

Abstract

Land is an asset that has an important meaning for every individual in society. Apart from having economic value that can be reserved as a source of human life support in the future, land also contains spiritual aspects in the environment and its survival. Land is a place of settlement, a place to carry out human activities, even after death it still needs land. Land in the plains of Indonesia is a source of livelihood for the community and income for those who earn income from agriculture. In the political aspect, land is the place, boundary, and location of the jurisdiction of the Indonesian population, while from the social aspect, land is a space for good relations between fellow Indonesians. The holder of the right to the surface of the earth (Landowner) is given the right to do something about the land that legally belongs to him. The term something that can, must or is prohibited to be done is the content of the right of the ruler. This is the criterion or benchmark for distinguishing between land tenure rights which are then regulated in land law or land regulations. The existing land regulations in Indonesia are regulated in Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles (hereinafter shortened to (UUPA)), providing affirmation of arrangements related to the surface of the earth in a juridical sense called land tenure rights. Land tenure includes the relationship between individuals, (individuals) legal entities, or communities as a collectivity with land that is haki resulting in the birth of rights and obligations. Agrarian land conflicts still often occur in various regions in Indonesia, especially on the issue of natural resource management with the assumption of increasing economic growth. Land issues between land rights holders dealing with the ruling government tend to change as a result of the ever-changing land configuration, resulting in a clash of interests that continues to grow so that a dispute resolution approach is needed that can provide justice and legal certainty for the community. This also happened in the eastern border area of Indonesia, namely Morotai Island Regency, North Maluku Province.

Abstract

Amicus Curiae is limited to providing opinions, and not taking action. The practice of amicus curiae is actually commonly used in countries that use the Common Law system and not the Civil Law system adopted by Indonesia. However, this does not mean that this practice has never been applied or practiced in Indonesia. In the Indonesian judiciary, amicus curiae has not been clearly regulated, but the legal basis for accepting the concept of amicus curiae in Indonesia is Article 5 Paragraph (1) of Law Number 48 of 2009 concerning Judicial Power. Therefore, it is interesting to examine the role of the amicus curiae in the judge's decision regarding the justice collaborator in the criminal case of premeditated murder. To answer these problems, normative legal research methods (normative juridical) are used with a statutory approach, case approach, conceptual approach and comparative approach, using secondary data obtained from primary, secondary and tertiary legal material sources. In this research, the role of the amicus curiae in the judge's decision on the justice collaborator in the criminal case of premeditated murder as regulated in Article 340 of the Criminal Code. Apart from that, the role of amicus curiae is also regulated in the Constitutional Court Regulations Article 14 Paragraph (4) Number 06/PMK/2005, Article 180 Paragraph (1) KUHAP, Article 183 KUHAP, Article 89 Paragraph (3) Law Number 39 of 1999 concerning Human Rights Humans, Circular Letter of the Supreme Court of the Republic of Indonesia (SEMA) Number 4 of 2011, even though they do not have clear regulations, in their application amicus curiae have never been prohibited by judges.

Abstract

Bhabinkamtibmas adalah petugas Polri yang bertugas di tingkat desa sampai dengan kelurahan yang bertugas mengemban fungsi preventif dengan cara bermitra dengan masyarakat. Babinkamtibmas sebagai pelindung dari kejahatan yang terjadi dan masyarakat mempercayakan kepada Bhabinkamtibmas untuk memberantas dan mencegah berbagai tindak pidana seperti balapan liar, narkotika, pencurian dan sebagainya sebagaimana fungsi Bhabinkamtibmas memiliki fungsi dan peran yang sangat penting dalam hal mengurangi tindak pidana, yakni tugas dan wewenang serta tanggung jawab lembaga atas kuasa undang-undang untuk menyelenggarakan fungsinya, antara lain memeliharaan keamanan dan ketertiban masyarakat, penegakan hukum, pelindung, pengayom dan pelayanan kepada masyarakat. Untuk itu akan diteliti lebih lanjut bagaimana peran bhabinkamtibmas dalam mencegah tindak pidana di masyarakat dan faktor-bagaimana faktor penghambat bhabinkamtibmas dalam mencegah tindak pidana di masyarakat. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian yuridis normatif. Dari hasil penelitian ditemukan peran bhabinkamtibmas dalam mencegah tindak pidana di masyarakat dengan membimbing masyarakat bagi terciptanya kondisi yang menguntungkan upaya penertiban dan penegakan hukum upaya perlindungan dan pelayanan masyarakat yang meliputi pembinaan kesadaran kamtibmas, pembinaan kesadaran hukum, melaksanakan tugas-tugas kepolisian umum dan hal-hal tertentu sesuai situasi dan kondisi dalam menangani setiap permasalahan sosial, yang pada akhirnya dapat mengurangi kejahatan, memberikan perasaan aman dari kejahatan dan selanjutnya akan terciptan keamanan dan ketertiban masyarakat dan faktor-faktor penghambat bhabinkamtibmas dalam mencegah tindak pidana di masyarakat antara lain: beban tugas yang besar, keterbatasan pendidikan dan pengalaman, kurangnya kesadaran masyarakat, kurangnya partisipasi masyarakat, kurangnya kewaspadaan masyarakat, kurangnya anggaran dan kurangnya jumlah personel Dari hasil penelitian untuk perbaikan diharapkan dibuatkan undang-undang khusus terkait bhabinkamtibmas dalam mencegah tindak pidana di masyarakat dalam perundang-undangan, peraturan pemerintah, permenkumham dan pemerintah harus membentuk perundang-undangan baru dalam undang- undang, peraturan pemerintah, permenkumham terkait bhabinkamtibmas dalam mencegah tindak pidana di masyarakat.

Abstract

In this research, one form of traffic violation is a minor who drives a motorized vehicle and does not have a driving license (SIM). This research examines a) what is the juridical review of minors who commit traffic violations that cause accidents and cause fatalities in the area of ​​the National Police's traffic police highway patrol, b) what is the responsibility of minors who commit traffic violations that cause accidents and cause fatalities. The research method used in this research is through normative juridical research which is supported by interviewing sources and collecting data using library research. The conclusions of this research are: a) a judicial review of traffic accident cases involving minors. Minors are regulated by special laws, namely Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. This law regulates various legal aspects related to minors who commit criminal acts, including traffic accidents. b) a child who is still a minor can be held responsible for the actions he has committed, based on the provisions of the child's age, as regulated in the provisions of the juvenile justice system, which regulates the imposition of sanctions based on the provisions of the child's age, namely over 14 years of age, as there is a requirement to look at age in determining sanctions as regulated in Law No. 11 of 2012, in Article 69 paragraph (1).

Abstract

This research aims to analyze how the juvenile justice system is applied to children involved in recidivist crimes, particularly in premeditated murder cases, with reference to the provisions of the Juvenile Justice System Act No. 11 of 2012. The research method used is a case study, focusing on Court Decision No. 3/Pid.Sus-Anak/2022/PN Buntok. Data was collected through the analysis of court decisions and interviews with legal practitioners and related parties. This study examines the application of the juvenile justice system in the context of premeditated murder cases involving repeat juvenile offenders and evaluates how well the law is implemented in judicial practice.The results indicate that the application of the juvenile justice system in recidivist cases, especially in premeditated murder, faces significant challenges in balancing the protection of the child's rights with societal justice. Law enforcement needs to be more sensitive to the rehabilitation needs of juveniles and prevention of recidivism through a more integrated approach and greater attention to the underlying factors driving the child's behavior.

Abstract

This research focuses on the misuse of revolving fund loans/financing from the Cooperative Revolving Fund Management Institution, Micro, Small and Medium Enterprises (LPDB-KUKM) to the West Java Panca Bhakti Street Vendors Cooperative (Kopanti Jabar) in 2012 and 2013. Through a qualitative approach, this study identifies the modus operandi of the perpetrators, the impact of state losses, as well as the judge's consideration in handing down the verdict. The results showed that there were manipulations in the process of applying for and distributing funds, which resulted in state losses of Rp. 116,823,508,700.00. Judges consider aggravating and mitigating factors in imposing sentences, with the aim of providing a deterrent effect and recovering state losses. This research is expected to contribute to efforts to eradicate corruption in Indonesia.

Abstract

Background: In Muslim-majority contexts, religious and cultural values significantly shape adolescents' emotional development, particularly in dating-related behaviors, attachment styles, and emotion regulation. Objective: The research aims to examine how dating status influences attachment styles and emotion regulation strategies among Muslim adolescents, considering the impact of religious beliefs and cultural norms. Method: This study employs a systematic literature review approach, synthesizing findings from research conducted between 2017 and 2024. Relevant studies were analyzed to identify patterns in attachment styles and emotion regulation strategies. Results: The findings indicate that non-dating adolescents tend to develop secure attachment patterns and primarily utilize cognitive reappraisal as their emotion regulation strategy. This is reinforced by strong family religious values and structured social support systems. Conclusion: The study underscores the significant role of religious coping mechanisms in fostering emotional resilience and reducing psychological distress among Muslim adolescents. It highlights the importance of structured support systems in shaping secure attachment and adaptive emotion regulation. Contribution: These findings have theoretical, practical, and managerial implications, suggesting the need for faith-based mental health programs, educational interventions, and further cross-cultural research on Muslim adolescent psychology.

Abstract

An increase in the number of motorized vehicles which is directly proportional to the number of traffic violations is a common phenomenon. The Electronic Traffic Law Enforcement (ETLE) system is a modern initiative in handling traffic violation cases committed by the police. This system uses technology to detect, record and take action against traffic violations electronically. Electronic Traffic Law Enforcement (ETLE) is a traffic law enforcement system that uses CCTV camera technology to detect and record traffic violations automatically. ETLE (Electronic Traffic Law Enforcement) is a modern system that utilizes electronic technology to carry out traffic supervision and law enforcement. This research will discuss the Implementation of Electronic Traffic Law Enforcement (ETLE) at the Polda Metro Jaya Traffic Directorate and the Obstacles to the Implementation of Electronic Traffic Law Enforcement (ETLE) at the Metro Jaya Police Traffic Directorate. The legal research method used is a normative juridical legal research method supported by empirical data. Using a statutory approach and a conceptual approach. obtained from primary, secondary and tertiary legal material sources. Implementation of Electronic Traffic Law Enforcement (ETLE) at the Traffic Directorate of Polda Metro Jaya, namely Installation of CCTV Cameras, Data Integration, Confirmation Letters, Action against Violations and Payment of Fines. Obstacles in the Implementation of Electronic Traffic Law Enforcement (ETLE) at the Traffic Directorate of Polda Metro Jaya are Lack of Facilities and Infrastructure, Data Incompatibility, Lack of Socialization to the Community, Limited Personnel for Supervising Electronic Traffic Law Enforcement (ETLE) and Public Awareness in Low Traffic.

Abstract

Illegal street racing is a social issue. Street racing is a race conducted outside official circuits, on public roads or other open areas not designated for racing. Street racing often involves various types of vehicles, including cars, motorcycles, and bicycles. This activity is frequently unregulated by law or lacks official permits, and is deemed highly dangerous for participants and the general public due to non-compliance with applicable rules. Sanctions can be imposed. The juridical-normative research employs primary and secondary data. The discussion results in law enforcement efforts both through preventive and repressive measures. According to Law Number 22 Year 2009, punitive measures include a fine of Rp. 3,000,000.00 under Article 309, and, to serve as a deterrent effect, the police can impound vehicles for two months. A managerial challenge faced by the Police is the passive or indifferent attitude of some members of the public towards illegal motorcycle racing actions.
