Abstract

Technological progress is a necessity faced by humans, because human intelligence has succeeded in creating various devices that are increasingly displaying the sophistication of the previous form. Its presence has had a major influence on the system of human life, where the role of these communication tools has been able to shift some of the roles of humans, and users are increasingly pampered with various applications and features that provide various conveniences for them in carrying out their daily activities. Previously, humans needed to use time specifically to buy food, for example, with the presence of smartphones, they only needed to open an application that served as a delivery person for goods and food. Then order the desired food then in a few moments the food will be delivered to the address without the need to go to a restaurant or stall. This is an example of consumers being spoiled by smartphones that are present in the current era. In addition to having applications and features that can help humans in their daily needs, smartphones also do not forget applications related to human spiritual activities. The developers continue to create and improve various applications that can help humans get closer to their Lord even though they are in places that are not specifically provided for worship. If previously a Muslim wanted to read the Qur'an for example, they needed to bring the Qur'an in the form of a special Mushaf or they needed to go to a special place such as a mosque, surau or other. With the presence of a smartphone, they only need to open the Qur'an application and can read it immediately. The problem that arises then is that the writing of the verses of the Qur'an must be respected by Muslims, then whether the writing of the verses of the Qur'an in smartphones is considered the same as the writings in the manuscripts. This is what makes the writer interested in studying this problem in a relatively short article by referring to the standard fiqh provisions.

Abstract

The regulation on marriage dispensation has encouraged the increase in early marriage in various regions in Indonesia, including in Bener Meriah, Aceh.  Early  marriage  has  a  negative  impact  on  family  resilience  as  it  raises problems leading to divorce. This is a normative legal study with a case study approach. Data collection was carried out employing a document study, namely Sharia Court Decisions and related literature. This study concludes a significant relationship  between  marriage  dispensation,  high  underage  marriages,  and weak family resilience. In granting marriage dispensation, the Sharia Court judges consider legal and extra-legal grounds. The dispensation stipulation has met  the  legal  requirement,  although  the  legal  reasonings  are  unconvincing. Furthermore, early marriage has an impact on increasing divorce rates due to issues such as psychological problems and reproductive readiness, as well as adverse effects caused by divorce. Therefore, concrete and strategic steps are needed  with  the  involvement  of  various  groups,  including  the  government, ulama, and traditional leaders, who are able to promote family resilience in society.Keywords: marriage dispensation; underage marriage; family resilience; sharia court AbstrakKebijakan dispensasi nikah telah mendorong peningkatan pernikahan dini  di  berbagai  daerah  di  Indonesia,  termasuk  di  Bener  Meriah,  Aceh. Pernikahan  dini  berdampak  negatif  terhadap  ketahanan  keluarga  karena menimbulkan masalah yang berujung pada perceraian. Penelitian ini merupakan penelitian  hukum  normatif  dengan  pendekatan  studi  kasus.  Pengumpulan data  dilakukan  dengan  studi  dokumen  yaitu  Putusan  Mahkamah  Syar’iyah dan literatur terkait. Penelitian ini menyimpulkan bahwa terdapat hubungan yang signifikan antara dispensasi perkawinan, tingginya angka perkawinan di bawah umur dan lemahnya ketahanan keluarga. Dalam pemberian dispensasi nikah,  hakim  Mahkamah  Syar’iyah  mempertimbangkan  alasan  hukum  dan alasan di luar hukum. Ketentuan dispensasi tersebut telah memenuhi syarat hukum,  meskipun  pertimbangan  hukumnya  tampak  memaksakan.  Lebih lanjut,  pernikahan  dini  berdampak  pada  meningkatnya  angka  perceraian karena masalah-masalah seperti masalah psikologis dan kesiapan reproduksi, serta dampak buruk akibat perceraian. Oleh karena itu, diperlukan langkah- langkah  konkrit  dan  strategis  dengan  melibatkan  berbagai  pihak,  termasuk pemerintah,  ulama,  dan  tokoh  adat,  yang  mampu  mendorong  ketahanan keluarga dalam masyarakat.Kata Kunci: dispensasi  pernikahan;  pernikahan  dini;  ketahanan  keluarga; Mahkamah Syar’iyah

Abstract

This study aims to find factors for the emergence and development of the Shafií School of legal thought and the role of al-Nawawī as a unifier of these thoughts. Legal thought in the Shafií school of thought at the beginning of the revival of the school was very diverse, so this also affected the legal analogy that developed between one region and another. This research is a qualitative research, in which the data were analyzed by using content analysis based on the text of the thoughts of the scholars. Based on the results of the study, it can be understood that the birth of various styles of thought in the Shafií school was caused by the different methods of thinking of the scholars from different regions in developing the Shafií school of thought, such as the areas of Iraq and Khurasan. Iraqi scholars prefer the riwāyah method while Khurasan scholars prefer the dirāyah method. In addition, each of these styles of thinking has advantages and disadvantages. The advantage of the Iraqi style is in the transmission of mazhab opinions and the rules of ijtihad, so that this style of thinking is considered stronger than Khurasan, while the Khurasan style lies in the systematic method of legal development, so that this style is considered better in legal development cases. The weakness of the Iraqi style of thought is in terms of takhrīj and tafrī’ compared to the Khurasan style, while the Khurasan style is weak in terms of the accuracy of the transmission of opinions compared to the Iraqi style. This has inspired the scholars who lived afterward, such as al-Nawawī (d. 676 H) to initiate the unification of these styles of thought. Therefore, al-Nawawī is seen as the most representative of the Shafi'iyyah scholars in developing the Shafi'i school.

Abstract

This study aims to analyze the influence of Imam al-Nawawī's ikhtiyārāt (personal scholarly preferences) on the development of Shāfiʻī jurisprudence, particularly in altering the landscape of Shāfiʻī school thought, enriching the scholarly tradition, affirming the school’s opinions, and serving as a basis for legal fatwas. The research employed a qualitative method with a library research approach, involving an analysis of the book Rauḍat al-Ṭālibīn and other Shāfiʻī literature sources. Data were collected through document review and analyzed descriptively and analytically. The results indicate that al-Nawawī's ikhtiyārāt have reshaped the thought patterns of the Shāfiʻī school, establishing themselves as a primary reference in resolving disputed issues (khilafiyah). Furthermore, al-Nawawī’s innovations have enriched the intellectual heritage of the school and strengthened the affirmation of its opinions. These ikhtiyārāt have also become a crucial foundation in the issuance of legal fatwas. The implications of this research underscore al-Nawawī’s role as one of the leading scholars of the Shāfiʻī school, whose innovative thoughts and perspectives have significantly contributed to the development of Islamic jurisprudence.
