Abstract

Marriage is a sacred bond to build an everlasting household. Regarding the marriage of a woman who is pregnant out of wedlock is a disgrace that some families must cover, so they are looking for a solution by marrying the pregnant woman. However, the problem is the legality of marriage for pregnant women out of wedlock according to Islamic law and Indonesian laws and regulations. This study uses a qualitative research method with a normative juridical approach because it relates to the validity of a law. The results of the study concluded that the marriage of a woman who is pregnant with the man who impregnated her is valid according to Islamic law, even though there are differences of opinion among the Maliki and Hanbali schools of thought that declare it invalid. According to the rules and regulations, it is also stated that it is legal based on KHI article 53, which explains that a woman pregnant out of wedlock can marry the man who made her pregnant.

Abstract

This study aims to find factors for the emergence and development of the Shafií School of legal thought and the role of al-Nawawī as a unifier of these thoughts. Legal thought in the Shafií school of thought at the beginning of the revival of the school was very diverse, so this also affected the legal analogy that developed between one region and another. This research is a qualitative research, in which the data were analyzed by using content analysis based on the text of the thoughts of the scholars. Based on the results of the study, it can be understood that the birth of various styles of thought in the Shafií school was caused by the different methods of thinking of the scholars from different regions in developing the Shafií school of thought, such as the areas of Iraq and Khurasan. Iraqi scholars prefer the riwāyah method while Khurasan scholars prefer the dirāyah method. In addition, each of these styles of thinking has advantages and disadvantages. The advantage of the Iraqi style is in the transmission of mazhab opinions and the rules of ijtihad, so that this style of thinking is considered stronger than Khurasan, while the Khurasan style lies in the systematic method of legal development, so that this style is considered better in legal development cases. The weakness of the Iraqi style of thought is in terms of takhrīj and tafrī’ compared to the Khurasan style, while the Khurasan style is weak in terms of the accuracy of the transmission of opinions compared to the Iraqi style. This has inspired the scholars who lived afterward, such as al-Nawawī (d. 676 H) to initiate the unification of these styles of thought. Therefore, al-Nawawī is seen as the most representative of the Shafi'iyyah scholars in developing the Shafi'i school.

Abstract

This paper aims to answer the question of why breast milk can cause mahramiyah of breastfeeding in the same way as sperm can cause mahramiyah of nasab. Breast milk is food for babies that serves to grow flesh and strengthen bones. On the other hand, breast milk is a liquid that comes out of the human body, similar to blood. However, breastfeeding a baby who has not reached the age of two years can cause mahramiyah, which is the same as mahramiyah caused by sperm. This is different from blood transfusions, which do not have any legal consequences. The research method used is a descriptive qualitative research method. The data collection technique is documentation review sourced from classical literature and scientific journals. After the data is collected, it is analyzed using content analysis techniques. The results show that breast milk has a correlation with sperm so that it can cause a mahramiyah relationship to be established. This is because breast milk contains genes as found in sperm, so that the genes owned by the mother will be inherited to the child when she is breastfed. The similarity of the inherited genes is what causes a negative impact on offspring in the event of marriage, so Islam states that there is a mahramiyah relationship from breastfeeding.

Abstract

This article explores the contribution of Islamic Religious Education (PAI) and Civic Education (PKn) to the achievement of the Sustainable Development Goals (SDGs) 2030, particularly Goal 4 (quality education) and Goal 16 (peace, justice, and strong institutions). Employing a literature review method, this study examines scholarly works related to the roles of PAI and PKn in strengthening character, morality, civic literacy, as well as national and religious values. The findings reveal that PAI fosters ethics, spirituality, and religious moderation, while PKn emphasizes democracy, tolerance, and legal awareness. Their synergy creates an educational model that shapes citizens who are both religious and democratic, thus aligning with the objectives of the SDGs 2030. This research contributes theoretically by enriching integrative literature on PAI and PKn, and practically by providing implications for strengthening the national education curriculum based on character, nationalism, and religious values.ABSTRAKArtikel ini membahas kontribusi Pendidikan Agama Islam (PAI) dan Pendidikan Kewarganegaraan (PKn) dalam mendukung pencapaian Sustainable Development Goals (SDGs) 2030, khususnya tujuan ke-4 (pendidikan berkualitas) dan tujuan ke-16 (perdamaian, keadilan, dan kelembagaan yang kuat). Penelitian ini menggunakan metode kajian pustaka dengan menelaah berbagai literatur terkait peran PAI dan PKn dalam penguatan karakter, moralitas, civic literacy, serta nilai-nilai kebangsaan dan religiusitas. Hasil kajian menunjukkan bahwa PAI berperan dalam menanamkan akhlak, spiritualitas, dan moderasi beragama, sedangkan PKn menekankan demokrasi, toleransi, dan kesadaran hukum. Sinergi keduanya menghasilkan model pendidikan yang mampu membentuk warga negara religius sekaligus demokratis, sehingga relevan dengan pencapaian SDGs 2030. Penelitian ini menawarkan kontribusi teoritis berupa pengayaan literatur integratif PAI-PKn serta implikasi praktis bagi penguatan kurikulum pendidikan nasional berbasis karakter, kebangsaan, dan nilai keagamaan.

Abstract

This study originates from the absence of a functional theory that systematically explains the legal status of joint marital property within the framework of Islamic law. Previous studies have predominantly focused on normative aspects such as shirkah (partnership), maintenance (nafaqah), and hibah (gifts), without conceptualizing joint property as an instrument for protecting the reciprocal rights of spouses. This theoretical gap raises critical questions regarding how Islamic jurisprudence can respond to the demands of modern legal systems that emphasize legal certainty, economic justice, and mutual protection within marriage. Accordingly, this research aims to formulate a Functional Theory of Joint Marital Property from an Islamic perspective through the integration of classical fiqh principles, social functionalist theory, and the local wisdom of the Indonesian archipelago (Nusantara). The study employs a library-based research method with normative analysis, utilizing approaches from usul al-fiqh, legal hermeneutics, and social systems theory. This multidimensional approach enables the identification of principles of reciprocity, public interest (maslahah), and rights protection embedded in classical fiqh texts, as well as their relevance to the Indonesian legal system. The findings indicate that joint marital property serves three primary functions: a protective function safeguarding the rights of both spouses; a stabilizing function ensuring the continuity and resilience of the household; and an integrative function that harmonizes Islamic jurisprudence with the requirements of modern legal frameworks. This functional theory of joint marital property constitutes a novel contribution to the development of Islamic family law in Indonesia and may serve as a foundational framework for regulatory reform, the formulation of jurisprudential guidelines, and the strengthening of rights-based protection mechanisms within marriage.

Abstract

This study analyzes strategies for implementing Pancasila values in the learning process aimed at shaping moderate, tolerant, and patriotic character among students of the Primary School Teacher Education (PGSD) Program at Universitas Serambi Mekkah. Employing a qualitative field research design, data were collected through classroom observations, in-depth interviews with lecturers and students, and documentation of instructional materials, including Semester Learning Plans (RPS), teaching resources, and academic activity records. Data analysis was conducted using descriptive qualitative techniques encompassing data reduction, data presentation, and conclusion drawing, and was reinforced by a review of relevant literature on radicalism, ideological education, and the internalization of Pancasila values in higher education. The findings reveal that the internalization of Pancasila values through contextual learning strategies, such as dialogical discussions, reflective learning, case-based instruction, the strengthening of ideological literacy, and lecturers’ exemplary conduct, contributes significantly to enhancing students’ awareness of diversity, religious moderation, and national unity. Students not only acquire cognitive understanding of Pancasila but also demonstrate the practical internalization of its values in their daily social interactions. This process strengthens students’ ideological resilience and reduces their susceptibility to radical narratives within the campus environment. The study concludes that learning Pancasila ideology plays a strategic role in preventing radicalism and serves as a fundamental pillar for reinforcing students’ national identity. These findings emphasize the importance of strengthening ideological education in a systematic and sustainable manner to foster a moderate, inclusive, and nationally oriented academic environment.
