Abstract

Sufism has long been associated with tolerance because of its theological nature that focuses on inner peace. However, this view tends to overlook that Sufi movements are often involved in politics and nationalist discourse. This study explains the social movement logic of a tarekat movement in Indonesia in promoting tolerance and nationalism. JATMAN (Jam’iyyah Ahl al-Thariqot al-Mu’tabarah an-Nahdliyyah) is well-known as a Sufi group currently led by Habib Luthfi. This movement calls to Bela Negara (defending Indonesia) by the jargon ‘NKRI Harga Mati’ (the doctrine of love for the homeland) and Handarbeni (being proud to locality). This research employs multiple analysis methods to examine the factors that underpin the emergence of this movement. I analyzed Habib Luthfi bin Yahya’s lectures (Rais 'Amm JATMAN) from 2020-2021, scattered on several online media such as YouTube and Instagram. Besides, I conducted interviews with several kiai in Idarah 'Aliyah (the central administrator of JATMAN) and I analyzed dozens of events organized by JATMAN in online media. Drawing on social movement theory, I argue that various motivations are overshadowed by the emergence of JATMAN within nationalism. This movement may not only be driven by piety and theological doctrine (Sufism) but also by social movement logics such as political opportunity structure, resource mobilization, and cultural framing.

Abstract

Youth is a part of the structure of society that is vulnerable to being exposed to radicalism. According to a report from the Setara Institute 2011-2012, cases of intolerance that occur in Indonesia are often committed by youth, especially high school age teenagers. In 2017, there has been a spread of religious radicalism doctrine in Batang carried out by several religious leaders towards high school youth age. In response to that, a group of youths in Batang formed a youth community aimed to counteract the spread of radicalism in Batang, Komunitas Santri Batang (KSB). This study wants to see the extent to which the role of youth represented by the KSB against religious radicalism by campaigning for the idea of 'religious moderation'. This study formulates two problems related to the role of youth in campaigning for religious moderation, (1) What is the strategy of the KSB in promoting religious moderation idea? (2) how effective are the programs organized by the KSB related to the prevention of radicalism among youth groups? To answer these questions, the researcher will interview several members of the KSB and participants of the KSB programs. The results of this study indicate that there is synergy between the KSB youth and several agencies in cultivating moderation and diversity dialogue among the community. This can be seen through the KSB community strategy in countering religious radicalism using an inclusive approach and social engagement dialogue. Also, KSB pays attention to strengthening intra-religious relations by involving various youths from different religious mass organization backgrounds in several activities. This strategy is considered effective to counter religious radicalism which often attacks young people.

Abstract

This article examines the criminal law policy in Indonesia regarding the increasing incidence of sexual violence crimes, primarily affecting women. The study adopts a literature research approach, utilizing data from legal regulations in Indonesia and various scholarly works related to the subject. Employing a gender equality approach and maqāsid al-sharī'a, the article concludes that while Indonesia possesses legal regulations addressing sexual crimes, these laws are dispersed across different statutes, resulting in diminished effectiveness. The enactment of the Law on Sexual Violence (UU TPKS) in 2022 signifies a noteworthy development in Indonesia's legal framework concerning sexual violence. This legislation is structured in a more organized and comprehensive manner, incorporating several reforms. Consequently, it instills optimism for enhanced endeavors to eliminate and prevent sexual violence. From an Islamic standpoint, the regulation of sexual violence aligns with the fundamental principles and objectives of Islamic law (maqāsid al-sharī'a). These principles aim to actualize the well-being and benefit of humanity while simultaneously preventing crimes that pose threats to human existence and dignity.

Abstract

This study examines the alignment between Pancasila values and religious moderation in Indonesia's criminal law reform. The old Criminal Code, inherited from the colonial era, has been criticized for its lack of social justice and religious freedom. The key problem addressed is how the new Criminal Code can embody Pancasila values while preventing religious radicalism and extremism. Observations focus on articles in the old code that are seen as unresponsive to human rights and plurality. A juridical-normative approach is employed, analyzing the new Criminal Code's relationship with Pancasila and religious moderation principles. The analysis includes primary legal documents, such as the new Criminal Code, and relevant secondary literature. Philosophical, historical, and normative methods are used to develop legal logic aligned with Pancasila, aiming to solve the problem of religious intolerance. The results indicate that the new Criminal Code introduces significant reforms to protect religious freedom, focusing on preventing radicalism and enhancing rehabilitative sanctions. These reforms represent a major step towards a more inclusive and just legal system. The conclusion drawn is that the new Criminal Code is expected to harmonize criminal law with Pancasila values and religious moderation, providing more humanistic and preventive approaches to religious issues. This research contributes by offering a new perspective on criminal law reform that emphasizes national values and presents a legal model more suited to Indonesia’s diverse society.
