Abstract

Sexual violence is increasingly massive in the educational environment, and several cases have even been recorded in Islamic boarding schools. The phenomenon of sexual violence in Islamic boarding schools has occurred several times in Central Java. Santri in this case are the weak, apart from being underage, they are also helpless with the power relations built by adults as supervisors in the pesantren, you can call them kiai, ustad, seniors or colleagues. This community service aims to increase knowledge and understanding of the academic community of Islamic boarding schools about the importance of preventing and overcoming crimes of sexual violence that occur in Islamic boarding schools. This service is carried out by introducing the problem of sexual violence that occurs in Islamic boarding schools. This is intended so that the pesantren academic community knows the legal basis for sexual violence, approaches to handling it, and institutions that can resolve sexual violence. The results of this dedication show that there is an increase in the knowledge and awareness of the pesantren academic community about their responsibilities in preventing and overcoming sexual violence crimes within the pesantren environment. The pesantren community with very high understanding increased from 10% to 65%. Meanwhile, the low understanding of the Islamic boarding school community regarding obligations and responsibilities in preventing and overcoming sexual violence crimes decreased from 50% to 10%. That all pesantren communities have the same roles and responsibilities in realizing peace and comfort in the pesantren environment.

Abstract

This article examines the protection of the constitutional rights of Pekalongan's women coastal workers against the loss of land rights due to sea flooding. Based on data from the Pekalongan Regional Disaster Management Agency (BPBD), in the last five years, more than 40% of the land in this coastal area has been submerged, affecting women's livelihoods. The juridical problem is that the Basic Agrarian Law (UUPA) does not regulate state compensation for destroyed land. Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 3 of 2024 on Amendments to Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 17 of 2021 on Procedures for Determining Land Destruction states that land parcels affected by tidal floods in Pekalongan can be categorized as land destruction. Land rights holders are given priority for reconstruction or reclamation within one year and receive a kerohiman fund if the land is used or reconstructed by the government. This research uses agrarian law and Islamic law approaches to evaluate the existing legal protections. The results show that constitutional protection for coastal women workers in Pekalongan already exists, but there are still some weaknesses. In addition, the practice of such protection has not been maximized. Some of these things are the main causes of inadequate legal protection of the rights of women coastal workers. Islamic law provides a more inclusive perspective on property rights and social justice, but its implementation is limited. This research contributes to the understanding of agrarian regulations in providing protection and compensation for women coastal workers as well as the understanding of Islamic principles in maintaining justice and welfare for those affected by tidal floods.   Artikel ini mengkaji perlindungan hak konstitusional perempuan buruh pesisir pantai Pekalongan terhadap hilangnya hak atas tanah akibat rob. Berdasarkan data dari Badan Penanggulangan Bencana Daerah (BPBD) Pekalongan, dalam lima tahun terakhir, lebih dari 40% tanah di wilayah pesisir ini telah terendam, yang berimbas pada mata pencaharian perempuan. Masalah yuridis yang dihadapi adalah bahwa Undang-Undang Pokok Agraria (UUPA) tidak mengatur kompensasi negara bagi tanah yang musnah. Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Republik Indonesia Nomor 3 Tahun 2024 tentang Perubahan atas Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 17 Tahun 2021 tentang Tata Cara Penetapan Tanah Musnah menyatakan bahwa bidang tanah yang terdampak banjir rob di Pekalongan dapat dikategorikan sebagai tanah musnah. Pemegang hak atas tanah diberikan prioritas untuk rekonstruksi atau reklamasi dalam satu tahun dan mendapatkan dana kerohiman jika tanah digunakan atau direkonstruksi oleh pemerintah. Penelitian ini menggunakan pendekatan hukum agraria dan hukum Islam untuk mengevaluasi perlindungan hukum yang ada. Hasil penelitian menunjukkan bahwa perlindungan konstitusional bagi pekerja perempuan pesisir di Pekalongan sudah ada, tetapi masih terdapat beberapa kelemahan. Selain itu, praktik perlindungan tersebut belum maksimal. Beberapa hal inilah yang menjadi penyebab utama belum memadainya perlindungan hukum terhadap hak-hak perempuan buruh pesisir. Hukum Islam memberikan perspektif lebih inklusif tentang hak milik dan keadilan sosial, tetapi implementasinya terbatas. Penelitian ini berkontribusi pada pemahaman mengenai regulasi agraria dalam memberikan perlindungan dan kompensasi bagi perempuan buruh pesisir serta pemahaman prinsip-prinsip Islam dalam menjaga keadilan dan kesejahteraan bagi pihak yang terdampak banjir rob.

Abstract

Legal awareness of a rule is important to have because with it a person will be able to carry out their professional duties and roles well in society. Thus, this community service activity took the form of an effort to increase legal awareness aimed at library staff at UIN Gusdur Pekalongan. The legal awareness that wants to be increased in this case is legal understanding of Law no. 43 of 2007 which regulates libraries. The main objective of this service activity is so that the activity participants have legal awareness of the library law. The method used in this service activity took the form of exposure-socialization using the format of in-house training (IHT). The result of this service activity is increased legal awareness and legal commitment for library staff to be able to carry out their professional duties in providing library services well

Abstract

Divorceify is an Artificial Intelligence (AI)-based platform designed to assist in managing divorce processes within a divorce accounting system. However, applying this platform in Indonesia’s legal system may face several challenges. This article examines the extent of Divorceify’s role and influence within the judicial system. It also delves into the challenges and future impacts of using Divorceify in Indonesia’s legal system. Using normative research methods with a conceptual approach, this article asserts that in the context of Indonesian law, the adoption of such technology faces various obstacles, including alignment with local legal frameworks, cultural sensitivities, access and education on technology, and data privacy issues. Indonesia’s legal system can adapt to this innovation in order to improve efficiency and fairness in divorce proceedings, as it is seen as capable of enhancing efficiency, reducing costs, providing fairer outcomes, and alleviating administrative burdens on courts. Additionally, critical obstacles must be addressed to ensure successful integration, especially regarding legal ethics and personal data protection. With the appropriate regulatory, ethical, and technological frameworks, AI-based divorce management tools like Divorceify hold significant potential to improve Indonesia’s judicial system.

Abstract

Non-performing financing is not expected by financial institutions that provide financing products because it can cause losses to financial institutions. The purpose of this study is to analyze the supporting and inhibiting factors in efforts to resolve problematic murabahah financing at KSPPS BMT Mitra Umat Pekalongan Krapyak Branch in 2021 and analyze the suitability of efforts to resolve problematic murabahah financing at KSPPS BMT Mitra Umat Pekalongan Krapyak Branch in 2021 with the DSN-MUI Fatwa and KHES. This type of research is sociological law with data collection techniques through interviews and documentation. The results of the study show that the supporting factors in efforts to resolve problematic murabahah financing are supervision and communication with customers; customer awareness and good faith; cooperative customers to the agreement; as well as the existence of a team of lawyers who provide a deterrent effect. The inhibiting factor is the character of the customer; customer dishonesty; unstable economic condition; and customers are reluctant to sell collateral. There is a discrepancy with the provisions of the DSN-MUI fatwa and KHES, namely the point of debt relief at the guarantee execution stage, the point of converting a contract. KSPPS BMT Mitra Umat Pekalongan Krapyak Branch does not apply sanctions to customers who delay payments, but charges compensation for transportation costs when billing the customer's home.

Abstract

This article examines the criminal law policy in Indonesia regarding the increasing incidence of sexual violence crimes, primarily affecting women. The study adopts a literature research approach, utilizing data from legal regulations in Indonesia and various scholarly works related to the subject. Employing a gender equality approach and maqāsid al-sharī'a, the article concludes that while Indonesia possesses legal regulations addressing sexual crimes, these laws are dispersed across different statutes, resulting in diminished effectiveness. The enactment of the Law on Sexual Violence (UU TPKS) in 2022 signifies a noteworthy development in Indonesia's legal framework concerning sexual violence. This legislation is structured in a more organized and comprehensive manner, incorporating several reforms. Consequently, it instills optimism for enhanced endeavors to eliminate and prevent sexual violence. From an Islamic standpoint, the regulation of sexual violence aligns with the fundamental principles and objectives of Islamic law (maqāsid al-sharī'a). These principles aim to actualize the well-being and benefit of humanity while simultaneously preventing crimes that pose threats to human existence and dignity.   Artikel ini mengkaji kebijakan hukum pidana di Indonesia dalam mengatasi praktik tindak pidana kekerasan seksual yang cenderung meningkat dari waktu ke waktu dan perempuan adalah pihak yang paling banyak menjadi korban tindak kejahatan ini. Artikel ini merupakan penelitian kepustakaan yang sumber datanya didasarkan pada peraturan-peraturan hukum di Indonesia dan sejumlah karya ilmiah yang berkaitan dengan topik kajian ini. Menggunakan pendekatan kesetaraan gender dan maqāsid al-sharī’a artikel ini menyimpulkan bahwa Indonesia sebenarnya telah memiliki sejumlah peraturan hukum tentang tindak pidana kejahatan seksual. Namun demikian, aturan-aturan hukum tersebut disusun secara parsial dan tersebar di berbagai peraturan perundang-undangan sehingga menjadikannya kurang efektif. Lahirnya Undang-undang Tindak Pidana Kekerasan Seksual (UU TPKS) pada tahun 2022 menandai adanya perkembangan baru dalam pengaturan hukum tindak pidana kekerasan seksual di Indonesia. Undang-undang ini disusun secara lebih sistematis dan komprehensif dengan sejumlah pembaruan yang ada di dalamnya sehingga ia telah memberikan harapan baru bagi upaya pemberantasan dan pencegahan terhadap praktik kekerasan seksual. Dalam perspektif Islam, pengaturan tentang tindak pidana kekerasan seksual ini selaras dengan prinsip dasar dan tujuan disyariatkannya hukum Islam (maqāsid al-sharī’a), yang ingin mewujudkan kebaikan dan kemaslahatan umat manusia dan sekaligus mencegah terjadinya tindakan kejahatan yang bisa mengancam eksistensi dan kehormatan manusia.

Abstract

This study examines the alignment between Pancasila values and religious moderation in Indonesia's criminal law reform. The old Criminal Code, inherited from the colonial era, has been criticized for its lack of social justice and religious freedom. The key problem addressed is how the new Criminal Code can embody Pancasila values while preventing religious radicalism and extremism. Observations focus on articles in the old code that are seen as unresponsive to human rights and plurality. A juridical-normative approach is employed, analyzing the new Criminal Code's relationship with Pancasila and religious moderation principles. The analysis includes primary legal documents, such as the new Criminal Code, and relevant secondary literature. Philosophical, historical, and normative methods are used to develop legal logic aligned with Pancasila, aiming to solve the problem of religious intolerance. The results indicate that the new Criminal Code introduces significant reforms to protect religious freedom, focusing on preventing radicalism and enhancing rehabilitative sanctions. These reforms represent a major step towards a more inclusive and just legal system. The conclusion drawn is that the new Criminal Code is expected to harmonize criminal law with Pancasila values and religious moderation, providing more humanistic and preventive approaches to religious issues. This research contributes by offering a new perspective on criminal law reform that emphasizes national values and presents a legal model more suited to Indonesia’s diverse society.

Abstract

Pesantren, Islamic educational institutions in Indonesia, traditionally provide dormitories for santri, students dedicated to religious studies from childhood through adolescence. However, adolescence often coincides with heightened curiosity about sexuality, leading to behaviors like "Mairil" and "Nyempet." Mairil involves affectionate interactions between individuals of the same gender, which can escalate to physical actions known as Nyempet, distinct from sodomy. This socio-legal study employs a qualitative approach focusing on substantive justice in criminal policy. The research underscores that Mairil and Nyempet constitute forms of sexual violence prevalent in pesantren. Despite inconsistencies with religious norms and criminal law, enforcement remains inadequate. It advocates for a comprehensive approach involving pesantren and competent authorities to tackle these issues. Key recommendations include enhancing victim protection, enforcing existing laws rigorously, and raising societal awareness through education on individual rights and humanitarian principles. In conclusion, addressing Mairil and Nyempet requires concerted efforts from all stakeholders to ensure justice, protect victims, and promote a more inclusive understanding within Indonesian society and its educational institutions.

Abstract

The Covid-19 pandemic profoundly impacted Indonesia's stability, yet amidst these challenges, a senior official within the Ministry of Social Affairs engaged in corrupt practices related to social grants, an offense stipulated under Article 2 paragraph (2) of Law No. 20 of 2001, amending Law No. 31 of 1999 on Corruption, which mandates the death penalty. This research examines the tension between imposing the death penalty on corruption offenders during emergencies and the human rights perspective, particularly in Indonesia. Employing a qualitative normative juridical method rooted in criminal law and human rights standards, the study reveals that despite the provision allowing for the death penalty for corruption during Covid-19, Indonesia adopts a moderately particularistic human rights stance that regards human rights as universal principles while addressing national concerns. The study highlights Indonesia's nuanced approach to human rights in the context of criminal justice, particularly concerning the application of the death penalty to corruption offenders during crises. It underscores the country's effort to uphold human rights as universal while recognizing national circumstances. This research contributes to ongoing scholarly debates on the intersection of emergency measures, criminal justice, and human rights, offering insights into how states navigate legal provisions in times of crisis to maintain stability without compromising fundamental rights. The findings provide a critical perspective for policymakers, legal practitioners, and human rights advocates grappling with issues of justice and rights protection amid global emergencies.

Abstract

Handling sexual violence cases requires a holistic, human rights-based approach, encompassing prevention, protection, law enforcement, recovery, and ensuring victims' access to justice. Islam advocates equality for all, but its implementation is constrained by the improper handling of many sexual violence cases due to the non-retroactive Sexual Violence Law. This paper proposes the urgency of upholding the principle of retroactivity in criminal law and Fiqh Jinayah to build an anti-sexual violence construction based on justice and equality. This normative juridical research employs conceptual, statutory, philosophical, and historical approaches. This approach provides an in-depth understanding of the concept of justice in the handling of sexual violence, according to Sharia. This study uses the Islamic legal literature and comparative legal studies to examine the urgency of upholding the retroactive principle in criminal law and Fiqh Jinayah. This study confirms that applying the retroactive principle to sexual violence is consistent with the six characteristics of Maqasid Sharia: cognitive nature, interconnectedness, wholeness, openness, multidimensionality, and purposefulness. The retroactive principle is necessary in cases of sexual violence as the primary rule in addressing such crimes, in addition to complementing existing laws and regulations. This principle is crucial to ensure fair law enforcement in cases of sexual violence.
