Abstract

This study examines the empowerment of waste pickers at the Tamangngapa Final Waste Disposal Site (TPA) in Manggala District from the perspective of Siyasah Syar’iyah. The focus includes the realities of waste pickers’ lives, existing empowerment efforts, and an analysis based on Siyasah Syar’iyah principles. This qualitative research employs a syar’i and juridical approach. The findings reveal that waste pickers at TPA Tamangngapa live in highly concerning conditions, marked by limited education, inadequate skills, and poor living facilities. No specific empowerment programs from relevant institutions were found to target this group directly. From a Siyasah Syar’iyah perspective, this situation reflects a weak role of the state in protecting and empowering marginalized communities. The study recommends the development of government policies focused on empowering waste pickers based on social justice and Islamic legal principles to achieve sustainable well-being.

Abstract

This study aims to determine the procedures for using the Online Single Submission (OSS) system and the impact on society based on the perspective of Siyasah Syariah at the Investment and One-Stop Service Office of Gowa Regency, while the issues raised are the licensing mechanism through the Online Single Submission (OSS) system and the impact accepted by society from the point of view of Siyasah Syar'iah. The research uses normative syar'I and normative juridical research approaches, qualitative descriptive research types, research locations in DPM-PTSP Kab. Gowa, secondary data sources in the form of literature such as journals, thesis books and primary data in the form of interviews, observation and documentation, techniques and processing used display, editing, reduction, analysis and conclusions. The findings obtained are, Licensing through the OSS system at PTSP Kab. Gowa has shown a positive impact on the community, both in terms of procedures for using the system and the benefits obtained by the community with the system, which illustrates that it has been running well in accordance with the service principles of simplicity and convenience, so that this is in accordance with what is contained in several concepts. Siyasah Syar'iyah, namely maslahah mursalah and maslahah al-'ammah regarding the formation of government policies must provide benefits for the whole community

Abstract

This research aims to describe the application of the Retroactive Principle in Human Rights Violations. The assertion of human rights in Indonesia experiences a very definite dilemma in law enforcement considering the many past human rights violations that have not been resolved. Thus, this research uses a type of library research with a normative juridical approach and a syar'I approach. This data collection method involves studying several primary data sources extracted from scientific works, documents and relevant books. The research results show that the retroactive principle is a principle or legal principle that can be implemented in upholding human rights, with 4 cumulative conditions, namely: 1) The criminal act committed is a serious human rights violation; 2) the nature of justice must be international; 3) justice is ad-hoc; 4) the government's inability to prosecute crimes, both in terms of cruelty and damage.
