Abstract

Kehidupan berumah tangga tidak sedikit yang berakhir dengan perceraian. Pembagian harta bersama dalam perkawinan menjadi masalah lain yang timbul setelah perceraian terjadi. Harta bersama adalah harta benda atau hasil kekayaan yang diperoleh selama berlangsungnya perkawinan. Meskipun harta tersebut diperoleh dari hasil kerja suami saja, isteri tetap memiliki hak atas harta bersama. Jadi, harta bersama meliputi harta yang diperoleh dari usaha suami dan isteri berdua atau usaha salah seorang dari mereka diatur lain dalam perjanjian perkawinan, apabila terjadi perceraian maka masing-masing pihak isteri maupun suami berhak atas separuh (seperdua) dari harta bersama.Permasalahan sering terjadi antara mantan suami dan isteri dalam pembagian harta bersama.

Abstract

Abstrak  Kondisi saat ini pemerintah desa di Kabupaten Cirebon dalam meyediakan informasi registrasi desa (letter C) masih menggunakan buku induk tanah yang rentan rusak karena kondisinya sudah lama dan belum diperbaharui. Proses pendaftaran tanah konversi hak tanah adat menjadi hak milik diperlukan suatu alat bukti salah satunya adalah registrasi desa (letter C). Untuk itu diperlukan, Pemerintah desa di Kecamatan Susukan Kabupaten Cirebon dapat berinovasi dengan memanfaatkan kemajuan teknologi dalam memberikan pelayanan registrasi desa (letter C) dengan konsep digitalisasi agar tercipta pemerintahan yang baik (good governance). Permasalahan penelitian ini tentang bagaimana peran Pemerintah Desa dalam memberikan pelayanan registrasi desa (letter C) di Kecamatan Susukan Kabupaten Cirebon dan bagaimana upaya Pemerintah Desa dalam memberikan pelayanan registrasi desa (letter C) dikaitkan dengan Instruksi Presiden Nomor 3 Tahun 2003 tentang Kebijakan dan Strategi Nasional Pengembangan e-government. Metode yang digunakan berupa penelitian yuridis empiris atau yuridis sosiologis. Spesifikasi penelitian ini adalah deskriptif analitis. Penelitian ini menggunakan data primer sebagai sumber data utama dan dibantu data sekunder sebagai sumber data pendukung. Data primer diperoleh dengan observasi dan wawancara. Pengumpulan data sekunder dilakukan dengan studi kepustakaan (library research).Kata kunci: Digitalisasi, Letter C, Optimalisasi, Pelayanan, Pandemi Covid-19. Abstract The current condition of the village government in the Cirebon Regency in providing village registration information (letter C) is still using the land master book which is vulnerable to damage because its condition is old and has not been updated. The land registration process for converting customary land rights into property rights requires evidence, one of which is village registration (letter C). For this reason, it is necessary that the village government in Susukan District, Cirebon Regency can innovate by utilizing technological advances in providing village registration services (letter C) with the concept of digitalization to create good governance. The problem of this research is how the role of the Village Government in providing village registration services (letter C) in Susukan District, Cirebon Regency, and how the Village Government's efforts in providing village registration services (letter C) are associated with Presidential Instruction Number 3 of 2003 concerning National Development Policies and Strategies e-government. The method used is in the form of empirical juridical research or sociological juridical research. The specification of this research is descriptive-analytical. This study uses primary data as the main data source and is assisted by secondary data as a source of supporting data. Primary data was obtained by observation and interviews. Secondary data collection is done by literature study (library research).Keywords: Digitization, Letter C, Optimization, Services, Pandemic Covid-19.

Abstract

This paper aims to determine to what extent Garuda totem is faced with covid-19 totem in the constitution of Indonesia. It begins with the pandemic hit a worldwide including Indonesia, all countries are busily making effective policies. Reviewing the existing policies, the president and the regional heads have an extraordinary role. A well-saying that the king can do no wrong while carrying out his policies. Many issues concerning the existence of Garuda totem are currently being in the spot light. Thus, this study focuses on the discussion upon the struggle of Garuda totem over the new totem that has changed the policy arrangement in Indonesia. A normative legal research method sets as a basis for conducting an analysis. The struggle made the existence of Garuda totem hits a polemic in the indonesian constitution. This so-called totem does not just apply on religious values. The state even has its respective totem as a form of sacredness for its people. The research result on the consenquences of Garuda totem, holding the shield of Pancasila and setting its feet on Indonesia’s diversity, are indicating an inseparable bondage for the king of the country and the king of the region during 2019-nCoV which befell the worldwide, particularly Indonesia. In addition, the national emblem, Garuda Pancasila, is not just an ordinary image. It has a meaning that is coming from Indonesian cultures. It has a sacred value (holy) that must be protected and maintained its dignity by everyone who claims to be the citizens of Indonesia. This is to signify an ethic of showing the love for the country. Lastly, in order to avoid the threats to Garuda totem, the state is required to be more careful in making policiesTujuan dari penulisan ini yaitu untuk mengetahui sejauh mana totem Garuda dihadapkan pada totem Covid-19 dalam ketatanegaraan Indonesia. Berawal dari adanya pandemik yang melanda dunia termasuk Indonesia, semua negara disibukan untuk segera mengambil kebijakan-kebijakan yang efektif. Melihat kebijakan-kebijakan yang ada menempatkan Presiden dan Kepala Daerah memiliki peran yang sangat luar biasa dan dapat dikatakan sebagai the king can not do wrong dalam menjalankan kebijakannya. Permasalahan-Permasalahan yang berkenaan dengan keberadaan totem Garuda saat sekarang banyak disoroti, fokus pembahasan mencoba mengkaji pergumulan totem garuda atas totem baru yang merubah tatanan kebijakan di Indonesia. Metode penelitian hukum yang bersifat normatif sebagai pijakan dalam melakukan analisis. Adanya pergumulan atau pertarungan yang menjadikan keberadaan totem Garuda mengalami polemik dalam ketatanegaraan Indonesia. Apa yang dinamakan sebagai totem sendiri rupanya bukan hanya berlaku pada nilai-nilai keagamaan saja, bahkan sekelas negara memiliki totem masing-masing sebagai bentuk kesakralan bagi masyarakatnya. Hasil penelitian Konsekuensi totem Garuda yang memegang perisai Pancasila dan menapakan kakinya pada kebhinekaan Indonesia, sebagai bentuk ikatan yang tidak terpisahkan bagi raja negara maupun raja daerah pada saat adanya 2019-nCoV yang menimpa dunia dan Indonesia khususnya. Labang Negara yaitu Garuda Pancasila bukan hanya sebuah gambar yang biasa saja, mempunyai makna yang lahir dari budaya-budaya Indonesia, memiliki nilai sakralitas (suci) yang wajib di lindungi yang harus dipertahankan martabatnya oleh setiap orang yang mengaku sebagai warga Indonesia untuk menandakan sebuah etika yang menunjukan rasa kecintaan terhadap tanah air. Dalam rangka menghindari ancaman terhadap totem Garuda, negara harus berhati-hati dalam mengambil kebijakan

Abstract

Language is a tool or instrument in reflecting an idea, thoughts, ideas, desires andwishes from one person to another person. It cannot be imagined how human life wouldbecome without language. Surely we will not be able to develop and pass down theculture or noble values of our nation's culture to the next generation, as is the case withanimal life. Animals do not have the ability to speak, so their ability to build civilizationis also lost. In addition, without the ability of human language cannot thinksystematically and orderly.The hijab is one of the legal language that applies and reflects the culture or behaviorthat applies in society. But the meaning, along with the passage of time feels a changein meaning. This is the entry point for the author to elaborate the veil as a legallanguage and standards of personal behavior in Indonesian society.How is the concept of hijab in legal language that is often used by Muslim women orgirls under the shadow of the terrorist and fundamentalist Islamic issues by certaingroups or those who do not like it and the hijab as a syar'i obligation for Muslimwomen so that it sticks as a symbol (character) for good Muslim women.

Abstract

Social transformation, law, development and modernization involve human history. In this context, law in Indonesia is a cultural phenomenon and can be studied with the approach of cultural science, law and methodological tools. With its advantages and disadvantages, studies on social transformation, law, development and modernization towards progress and a better government order towards civil society. As the background of the Paradigm of Social Transformation, Law, Development and Modernization of Society, which is the discussion in this proposal, it is attempted to be able to distance itself from the attitudes Richard C. Martin called as fideistic subjectivism or scientific objectivity. More importantly, the side that portrays the side of the government towards the weak or the poor and becomes an important awareness that is critical of the existence of social transformation, law, development and community modernization.

Abstract

This article aims to explore the relationship between the Ministry of Home Affairs (Kemendagri) and the Ministry of Villages (Kemendes) from theconstitutional law and state administrative law point of view.The second concerns of this research is the disharmony and problem between the two ministries.From the constitutional law point of view, it turns out that what the Ministry of Home Affairs is doing, is closer to the object of its discussion. The method used in this research is normative legal research bycomparingthe constitutional law and state administrative law to obtain clarity regarding the Ministry of Home Affairs and Ministry of Village. The result shows that the Ministry of Village approached the science of state administrative law, namely to revive or give spirits to the village. Disharmonization began to exist since the inception of the Ministry of Village. The root of disharmony itself was the improper application of constitutional foundations in the formation of the Village Law. It would be better if the government reassess the constitutional foundation for the village.

Abstract

The rejection of the judicial review has an impact on Regional Head Elections (Pilkada) throughout Indonesia. Consequently, the Pilkada must follow the same legal provisions as the central provisions regarding the presidential threshold. The difference is only in terms of naming which is called the regent threshold. Researchers, using the regent threshold for studies related to regional elections at the district level, especially the object of which is the Regency. In addition, in the form of regional autonomy, it recognizes the level of legal norms that the law of a lower position may not conflict with the law of a higher position. This means that in a unitary state, the rules that apply at the center will also apply to the regions. Affirmation should be done to avoid confusion or to avoid interpretations between regions, gubernatorial elections, and elections. The threshold for regional heads is inseparable from the existence of the Lex Superior Derogat Legi Inferiori legal principle which regulates how the legal status exists in Indonesia so that the regional head threshold setting is a derivative of the above threshold setting, namely the presidential and vice presidential election threshold. The impact of the Presidential Threshold is not only in the election of regional heads, but also in the election of regents or deputy regents, interim changes for regional heads or deputy regional heads who have a permanent membership.
