Abstract

Abstract: This article aims to find out the problems regarding the resolution of medical disputes between dentists and patients n the city of Pekanbaru based on law number 29 of 2004 concerning medical practice because n medical disputes patients often experience difficulties n realizing their rights. These problems are studied and researched with the Sociological legal research method and using primary and secondary data. The discussion of this thesis harmonizes the laws and regulations with the real situation n society. The patient's weakness factors were also disclosed ncluding psychological factors, educational and economic factors of the patient causing the patient to have difficulty n fighting for their rights n medical disputes. The resolution of medical disputes that are taken through litigation and non-litigation channels are still found to have weaknesses that are not n favor of the patient. Thus, an dea was found through previous discussions and research, that t s necessary to form a special forum for resolving medical disputes that favors patients as consumers of health services. Keywords: medical dispute, dentist  Abstrak: Artikel ini bertujuan untuk mengetahui permasalahan mengenai penyelesaian sengketa medis antara dokter gigi dan pasien di kota pekanbaru berdasarkan undang-undang nomor 29 tahun 2004 tentang praktek kedokteran karena dalam sengketa medik pasien sering mengalami kesulitan dalam mewujudkan haknya. Permasalahan tersebut dikaji dan diteliti dengan metode penelitian hukum Sosiologis dan menggunakan data Primer dan sekunder. Pembahasan tesis ini mengharmonisasikan antara peraturan perundang-undangan dengan keadaan nyata di masyarakat. Faktor-faktor kelemahan pasien juga diungkapankan antara lain faktor psikologis, faktor pendidikan dan ekonomi pasien menyebabkan pasien mengalami kesulitan dalam memperjuangkan haknya di sengketa medik. Penyelesaian sengketa medik yang ditempuh melalui jalur litigasi dan non litigasi masih ditemukan kelemahan-kelemahan yang belum berpihak kepada pasien. Dengan demikian ditemukan suatu gagasan melalui pembahasan dan penelitian yang dilakukan sebeleumnya, bahwa perlu dibentuk suatu wadah khusus penyelesaian sengketa medik yang berpihak kepada pasien selaku konsumen pelayanan kesehatan. Kata kunci: sengketa medis, dokter gigi

Abstract

The purpose of the study was to analyze the legal protection of BPJS participantpatients in medical treatment at a private hospital in Pekanbaru City and theobstacles in its protection. This type of research is normative law. The data sourcecomes from secondary data. The results of this study are legal protection for BPJSparticipant patients in medical treatment at private hospitals in Pekanbaru City thatthe government has issued Law Number 40 of 2004 namely the Health Insuranceprogram for BPJS participant patients where every hospital is to provide services toparticipants in utilizing their right to seek treatment at designated health facilitiesfor free, but there are obstacles in legal protection for patients participating in BPJSbecause there are still health service facilities and infrastructure that are not up tostandard and there is still unfulfilled/availability of medicines and medicalconsumables needed.
