Abstract

Islamic thought has conventionally distinguished between what it calls the People of Hadith (ahlu al-hadîs) and the People of Opinion (ahl ar-ra’y). These two segments have improved into a countless current of thought in the modern world, making it impossible to refer to a certain type of thinking as this or that. Nonetheless, the basic characters of the modern Muslim thinking are not quite distinctive from that of the classical-dualistic dichotomy. Hence, the clash of discourse that we witnessed recently in various Muslim worlds is reflective of the intellectual tension between the People of Hadith and the People of Opinion. The clash of discourse that we have just referred to even took the form of physical conflict such as that which happened in Egypt and Algeria. In these two Muslim countries the clash of discourse has turned into the clash of politics, where religious radicalism and absolutism are the dominant features. This paper seeks to provide a critique of this negative development, offering in the process a kind of discourse that can serve as an alternative, namely the discourse of a moderate Islam.

Abstract

Tren perkembangan ekonomi syariah, khususnya perbankan syariahdi Indonesia memperlihatkan grafik peningkatan yang signifikan. Dinamikaperkembangan tersebut disebabkan oleh adanya fatwa-fatwa terkait denganpelaksanaan ekonomi syariah yang dikeluarkan oleh Dewan Syariah NasionalMajelis Ulama Indonesia (the DSN MUI). Tidak bisa dipungkiri bahwa fatwafatwa tersebut mempunyai peran sebagai pedoman dalam aktifitas kegiatanekonomi syariah, sehingga lebih memberikan jaminan kepastian hukum bagipihak yang berkepentingan. Para praktisi ekonomi syariah, masyarakat danpemerintah (regulator) membutuhkan fatwa-fatwa terkait ekonomi syariahsebagai suatu pegangan atau petunjuk untuk melaksanakan kegiatan ekonomisyariah. Artikel ini akan mengelaborasi signifikansi fatwa the DSN MUI tentangproduk ekonomi Syariah di Indonesia yang meliputi pendekatan, metode, danproses istinbath hukum dalam menetapkan fatwa, serta legitimasi hukumfatwa the DSN MUI berdasarkan Undang-undang.

Abstract

The delopment of thought dichotomically occupies in the level of ahlu al-hadîs dan ahlu ar-ra’yî, though in the contemporary context, those two axis of thoughts have derivated a lot of varieties. Basically, they want to appear as an alternative movement of thought facing the development of modern world. It seems obvious that the issue deals not only with the clash of discourse but also with the clash of politics. In this respect, the phenomenon of mutual blasphemy is manifest among Muslims thinkers. On its peak, each parties use radicalism as a weapon to silence the opponent’s movement. History teaches us, for instance, radicalism movement in Egypt, Algeria, and Turkey carried out by the fundamentalists. This movement eventually comes into world as the movement of moderate Islam, which is more open seeing the problem and more flexible in acquiring the decision through the text. The moderate Islam is open to welcome some current and modern interpretations. Meanwhile the formal Islam is an Islamic group always rigidly understands religious texts in an absolutism way. They tightly select all aspects came from the external entity, and strongly hold the religious texts.

Abstract

This research aims to analyze the use of language in Sharia financial agreements, with a focus on a case study of mudarabah contracts. Sharia financial agreements play a crucial role in regulating financial transactions in accordance with Sharia principles. In the context of mudarabah contracts, the appropriate and clear use of language becomes a key aspect in maintaining transparency, clarity, and understanding among the parties involved. This research adopts a qualitative method with a case study approach. Research data is collected through document analysis, including mudarabah contract agreements in real practice. The data is then thematically analyzed, focusing on word selection, the use of characteristic clauses, sentence structure, and other language structures in mudarabah contracts. The results of the analysis indicate that the appropriate and clear selection of words in mudarabah contracts is important to reflect Sharia principles and maintain transparency. Furthermore, the use of characteristic clauses helps regulate profit sharing, loss sharing, and the responsibilities of the involved parties. Clear and structured sentence arrangements also ensure clarity and readability of the contract contents. Additionally, the use of distinctive Arabic language structures provides clarity in describing actions that have been taken and instructions that must be followed by the parties involved. This research contributes significantly to understanding the use of language in Sharia financial agreements, particularly in the context of mudarabah contracts. The findings of this research are expected to serve as a reference for practitioners and academics in developing effective Sharia financial agreements in accordance with Sharia principles.
