Abstract

The debate on whether bank interest is permissible because it equates to the prohibition of usury is still an issue until now, so this paper aims to explain various expert opinions that bank interest is not haram and not like usury which is forbidden. This paper is a literature study with the type of qualitative research that takes primary and secondary data from various reference sources from books, especially articles related to the discussion. The author's findings show that several figures and one institution argue that bank interest that applies in conventional banks is not haram. The figures are Fazlurrahman, Abdullah Saeed, Muhammad Sayyid Thantawi, M. Dawan Rahardjo and Darul Ifta' Egypt which is an Islamic fatwa institution in Egypt Abstrak Perdebatan boleh tidaknya bunga bank karena menyamakan dengan keharaman riba masih selalu menjadi isu sampai sekarang, maka tulisan ini bertujuan untuk memaparkan berbagai pendapat ahli bahwa bunga bank tidaklah haram dan bukan seperti riba yang diharamkan. Tulisan ini adalah studi pustaka dengan jenis penelitian kualitatif yang mengambil data primer maupun sekunder dari berbagai sumber rujukan dari buku terutama artikel yang terkait pembahasan. Adapun hasil temuan penulis menunjukkan beberapa tokoh dan satu lembaga berpendapat bunga bank yang berlaku di bank konvensional tidaklah haram. Adapun tokoh tersebut yaitu mulai dari Fazlurrahman, Abdullah Saeed, Muhammad Sayyid Thantawi, M. Dawan Rahardjo dan Darul Ifta’ Mesir yang merupakan lembaga fatwa keislaman di Mesir.

Abstract

This study aims to determine how agency theory is related to the trustworthy profit sharing in suppressing the adverse selection problem. This research is a qualitative research. The type of research that researchers use is library research. Library research is a form of research carried out by collecting various kinds of references which are the main source for conducting research, references which are the primary sources in this research are articles published in journals, and other written articles. The results of this study explain that when the company divides the ownership structure and also the management of the company, there will be problems in it, the problem that arises is that there is an agency problem. Agency problems are divided into  two forms, namely moral hazard and also adverse selection. One way to solve this problem is to apply the concept of a trustworthy profit sharing.
