Abstract

This research discusses the role of child marriage prevention strategies (SIP-PEKA) in efforts to prevent child marriage in Bone district. The main research problem is the role of SIP-PEKA in efforts to prevent child marriage in Bone Regency. This research uses theoretical legal methods with a maqāṣid al-sharī'ah approach, while the data collection technique is documentation study. The research results show that SIP-PEKA has succeeded in preventing child marriage in Bone Regency, which was carried out using an integrated system with coordination with various parties and across agencies. Although there are obstacles to SIP-PEKA, internal obstacles such as: lack of budget and problems with the cohesiveness of agencies, as well as external obstacles such as: economic problems, culture, children's morals, religious perceptions, and community non-compliance with applicable laws. Meanwhile, evidence of the role of SIP-PEKA in efforts to prevent child marriage in Bone Regency includes: preventing child marriage by providing guidance and counseling, supporting the creation of Village Regulations; limiting marriage dispensations at the Religious Courts, and refusing to register marriages at the KUA. Apart from that, SIP-PEKA also plays an indirect role in the growth of the human development index (HDI) of Bone Regency, because it contributes to reducing the crisis in the health, education and economic sectors of children in Bone Regency. Therefore, the prevention of child marriage carried out by the Bone Regency government is in accordance with maqāṣid al-sharī'ah and is important in the study of Islamic family law.

Abstract

The study discusses the "Concept of Restorative Justice in Criminal Procedure Law through Rehabilitation Process by the Integrated Assessment Team at the National Narcotics Agency of Bone Regency." The research aims to: identify the essence of Restorative Justice through Rehabilitation by the Integrated Assessment Team at the National Narcotics Agency of Bone Regency, describe the implementation of Restorative Justice through Rehabilitation by the Integrated Assessment Team at the National Narcotics Agency of Bone Regency, and analyze the integration of Competency Development in Criminal Procedure Law courses through the Concept of Restorative Justice in Rehabilitation by the Integrated Assessment Team at the National Narcotics Agency of Bone Regency. This research employs a qualitative approach with legislative, case, and conceptual approaches located at the National Narcotics Agency of Bone Regency, with doctors and the rehabilitation section of BNNK Bone as the sources of information, who are part of the integrated assessment team. The data used are primary data obtained through interviews, observation, and documentation. The research findings indicate that: (1) The essence of Restorative Justice through Rehabilitation by the Integrated Assessment Team at the National Narcotics Agency of Bone Regency is rooted in the protection of the health and social life of drug abusers specifically and society in general. (2) The implementation of Restorative Justice through Rehabilitation by the Integrated Assessment Team at the National Narcotics Agency of Bone Regency complies with regulations, but there are still some challenges, including ambiguous regulations, law enforcement officers' paradigm towards rehabilitation, and inadequate rehabilitation facilities; (3) The integration of Competency Development in Criminal Procedure Law courses through the Concept of Restorative Justice in Rehabilitation by the Integrated Assessment Team at the National Narcotics Agency of Bone Regency can be applied to related criminal law courses through sub-topics in the semester lesson plan, especially regarding narcotics offenses.

Abstract

This research aims to identify the soft and hard skills students need to improve the quality of human resources in the tertiary environment. The research was conducted in Bone Regency, focusing on IAIN Bone students and related stakeholders. The research method used is qualitative research, which involves interviews, observations, and questionnaires to collect primary data and documents and literature as secondary data. Data analysis was carried out using qualitative descriptive techniques and descriptive statistical analysis. It is hoped that the results of this research will be able to design practical and applicable skills development models and evaluate the effectiveness of the skills development programs that have been implemented. The ultimate goal of this research is to improve the quality of college graduates so that they are ready to compete in the world of work, support higher education policies, increase the competitiveness of universities, and prepare students to face increasingly complex future challenges. This research provides recommendations to universities regarding developing curricula and learning programs that are more comprehensive and relevant to industry needs.

Abstract

ABSTRAK          Jurnal ini membahas tentang Problematika Nikah Siri yang ditinjau dari Hukum Islam di Desa Ujung Salangketo Kec. Mare. Permasalahan dalam penelitian ini adalah bagaimana probelematika nikah siri di Desa Ujung Salangketo dan bagaimana tinjauan Hukum Islam terhadap problematika nikah siri yang terjadi di Desa Ujung Salangketo. Tujuan penelitian ini untuk mengetahui problematika nikah siri di Desa Ujung Salangketo dan tinjauan hukum  Islam. Penelitian ini merupakan penelitian lapangan (field research) dengan pendekatan kualitatif.          Hasil penelitian menunjukkan bahwa terdapat  beberapa problematika yang menyebabkan terjadinya nikah siri di Desa Ujung Salngketo Kec. Mare di antaranya: ketidaktauan masyarakat tentang dispensasi nikah di Pengadilan Agama, tidak adanya keinginan untuk mengurus ke Pengadilan Agama karena jarak yang jauh, dan tidak adanya keinginan untuk mengurus berkas-berkas bagi mereka yang sudah menikah. Adapun solusi yang diberikan oleh pihak KUA Kec. Mare yaitu dengan melakukan isbat nikah di Pengadilan Agama dan mencatatkan pernikahannya di KUA. Tinjauan Hukum Islam terhadap problematika nikah siri yang terjadi di Desa Ujung Salangketo yaitu pernikahan tersebut dianggap sah menurut agama karena pernikahan tersebut telah memenuhi rukun dan syarat pernikahan, tetapi menurut hukum negara atau hukum positif pernikahan tersebut belum dianggap sah karena belum melakukan pencatatan pernikahan. Dalam rangka mendapatkan kepastian hukum.

Abstract

The phenomenon of increasing divorce cases in Indonesia shows that women are becoming more legally aware, but at the same time they still face structural barriers in the religious court process. One example of this can be seen in Decision Number 10/Pdt.G/2022/PA.Wtp at the Watampone Religious Court, where the judge dismissed the divorce petition because the parties were still in a marital relationship after the petition was filed. This study aims to analyze the basis of the judge's considerations in this case from the perspective of maslahah mursalah. The results of the study show that the judge applied the principle of dar'u al-mafasid muqaddam 'alā jalb al-maşālih by rejecting the lawsuit (Niet Ontvankelijk Verklaard). The aim was to preserve hifz al-nasl (lineage) and prevent harm in the form of uncertainty regarding the legal status of children, as well as to preserve the integrity of the household. Normatively, this decision upholds the maqasid syariah (objectives of Sharia law). However, in practice, the interpretation of maslahah mursalah must be refined by increasing gender sensitivity and considering al-maslahah al-fardiyyah (individual interests) to achieve substantive justice
