Abstract

The transition from communal to individual land ownership in modern society, as posited by replacement theory, has profound implications for land management practices. This study critically examines the practices surrounding customary land (tanah ulayat) within the Minangkabau community, specifically in Nagari Sungai Kamuyang, West Sumatra, thereby challenging prevailing theoretical assumptions. Utilizing a qualitative approach, the research incorporates in-depth interviews and field observations to understand the community's strategies for managing and utilizing customary land. Findings reveal that the Nagari Sungai Kamuyang community actively upholds the ulayat land status as a collective right and effectively administers it to promote the welfare of its members. The management of customary land occurs under the guidance of traditional leaders (niniak mamak) and local government authorities, with regulations that permit usage rights without transferring ownership. This collective stewardship not only sustains livelihoods for community members, particularly those lacking access to agricultural land, but also reinforces the social values intrinsic to ulayat land. These practices demonstrate the community's resilience and offer a robust counterargument to the predictions of replacement theory.

Abstract

Giovanni Sartori menawarkan gagasan tentang klasifikasi sistem partai. Sistem partai sebagai sistem interaksi yang bersumber pada persaingan antarpartai. Pendekatan yang diberikan oleh Sartori dalam melihat klasifikasi sistem kepartaian  adalah pertama, dengan melihat jumlah partai politik yang relevan. Dan yang kedua adalah jarak ideologis diantara mereka.

Abstract

The purpose of this study is to analyze the Minangkabau community's practices regarding land inheritance in West Sumatra based on applicable customary law and to explain the dynamics of these practices in relation to Islamic inheritance law or to describe them using Imam al-Syathibi's Maqashid Syari'ah theory, which is claimed to be an Islamic perspective. This study uses a qualitative method with a social integration paradigm and sociology of religion approach. Data collection was carried out through observation and interviews in three districts in West Sumatra, namely Padang Pariaman, Lima Puluh Kota, and Agam, as well as a literature and document study process related to the discussion in this study. Meanwhile, the type or nature of this article is descriptive narrative. The results of this study are that the Minangkabau land inheritance system, with the dualism of high and low pusako assets, can be integrated with faraid law through the perspective of Al-Syathibi's maqashid syari'ah. This approach ensures that the objectives of sharia, especially safeguarding assets (hifz al-mal) and descendants (hifz al-nasl), are fulfilled while maintaining Minangkabau cultural identity. By utilizing the principles of mashlahah and ijtihad maqashidi, this inheritance system can remain relevant in the modern era, supporting social justice and cultural harmony.
