Abstract

Pembangunan hukum Nasional ditandai dengan berbagai  kebijakan yang salah satu trendnya yaitu membangun sistem demokrasi dalam bidang Pemilihan Umum. Pemilihan Umum merupakan aktualisasi nyata dari demokrasi. Di Indonesia, pengaturan yang berkaitan mengenai Pemilihan Umum seringkali berubah-ubah demi mencari sistem penyelenggaraan Pemilihan Umum yang ideal, serta sesuai dengan keinginan politisi dan pembuat undang-undang. kewenangan untuk menyelesaikan permasalahan terkait Pemilihan Umum, setidaknya dapat dikategorisasi enam jenis perkara. Perkara-perkara tersebut meliputi administratif Pemilihan Umum, proses penyelenggaraan Pemilihan Umum, perselisihan hasil Pemilihan Umum, atas tindak pidana Pemilihan Umum, kode etik penyelenggara Pemilihan Umum, dan perkara lainnya yang berkaitan dengan Pemilihan Umum. Dalam melakukan penelitian ini, tipe penelitian yang digunakan adalah penelitian hukum (legal research) yaitu suatu proses untuk menemukan aturan hukum, prinsip-prinsip hukum maupun doktrin-doktrin hukum agar dapat menjawab permasalahan hukum yang sedang dihadapi. Pendekatan yang digunakan dalam penelitian ini yaitu, pendekatan perundang-undangan adalah pendekatan dengan menggunakan legislasi dan regulasi yang berkaitan dengan isu hukum yang sedang dibahas. Dengan pendekataan ini maka dapat dilakukan dengan menelaah aturan hukum yang ada yakni Undang-Undang Dasar Tahun 1945 sebagai dasar tertinggi sumber hukum dan dikaitkan dengan aturan-aturan yang ada dibawahnya untuk menjawab rumusan masalah

Abstract

Houses are a primary need for some families, both those living in rural areas and in urban areas, which is a primary need. The fulfillment of these primary needs cannot be met by everyone to buy in cash. Therefore, a financial institution is needed to provide financial assistance in the form of credit distribution, especially in housing loans (KPR).This research examines two problems, namely the obstacles in solving bad credit at PT Bank Tabungan Negara Pekanbaru Branch and how to solve bad credit through non-litigation forums on the home ownership process carried out by PT BanK Tabungan Negara Pekanbaru Branch. This research uses observational research, which is a field research that is attempted to provide a descriptive description of the reality that occurs in society, where the author in conducting observational research uses qualitative methods. Broadly speaking, the factors that can hinder the occurrence of non-performing loans can be classified into internal and external factors, where the non-litigation settlement of bad loans at PT Bank Tabungan Negara Pekanbaru Branch takes several steps recommended by creditors, namely pre-negotiation, negotiation implementation. , post negotiation. From the research results, it can be concluded that the obstacles in settlement through non-litigation are incomplete documents / debtor credit data, and can take the form of difficulties in collecting debts because the debtor has a poor character. Bad faith from the debtor, lack of awareness of the debtor in completing his loan facility, timeliness because the debtor's improperly repaying his debt results in a protracted settlement, so that the burden borne by the debtor is getting bigger, non-litigation settlement is Rescheduling, Restructuring, and Reconditioning, the factor that causes PT Bank Tabungan Negara Pekanbaru Branch to choose to settle non-performing loans through non-litigation channels is time, the results achieved if through non-litigation channels the settlement of bad credit in home ownership loans (KPR) can get maximum results, good faith reason The non-litigation route was chosen, because there is still a willingness from the debtor to settle the credit.

Abstract

Disclosure of narcotics crimes is not easy because drug abuse crimes are carried out in a systematic, organized, and hidden manner. Narcotics transactions are generally conducted at times and places that are difficult for the public to ascertain. Perpetrators always try to evade law enforcement in their drug abuse activities. From its nature, this study falls into observational research conducted through a survey method, which involves direct research at the study location using interview data collection tools. To avoid law enforcement reach, transactions are usually carried out with individuals who are already known due to the rapidity of illegal narcotics circulation. Often, those apprehended by law enforcement are only small-scale perpetrators as dealers, while narcotics traffickers are difficult to trace. Therefore, one strategy employed to uncover such crimes is the use of undercover purchases (Undercoverbuy).
