Abstract

Abstract: This paper discusses fuqaha's view of the mudharabah system in fiqh and Islamic banking. This discussion is critical because the mudharabah contract is one of the contracts that can help the community in conducting economic transactions through Islamic banking. This article aims to oversee the mudharabah contract in fiqh and the mudharabah system in Islamic banking. The research method used is the library research method. The research data used is qualitative. The collection is carried out from several sources for reference, such as books, both online and in print, scientific articles downloaded from journals, fatwas from the National Sharia Council of the Indonesian Ulama Council (DSN-MUI), regulations from the Financial Services Authority (OJK) and other data sources. Data analysis techniques used are data condensation, data presentation, and concluding. The results of the analysis show that the mudharabah contract, according to the majority of Fuqaha, is a contract made by two parties who interact with each other, and one of them becomes the investor and surrenders his assets to share/manage, and the profits will be divided according to what has been determined. In Islamic banking, the mudharabah contract is divided into two forms: a system and a product.

Abstract

This study investigates the classification, governance, and institutional dynamics of Sharia securities within Indonesia’s Islamic capital market. Using a qualitative methodology grounded in document and thematic analysis, it explores how regulatory bodies—including the Financial Services Authority (OJK), the National Sharia Council (DSN-MUI), and the Indonesia Stock Exchange—coordinate to ensure Sharia compliance. Findings reveal that while regulatory instruments such as the Sharia Securities List (DES) and Jakarta Islamic Index have improved transparency and compliance, overlapping jurisdictions and limited enforcement mechanisms present notable challenges. Additionally, gaps in investor literacy and underdeveloped Sharia auditing hinder wider market participation. However, the market holds significant growth potential due to strong demographic demand, supportive government policy, and technological opportunities in fintech. The study offers theoretical and practical insights into strengthening institutional trust, regulatory harmonization, and ethical investing within Indonesia’s Islamic finance framework.

Abstract

Penelitian ini memaparkan pemikiran Imam Al-Ghazali dalam bidang ekonomi yang dijadikan prinsip dan patokan dasar tentang penerapan sistem ekonomi Islam di Indonesia. Artikel ini bertujuan menganalisis pemikiran ekonomi Islam menurut Imam Al-Ghazali dan melihat relevansi dengan konteks saat ini, khususnya Indonesia. Artikel menggunakan penelitian kualitatif yang bersifat studi kepustakaan. Data-data diambil dari buku, jurnal, laporan penelitian, dan sumber-sumber lain mengenai permasalahan yang dibahas yaitu tentang pemikiran ekonomi Islam menurut Imam Al-Ghazali. Teknik analisis data yang digunakan adalah reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa kegiatan ekonomi harus berjalan sesuai dengan syariat Islam demi kemaslahatan. Secara umum pemikiran ekonomi Imam Al-Ghazali membahas tentang peranan negara dalam membangun ekonomi seperti dalam aspek makro dan mikro perekonomian. Penerapan sistem ekonomi di Indonesia memaparkan bahwa di dalam kegiatan ekonomi harus berpegangan penuh terhadap Al-Qur’an dan Sunnah sebagai acuan serta pedoman untuk mencapai perekonomian berbasis syariah, seperti pengimplementasian akad-akad hukum ekonomi syariah di perbankan syariah terhadap larangan riba dan penimbunan uang yang menjadikan perekonomian tidak stabil.

Abstract

Purpose - This study departs from the normative problem of placing Islamic bank funds in conventional banks, which continues amid limited Islamic liquidity instruments, causing tension between the qaṭ‘ī prohibition of usury and the need for systemic liquidity in the dual banking system. This study aims to determine the extent to which the placement of Islamic bank funds in conventional banks is permissible under Islamic law and the limits of permissibility that can be maintained without reducing the principle of non-usury (ribā). Method - This study uses a normative qualitative method based on fiqh and uṣūl al-fiqh analysis oriented towards maqāṣid al-sharī‘ah, with analysis techniques in the form of content analysis and comparative legal analysis of the views of contemporary scholars, DSN-MUI fatwas, and Indonesian and Financial Services Authority regulations. Finding - The permissibility of fund placement can only be positioned as a temporary rukhsah based on ḥājah that is close to systemic emergency, with operational indicators in the form of the absence of adequate sharia liquidity instruments, time and nominal restrictions in proportion, non-interest schemes, and strict and continuous sharia supervision. The legitimacy of this permissibility is casuistic and contextual and cannot be normalized as a permanent practice in Shariah banking liquidity management. This study affirms a moderate-critical normative approach that acknowledges the regulatory reality in the dual banking system while still placing the non-usury principle and the principle of Sharia prudence as the main ethical-juridical boundaries in preventing the shift of Sharia principles in contemporary financial practices. Contribution - This research contributes to the conceptual reformulation of temporary rukhsah as an operational legal category in contemporary fiqh al-mu‘āmalah and the strengthening of sharia liquidity instruments. Limitations - The limitations of this research lie in its predominantly normative-conceptual basis of analysis, which is not yet supported by comparative empirical data across Islamic banking institutions.
