Abstract

This research uses the Empirical Juridical Method, examining the legal provisions that apply to implementation in reality. The applicable legal provisions referred to are Regional Regulation Number 1 of 2012 concerning the 2030 Regional Spatial Planning regarding the development of Green Open Space (RTH) for the DKI Jakarta Province Region in the Jagakarsa District, South Jakarta Administrative City. Regarding the problem of how to regulate green open space development in the Jagakarsa District area, are there any obstacles and what are the solutions. The results of this research show that Jagakarsa District is the area that has the largest green open space in the South Jakarta Administrative City area. The distribution of green open space in the Jagakarsa sub-district includes the distribution of green open space (RTH) in the Jagakarsa sub-district including urban forests, setu/lakes, reservoirs/river runoff spaces, reservoirs, interactive parks, environmental parks, road medians, river and canal borders, edges of railway lines. fire, under the electric power transmission network with shade plants, and local ornamental plants. The obstacle faced in the construction and development of green open space is changing the function of land to residential land. As a solution to suppress residential development by enforcing spatial zoning regulations. The role of the DKI Jakarta Regional Government in RTH is to carry out planning, utilization and control of green open space layout. The people of Jagakarsa District really feel the benefits of Green Open Space, clean air, the availability of clean water sources even though in the dry season, the Jagakarsa area is not too badly affected by drought, including floods.

Abstract

Significant transformations in human interaction patterns have occurred thanks to advances in science and technology in the field of communication technology. The era of information technology began with the emergence of computer innovation, which initially came in the form of mainframe computers. Advances in information and communication technology have brought major changes to social interaction and human civilization globally. The use of information technology raises cyber law and cybercrime as important issues. Technological developments have commensurate consequences, with benefits in everyday activities but also negative impacts through online fraud and cybercrime. In handling information technology crime cases, digital forensics has an important role, especially in facing evidentiary challenges. Digital forensics includes the analysis of digital traces and has become an integral part of law enforcement in the digital era. The formation of the Indonesian Digital Forensics Association and the Electronic Transaction Information Law confirms the urgency of digital forensics in law enforcement in Indonesia.

Abstract

The aim of this research is to examine and analyze the legal force of State Administrative Court (PTUN) decisions which have permanent legal force, as well as what the sanctions are for State Administrative officials who do not implement these State Administrative Court decisions.  The research method used is a normative research method, namely legal research carried out by examining the laws and regulations applied to a particular legal problem. The results of the research are that the decision of the state administrative court is generally binding (erga omnes), so the strength of the decision of the administrative court The state's efforts are the same as the power of statutory regulations. Thus, a state administrative court decision that has permanent legal force has the following powers: 1) binding power; 2) strength of evidence; and 3) executive power. And what are the sanctions for government officials who do not implement state administrative decisions that have permanent legal force (in kracht van gewijsde) according to Article 116 of Law Number 51 of 2009 concerning the Second Amendment to Law Number 5 of 1986 concerning State Administrative Courts, can be subject to penalty.

Abstract

Penelitian ini bertujuan untuk mengetahui pengaturan lalu lintas pada saat terjadi kebakaran serta untuk mengetahui bentuk perlindungan hukum terhadap petugas Pemadam Kebakaran pada Dinas Penanggulangan Kebakaran dan Penyelamatan (DPKP) Provinsi DKI Jakarta yang mengalami Kecelakaan Lalu Lintas saat bertugas Menurut Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan. Penelitian ini menggunakan kajian hukum normatif yaitu penelitian hukum yang meletakkan hukum sebagai norma. Sedangkan pendekatan yang digunakan adalah pendekatan perundang-undangan (statue approach), pendekatan konseptual (conseptual approach), dan pendekatan kasus (case approach). Dari penelitian ini dapat diambil kesimpulan sebagai berikut: Pertama bahwa pengaturan lalu lintas merupakan aspek krusial dalam penanganan situasi darurat, termasuk saat terjadi kebakaran. Langkah-langkah umum yang biasanya diambil dalam pengaturan lalu lintas saat terjadi kebakaran antara lain: 1) Koordinasi Antara Instansi Terkait; 2) Pengalihan Rute Lalu Lintas; 3) Penutupan Jalan; 4) Prioritas Kendaraan Darurat. Kedua bahwa sesuai dengan pasal 240 undang undang lalu lintas bahwa prosedur untuk mendapat hak perlindungan korban pada kecelakaan lalu lintas yang dialami oleh petugas pemadam kebakaran adalah: 1) Mendapatkan pertolongan dan perawatan sehingga seseorang yang telah mengalami kecelakaan dapat tindakan medis yang tetap dan cepat; 2) Santunan kecelakaan lalu lintas. Apabila terjadi musibah pada pengguna jalan akibat petugas pemadam kebakaran saat berkendara dengan kencang maka yang bertanggungjawab adalah pihak pemerintah daerah.
