Abstract

existence of the Constitutional Court interpreted as the guardians of the constitution of the various operational policies that are not in accordance with the constitutional mandate. Climate ‘economic’ change is happening the world economy, shift-many policy base the national economy. This study intends to identify and analyze the involvement of the Constitutional Court towards strengthening the Constitutional Foundation of Economical System in Indonesia, which would determine the appropriate policy actualization. Therefore, it is important to identify and analyze the value of the economic constitution of Indonesia that was based on a social contract supreme law, the constitution and the ruling of the Constitutional Court that in the economic field and be able to influence national economic policy. The method of approach used in the study is descriptive analytical that explain and analyze by law as a regulation made by the Indonesian government to national economic policy, which is associated with the actual conditions that occur. The economic constitution idealistic values faced with an open market regulation, control and supervision of a force that is not only submitted to the Constitutional Court ruling which has the character of final appeal.

Abstract

In the realm of construction, contracts form the fundamental basis of projects involving multiple parties with clear responsibilities and obligations. This research explores a case of breach of contract (wanprestasi) in a construction project involving an individual, which not only caused financial and reputational harm to other parties involved but also compromised the integrity and quality of the project. The legal framework governing construction services and contracts, including Article 1 paragraph (3) of Law Number 2 of 2017 concerning Construction Services, sets the ground for understanding obligations and rights under Indonesian civil law. The methodology employed in this study is a qualitative analysis, focusing on the application of legal principles, relevant regulations, and real-life practices related to cases of breach of contract using literature reviews and case document analysis. This approach has allowed for an in-depth understanding of the legal norms and the actual enforcement of laws in similar situations. The findings reveal that the specific breaches included not meeting agreed specifications and delays in project completion, which are deemed as wanprestasi under Article 1243 of the Indonesian Civil Code. These violations stem from poor project management, opaque fund usage, and unilateral decisions by the executing party, highlighting the need for stringent legal enforcement and protection for the aggrieved parties. Abstract

The constitutional interpretation of the regulation of State-Owned Enterprises (BUMN) is still looking for the right method, BUMN as the embodiment of the constitution for the state's responsibility in managing strategic resources that are used as wide as possible for the prosperity of the people. Submission of a judicial review to the Constitutional Court regarding BUMN can show the direction of constitutional interpretation given by the judges of the Constitutional Court. This article examines whether the constitutional interpretation of SOE arrangements is in accordance with Indonesia's national economic system. The method of approach in this writing is descriptive analysis which explains and analyzes the constitutional interpretation of SOE regulations. the results of the study reveal that the constitutional court has carried out its duties in accordance with the basic principles and principles of the constitution. The Constitutional Court in every decision in the field of BUMN dominates its interpretation by using an originalist interpretation.

Abstract

The Decree of the People's Consultative Assembly (MPR) regarding the inauguration of the President and Vice President in Indonesia plays a crucial role in determining the validity and legitimacy of the elected leaders. This decree serves as the legal foundation that regulates the entire inauguration process, ensuring that each step is carried out in accordance with applicable regulations, thereby providing legal guarantees to the public. The MPR, as the supervisory body, has the responsibility to maintain transparency and accountability during the inauguration, which in turn strengthens public trust in the democratic system. However, challenges in interpreting and implementing this decree still exist. Therefore, it is essential to ensure that all parties understand and respect the established provisions. This includes a clear understanding of the proceduresoutlined in the amendments to the MPR's Rules of Procedure. Thus, the implementation of this decree is a commitment to a strong democratic principles in Indonesia.

Abstract

Recently, corruption has been increasingly discussed, both in print and electronic media, as well as in seminars, workshops, discussions, and so on. Corruption has become a serious problem for the Indonesian people, because corruption in Indonesia occurs systemically, massively and structured so that it is not only detrimental to the state's financial condition, but also violates the social and economic rights of the community at large. The research method used is a normative research method that focuses on library research to obtain secondary data from legal materials. The normative approach is carried out by reviewing the provisions or applicable laws and regulations. The results of the study indicate that the provisions regarding criminal acts of corruption in Indonesia are regulated in Law no. 31 of 1999 concerning the Eradication of Corruption Crimes and Law no. 20 of 2001 concerning Amendments to Law no. 31 of 1999 concerning the Eradication of Corruption Crimes. In the consideration of the Panel of Judges, that in the public's view - the Defendant's actions were a disgraceful act, and during the examination process at the trial the Tribunal did not obtain justifying facts which could erase the unlawful nature of the Defendant's actions, nor the facts of forgiving reasons which could erase the guilt of the Defendant. Therefore, the defendant must be held accountable for his actions.

Abstract

Akhir-akhir ini korupsi semakin ramai diperbincangkan, baik di media cetak maupun elektronik, maupun dalam seminar, workshop, diskusi, dan lain sebagainya. Korupsi telah menjadi masalah serius bagi bangsa Indonesia, karena korupsi di Indonesia terjadi secara sistemik, masif dan terstruktur sehingga tidak hanya merugikan kondisi keuangan negara, tetapi juga melanggar hak-hak sosial dan ekonomi masyarakat secara luas. Permasalahan dalam tulisan ini adalah bagaimana pertanggungjawaban hukum bagi pelaku korupsi? Dan apa dasar pertimbangan Majelis Hakim Pengadilan Negeri Jakarta Pusat nomor 97/Pid.Sus-TPK/2019/PN Jkt.Pst?. Metode penelitian yang digunakan adalah metode penelitian normatif yang menitikberatkan pada penelitian kepustakaan untuk mendapatkan data sekunder dari bahan hukum. Pendekatan normatif dilakukan dengan meninjau ketentuan atau peraturan perundang-undangan yang berlaku. Hasil penelitian menunjukkan bahwa ketentuan mengenai tindak pidana korupsi di Indonesia diatur dalam UU No. 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi dan UU No. 20 Tahun 2001 tentang Perubahan atas UU No. 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi. Dalam pertimbangan Majelis Hakim, bahwa menurut pandangan masyarakat - perbuatan Terdakwa merupakan perbuatan tercela, dan selama proses pemeriksaan di persidangan Majelis tidak memperoleh fakta-fakta yang membenarkan yang dapat menghapus perbuatan melawan hukum Terdakwa, maupun fakta-fakta alasan pemaaf yang dapat menghapus kesalahan Tergugat. Oleh karena itu, terdakwa harus mempertanggungjawabkan perbuatannya.

Abstract

This community service activity aims to respond to the legal silence that still surrounds vulnerable groups in Pademangan Barat Village, North Jakarta, particularly women and children who are often victims of domestic violence. In a social context marked by patriarchal structures and low legal literacy, violence is often considered part of household dynamics rather than a violation of the law. The one-day legal education session held at the Integrated Child-Friendly Public Space (RPTRA) was an initial intervention designed in a participatory and community-based manner. The activity not only conveyed legal material in a normative manner but also encouraged residents to reflect on their social experiences in open discussions with community leaders and local officials. The most notable outcome of this activity is the increased legal awareness among local residents. Additionally, there has been a change in attitude identified verbally through participants' courage to ask critical questions, share personal experiences, and challenge social norms that have long silenced victims. This phenomenon underscores that legal education, when conducted through a dialogic approach as suggested by Freire (2005), can serve as an initial instrument for social transformation, even within limited spatial and temporal constraints. This activity demonstrates that law does not necessarily begin in the courtroom but can emerge from honest, simple conversations within the community.

Abstract

The relocation of Indonesia’s new capital city (IKN) demands significant funding, raising concerns about inefficiency in the State Budget (APBN) and issues in the drafting of Law Number 3 of 2022 on the State Capital. This study analyzes the authority and accountability of the Nusantara Capital City Authority within Indonesia’s constitutional system. Using a normative juridical method, the research finds that Article 12 paragraph (1) of Law No. 3/2022 grants the Authority the status of a special regional government, distinguishing it from general regional administrations. Furthermore, Article 13 specifies that elections in IKN are limited to the President and Vice President, DPR, and DPD members, with no local elections or DPRD. This centralized appointment of the Head of the Authority by the President challenges democratic values and decentralization principles. Therefore, transparent selection, strong oversight, and balanced investment policies are crucial to ensure accountable governance that safeguards national interests.

Abstract

The importance of maintaining environmental balance and dealing with complex issues such as forest fires in Indonesia requires attention to the relevant legal aspects. The concept of the environment involves the human area and the accumulation of its activities, with forests playing a central role in maintaining ecosystems and providing benefits for society. Law Number 32 of 2009 concerning Environmental Protection and Management is a strong legal basis for dealing with this problem. This research method applies a normative approach and literature study to analyze legal aspects related to forest fires. Within this framework, the statutory approach is used to collect all laws and regulations that are relevant to the legal issues being studied, especially in the context of enforcing criminal law against forest fires as an environmental crime. The results reveal the importance of effective law enforcement in the environmental context, which is regulated by Article 98 of Law Number 32 of 2009. This article outlines criminal sanctions for those who violate air, water, or environmental damage criteria.

Abstract

Research of validity (geltung) is discussing about how a rule applied in the administration of the state and government. This research intends to examine the enactment of Government Regulations on the acceleration of development of disadvantaged regions based on legal theory. This is a normative research, using literature studies, with the statutes approach and conceptual approach, and using descriptive analysis. Through this research, it was found that government policies related to the implementation of acceleration for development of disadvantaged regions has no legal basis for its validity, and it has been put aside of the higher legal norms (hierachichal of regulations) especially Laws Number 39 year 2008. Therefore, it is recommended that every policy implementation at the level of Government Regulation must be ordered by the rigt of higher Regulations or based on concretely regulated authority by higher norms.
