Abstract

The government of West Java has applied discretion in interpreting the national disaster regulation through West Java Province Bylaw Number 5/2021. To ensure procedural justice for the society, the bylaw applies fines through a trial court of minor offenses against health protocols violators. The implementation of the bylaw is a manifestation of the theory of an integrated criminal justice system, which, to date, has only been carried out independently. However, in this case, there is an integration in achieving an objective of law enforcement, that is, the prevention of the spread of the pandemic. Thus, this study examines the implementation of the Bylaw involving Indonesian National Police and Civil Service Police in regulating the health protocol. This research uses descriptive qualitative methodology involving triangulation, literature reviews, interviews, and case studies. The results reveal that an integrated judicial system has been implemented and met its objective in ensuring public compliance to health protocols. Yet, a number of issues persists, including using quantitative performance metrics in identifying the target offenders, outdated paperwork methods, teleconferencing judicial processes that are hindered by the existing constitution, and dilemma in either imposing heavy fines or light fines in a society hit hard by an unseen contingency.

Abstract

penelitian ini adalah pendekatan assosiatif. Populasi dalam penelitian ini adalah seluruh pegawai Badan Pertanahan Nasional Kota Medan yang jumlahnya 323 orang. Sampel dalam penelitian ini menggunakan rumus slovin yang berjumlah 77 orang pada Badan Pertanahan Nasional Kota Medan. Teknik pengumpulan data dalam penelitian ini menggunakan teknik observasi, dan angket. Teknik analisis data dalam penelitian ini menggunakan pendekatan kuantitatif menggunakan analisis statistik dengan menggunkana uji Analisis Auter Model, Analisis Inner Model, dan Uji Hipotesis. Pengolahan data dalam penelitian ini menggunakan program software PLS (Partial Least Square). Hasil penelitian ini membuktikan bahwa secara langsung Pemanfaatan Teknologi Informasi berpengaruh signfikan terhadap Kualitas Laporan Keuangan Pemerintah. Sistem Pengendalian Intern berpengaruh signfikan terhadap Kualitas Laporan Keuangan Pemerintah. Pemanfaatan Teknologi Informasi berpengaruh signifikan terhadap Kualitas Laporan Keuangan Pemerintah Dengan Komitmen Organisasi Sebagai Variabel Moderating. Dan Sistem Pengendalian Intern berpengaruh signfikan terhadap Kualitas Laporan Keuangan Pemerintah Dengan Komitmen Organisasi Sebagai Variabel Moderating pada Badan Pertanahan Nasional Kota Medan

Abstract

This study aims to find that the organizational structure and culture of the police have a significant impact particularly in terms of facilitating access, ensuring research independence, and developing long-term relationships. Police research has enabled the integration of grounded theoretical findings with the practical application of police strategies. However, scholars in police studies, especially those new to research, often face intricate dynamics and limitations, particularly concerning police culture and organizational obstacles. This paper seeks to examine the challenges and political barriers that new researchers have when studying the police. Employing an empirical qualitative approach, this study combines semi-structured interviews with six researchers who have different levels of expertise in police research. Additionally, auto-ethnographic reflections offer a thorough understanding of the subject matter. The research findings suggest that the organizational structure and culture of the police have a significant impact on research, particularly in terms of facilitating access, ensuring research independence, and developing long-lasting connections. We conclude by proposing that establishing an effective research collaboration with the police necessitates finding a balance between the interests of academics and the police institution. To achieve this, we advocate implementing mentorship programs that pair experienced researchers with junior researchers and create collaborative infrastructure to help new scholars.
