Abstract

Jembrana Regency has 26 modern shopping centers spread across five districts. The rapid development of the trading business in the form of modern shops has created new problems for small traders and traders in traditional markets. This study examines how the existence of traditional markets amid the rise of modern markets in Jembrana district, and how legal protection efforts are provided by the Jembrana district government for traditional markets. The legal research method used in this paper is empirical legal research, which focuses on phenomena in people's lives. The results of the study found that there were more modern markets than traditional markets, based on this the Jembrana Regency Government issued Regional Regulation of Jembrana Regency Number 8 of 2010 concerning Arrangement and Empowerment of Traditional Markets, Shopping Centers and Modern Shops. This Regency Regional Regulation aims that economic development between traditional markets and modern markets can jointly develop the Jembrana Regency economy in a balanced manner.

Abstract

Public service is a manifestation of the government's attitude to the community that is prime or primary, to succeed in excellent public service it is also necessary to cooperate with the community, but often in the field, people face obstacles that lack information about the mechanisms or procedures requested by public agencies. such as population management in the civil registry. With the existence of regulations issued by the Tabanan Regency Government, it reflects the government's attitude that prioritizes the community and the government's concentration in serving the interests of the community quickly, so that in managing public services, of course, the human resources in these agencies are always being improved to suppress systems that complicate the community in general, as well as by providing socialization to the community in order to increase public knowledge related to the mechanism for using the system in each intended institution

Abstract

Purpose: This study aims to examine the regulations and legal consequences of civil servant (ASN/aparatur sipil negara) neutrality in the context of the 2024 General Elections and Regional Elections in Bali Province, and to provide practical recommendations to assist civil servants in maintaining neutrality. Research methods: A normative legal method with a statutory regulation approach using concept and case analysis is applied in this study. In this case, primary and secondary data are utilized through bibliography and description techniques. Results and discussion: The regulations regarding civil servant neutrality are quite comprehensive, yet there are still significant violations which result in disciplinary and criminal sanctions for civil servants in Bali who are proven to be non-neutral. Implication: This study highlights the importance of strengthening socialization, monitoring, and enforcement of rules to ensure that civil servants understand and adhere to neutrality provisions in performing their duties, while also considering the social and cultural factors that influence the community in Bali.

Abstract

Penegakan hukum merupakan suatu usaha untuk mewujudkan ide-ide keadilan, kepastian hukum dan kemanfaatan sosial menjadi kenyataan. Penegakan hukum pada hakikatnya adalah proses perwujudan ide-ide. Penegakan hukum adalah proses dilakukannya upaya tegaknya atau berfungsinya norma-norma hukum secara nyata sebagai pedoman pelaku dalam lalu lintas atau hubungan-hubungan hukum dalam kehidupan bermasyarakat dan bernegara. Tindak Pidana tidak melengkapi Sertifikat Kesehatan Karantina Hewan, Ikan, dan Tumbuhan berpedoman pada Undang-Undang Karantina Hewan, Ikan, dan Tumbuhan. Pengertian karantina hewan, ikan, dan tumbuhan tercantum dalam Pasal 1 angka 1 Undang-Undang Karantina Hewan, Ikan dan Tumbuhan, karantina adalah sistem pencegahan masuk, keluar dan tersebarnya hama dan penyakit hewan karantina, hama dan penyakit ikan karantina, dan organisme pengganggu tumbuhan Karantina.Dalam proses penegakan hukum terhadap pelaku pidana tidak melengkapi sertifikat kesehatan karantina hewan, ikan dan tumbuhan di wilayah hukum Ditpolairud Polda Bali adalah berdasarakan KUHAP dan juga diatur dalam Pasal 83 ayat (1) Undang-undang Karantina Hewan, Ikan dan Tumbuhan, adapun tahap awal berdasarkan Peraturan Jaksa Agung Nomor : Per-036/A/JA/09/2011 tentang Standar Operasional Presedur (SOP) Penanganan Perkawa Tindak Pidana Umum, yang terdapat pada Pasal 1 angka 5 penyidik membuat surat perintah penyidikan terkait dengan tindak pidana Karantina Hewan, Ikan, dan Tumbuhan. Kata Kunci: Hukum, Karantina, Pangan

Abstract

Transportation is an important infrastructure for the economic life of society, transportation is a means to encourage economic development. Transportation by motorized vehicles often causes problems that can harm passengers. The problem, how is the function of the implementation of motor vehicle testing in an effort to prevent traffic accidents and law enforcement against violations if the owner of motorized transportation does not conduct vehicle testing, Research results: that the function of motor vehicle testing is very decisive in efforts to prevent traffic accidents. Because with the condition of vehicles that meet the technical requirements and roadworthy supported by drivers and road users who are disciplined and aware of the law, the danger of traffic accidents will be prevented or minimized. Law enforcement against violations for motorized transport owners who do not conduct vehicle testing is based on Article 56 of the UULLAJ, if violated shall be punished with a maximum imprisonment of 2 months or a maximum fine of Rp. 2,000,000, - and if the vehicle does not have a proof of passing the test. If the vehicle does not have a test pass mark, it shall be punished with imprisonment of 6 months or a fine of up to Rp. 6,000,000.
