Abstract

The mining issue in North Moluccas has given rise to legal issues which have a negative impact on the economic and investment climate. Mining problems include forest destruction, environmental pollution, land grabbing, illegal mining, permits that are not in accordance with their intended use, and land clearing issues with miners, which then give rise to conflicts of interest with the state and local communities. These issues have been demands of society for a long time, but have not been fulfilled and resolved by the company or the government. So that conflict increases from people's attitudes of protesting to resistance. There are several factors that influence this, namely; first, the factor of centralism in mining resource policy making in the government, where the community and local government are only the recipients and implementers of the policy. Second, mining company programs towards community empowerment, namely the company's lack of concern for the social environment, especially regarding compensation related to the welfare of local communities. The results of the research show that there are issues that cause the community to protest against the mining concession policy, namely: first, the neglect of the rights of local communities in the form of compensation during mining exploitation, second, the discriminatory treatment of mining companies in the labor recruitment process. local; and third, there is post-mining environmental destruction in protected forest areas in mining areas.

Abstract

This research aims to describe the territorial boundary conflicts of six villages in North Maluku in relation to the problems with the issuance of the law regarding the expansion of North Halmahera Regency, namely Law Number 1 of 2003. The focus that we want to look at is first, that the power relations of the regional center as an institution . As an institution, these power relations go through bureaucratic models. The central government is the state representative who has the authority to issue laws. The power relationship between the central government and provincial governments has two dimensions. The first dimension is that the provincial government has a position as a representative of the central government in the regions. This means that the relationship between the central government and the provincial government is a coordinative relationship. The second dimension is the position of the provincial government as the ruler of the provincial territory. This means that the relationship between the central government and the provincial government is a command or command relationship.This research was conducted with the object of 6 (six) disputed villages between two community groups and the government, namely the governments of West Halmahera Regency and North Halmahera Regency. The villages in question are Dum Dum, Akesahu, Akelamo Kao, Tetewang, Bobane Igo and Pasir Putih villages. Abstract

Desa adalah kesatuan masyarakat hukum yang memiliki batas-batas wilayah yang berwenang untuk mengatur dan mengurus kepentingan masyarakat setempat, berdasarkan asal-usul dan adat istiadat setempat yang diakui dan dihormati dalam sistem Pemerintahan Negara Kesatuan Republik Indonesia. Dana Desa adalah dana yang bersumber dari Anggaran Pendapatan dan Belanja Negara yang diperuntukkan bagi Desa dan Desa Adat yang ditransfer melalui Anggaran Pendapatan dan Belanja  Daerah  kabupaten/kota  dan  digunakan  untuk  membiayai  penyelenggaran pemerintahan, pembangunan.Penelitian dilakukan di Desa Sagawele, Kayoa Selatan, dan waktu penelitian selama 2 bulan, tipe penelitian yang digunakan adalah tipe penelitian kualitatif deskriptif, dengan sumber data primer dan sekunder. Untuk mendapatkan data yang akurat berkaitan dengan peran pemerintah desa dalam mengelola dana desa untuk pembangunan Desa, dengan penelitian menggunakan teknik observasi, wawancara dan dokumentasi.Hasil penelitian ini menunjukkan bahwa, peran pemerintah dalam mengelola dana desa untuk pembangunan desa merupakan salah satu moto penggerak agar pemerintah desa dan masyarakat dalam pembangunan desa dapat terwjud dan terlaksana. Adapun bentuk-bentu peran pemerintah desa untuk membangun desa mencakup dua hal yaitu pembangunan secara fisik dan pembangunan secara non-fisik.Kata kunci; Peran Pemerintah Desa, Dana Desa, Pembangunan, dan Desa Sagawele.

Abstract

This study aims to optimize the performance of social studies teachers in instilling discipline and honesty in students at SD Negeri 50 Kota Ternate. Instilling character values, especially discipline and honesty, is an important part of basic education. Social studies teachers have a strategic role in shaping good student character. This study uses a qualitative approach with a case study method, which involves observation, interviews, and documentation to collect data. The results of the study indicate that the performance of social studies teachers can be optimized with a more personal and interactive approach, as well as the application of creative learning strategies. In addition, the role of parents and the school environment is also very supportive in shaping discipline and honesty in students.

Abstract

This study aims to analyze the role and function of the Regional Regulation Formation Agency (Bapemperda) of the Taliabu Island Regency DPRD in the process of forming regional regulations (Perda). The birth of Bapemperda as a fitting tool for the DPRD is a mandate of Law Number 12 of 2011 concerning the Formation of Laws and Regulations, which emphasizes the importance of the quality of regional legal products to be in harmony with the needs of the community and regional development. The research method used is a qualitative approach with data collection techniques through interviews, documentation, and literature studies. The results of the study show that the Bapemperda DPRD of Taliabu Island Regency plays an important role in the preparation of the Regional Regulation Formation Program (Propemperda), the discussion of the draft Regional Regulation, and providing legal considerations to the proposed regional regulations from the executive and legislative initiatives. However, in practice, the role of Bapemperda still faces various obstacles, such as limited human resources who understand legislative techniques, lack of public participation in the preparation of regional regulations, and suboptimal coordination between the DPRD and local governments. In conclusion, the Bapemperda of the Taliabu Island Regency DPRD has carried out the function of legislation according to its authority, but its effectiveness still needs to be improved through strengthening the capacity of members, increasing synergy between institutions, and encouraging community involvement in every stage of the formation of regional regulations so that the resulting regional regulations are truly aspirational, implementive, and effective for regional development
