Abstract

This study analyzes the presence of Islamic Fintech as a sharia-based digital financial institution as a role in distributing People's Business Credit (KUR) from banks to Micro, Small and Medium Enterprises (MSMEs). The research method used in this study is a qualitative method using secondary data with deductive analysis. The results of this study indicate the potential and role of Sharia Fintech in distributing KUR by banks to MSMEs. The existence of sharia fintech is expected to increase the productivity of MSMEs in Indonesia.

Abstract

A case of sexual violence experienced by a deaf and speech impaired person in Makassar who was raped by three men and blackmailed into giving money worth five million with the threat that if not given, the rape video would be distributed. In this case, it is difficult for the victim to provide information when going through a criminal trial process, because most of the existing Legal Aid Institutions are not equipped with translators for people with disabilities. Seeing the various forms of problems in handling sexual violence, improvements should be made in handling cases of sexual violence for victims with disabilities: First, Legal-formal legal assistance from LBH APIK Advocates, Second, Psychological personal assistance by adult clinical psychologists from before to the end of the trial, Third, Assistance by a sign language interpreter during the trial to be able to help provide information at the trial and 4). Create a Victim Trust Fund for victims of sexual violence to meet the material and immaterial needs of victims.

Abstract

The objective of this article is to examine the extent to which the implementation of Islamic law in Aceh has affected the civil rights of non-Muslim groups. Its focus is on their access to bureaucracy and public services after the implementation of Islamic sharia. The article seeks to answer these questions: (1) What is the opinion of the non-Muslim communities in Aceh on the implementation of Sharia law and its impacts on their lives in Aceh? (2) Do they experience discrimination when it comes to bureaucracy, government, and access to public services after the special autonomy status granted in Aceh? (3) What is the strategy for strengthening access to bureaucracy and public services for non-Muslim community in Aceh? To answer this question, the author conducted research using a qualitative approach with a purposive sampling technique involving seven informants ranging from local bureaucrats, interfaith leaders and non-moslem NGO to utilizes in-depth explanation to assess the accessibility of public services and bureaucratic systems under the implementation of Sharia law. The article indicates that there has been a shifting opinion among non-Muslims in Aceh before and after the implementation of Islamic Sharia in Aceh. Before the implementation of Islamic law, they had a slanted view of Islamic law. But after the implementation of Islamic Sharia, their views have changed positively. When dealing with bureaucracy and public services, non-Muslims generally do not feel any discrimination. However, there have been instances where non-Muslims faced difficulties in obtaining permits for activities.

Abstract

Abstract

Viktimisasi merupakan konstruksi yang menjelaskan bagaimana seorang korban tercipta dari sebuah tindak pidana. Dalam viktimologi, para korban yang muncul karena sebuah tindak pidana memiliki klasifikasi atau yang dikenal dengan istilah tipologi korban. Dalam perkembangan viktimologi, konsep-konsep humanis seperti hak asasi manusia ikut terlibat dan hukum pidana tidak hanya berorientasi pada penegakan hukuman saja tetapi juga mulai memiliki dimensi repatriasi atas kerugian yang dialami oleh korban tindak pidana. Akan tetapi, terdapat permasalahan dualisme dalam menentukan korban, apakah pelaku tindak pidana tersebut merupakan korban atau bukan. Hal seperti ini dapat ditemukan dalam situasi konflik seperti peperangan. Hal ini akan berimplikasi pada penegakan hukum pidana dan repatriasi hak. Artikel ini membahas tentang viktimisasi, tipologi korban, dualisme viktimisasi dalam perang, dan repatriasi hak korban kejahatan perang dalam kasus kudeta militer Myanmar.

Abstract

Indonesia memiliki tanggung jawab untuk melindungi hak-hak dasar setiap individu, yaitu hak asasi manusia (HAM). Regulasi terkait kepemilikan dan penggunaan senjata api, diatur salah satunya dalam Undang-Undang Nomor 8 tahun 1948 tentang pendaftaran dan perizinan senjata api. Senjata api hanya boleh digunakan dalam keadaan tertentu, seperti ancaman terhadap nyawa manusia, dan disertai langkah peringatan yang jelas. Namun, penerapan norma ini tidak selalu berjalan sesuai prosedur. Kasus-kasus penggunaan senjata api secara eksesif, termasuk pembunuhan siswa SMK di Semarang oleh seorang anggota polisi. Tindakan ini merupakan pelanggaran hak asasi manusia berat, yang melanggar prinsip negara hukum dan mencederai harkat martabat manusia. Dalam konteks negara hukum, aparat kepolisian harus tunduk pada supremasi hukum untuk menjaga kepercayaan publik dan mencegah penyalahgunaan kekuasaan. Hal ini berdampak negatif secara sosiologis, termasuk merusak citra institusi kepolisian, dan menimbulkan urgensi penegakan hukum yang lebih kritis terhadap aparat yang melakukan pelanggaran ini. Tujuan dilakukan penelitian ini adalah untuk mengetahui faktor penyebab penyalahgunaan kekuasaan aparat kepolisian dan penegakan hukum kritisnya dalam kasus extrajudicial killing. Penelitian ini menggunakan pendekatan penelitian hukum empiris dan jenis penelitian hukum kualitatif dengan menggunakan sumber data tersier. Adapun hasil yang diperoleh dari hasil penelitian ini menunjukkan bahwa kejahatan extrajudicial killing dapat diatasi dengan penegakan hukum kritis yang dapat memperkuat mekanisme akuntabilitas terhadap aparat yang melakukan pelanggaran hukum.

Abstract

The construction of Pantai Indah Kapuk 2 (PIK 2), a waterfront city mega-project in Tangerang, Indonesia, has raised legal, social, and environmental concerns. While designated as a National Strategic Project (PSN) due to its economic benefits, such as job creation and green tourism development, the project has caused significant adverse impacts. Specifically, a 30-kilometer sea fence obstructed access for approximately 4,000 fishermen, resulting in an estimated economic loss of IDR 16 billion since September 2024. This study examines the constitutionality of sea privatization through land certificates (SHM and SHGB) issuance and evaluates government responses to this issue. Using a normative juridical approach, the research analyzes legal frameworks governing coastal resource management, including UNCLOS 1982 and Indonesian laws such as Law No. 27/2007 and Law No. 26/2007. The findings reveal that government actions—sealing the area, dismantling the sea fence with military assistance, and revoking SHM/SHGB—align with regulations but lack systemic coordination. Key issues remain unresolved: criminal prosecution of perpetrators, economic restitution for affected fishermen, and environmental rehabilitation. This article proposes a systemic approach to restoring fishermen's rights through criminal enforcement against illegal actors, financial compensation for economic losses, ecosystem restoration, and strengthening public participation in spatial planning. Drawing lessons Australia's Community Participation Plans (CPP), the study emphasizes inclusive development that balances economic growth with social justice and environmental sustainability.
