Abstract

This study aims to analyze the dynamics of governing holidays and collective leave for Eid al-Fitr and Eid al-Adha, as well as their relationship to the implementation of religious moderation in Indonesia. The complexities associated with recognizing these Islamic celebrations arise from the diverse methods employed by the government, mass organizations, Islamic groups, and Sufi orders to determine the commencement of the Hijri month. A qualitative research approach was adopted, utilizing library research methods. Data were sourced from literature pertaining to governmental decisions on Eid al-Fitr and Eid al-Adha, as well as the perspectives of Nahdlatul Ulama, Muhammadiyah, Islam Aboge, and Jamaah Tarekat Naqsabandiyah Padang City. Additionally, literature on religious moderation and its application in Indonesia was examined. Findings indicate that the Indonesian Government, Nahdlatul Ulama, Muhammadiyah, Islamic Aboge, and Jamaah Tarekat Naqsabandiyah employ distinct methodologies for determining the dates of Eid al-Fitr and Eid al-Adha. The celebrations of these Islamic holidays in Indonesia align with key indicators of religious moderation, including national commitment, tolerance, non-violence, and the embrace of tradition. However, the study concludes that further interventions are necessary to mitigate potential future disputes and enhance the implementation of religious moderation in this context.

Abstract

The increase in civil cases that entered in the Court, prompting the MA to issue PERMA No. 1, 2016, on mediation procedures in court. The success of mediation in resolving cases in court is also found in the Pekalongan District Court, the Pekalongan District Court which has 2 (two) jurisdictions, namely Pekalongan City and Pekalongan Regency with data sources on the number of lawsuits from 2019 to December this is 46 (forty) six) cases, specifically cases with register number 13/Pdt.G/2019.PN.Pkl can be resolved through a mediation process without having to go through a long trial. This type of research is used libraryresearch with perprobleman this research 1) the mediation process and the obstacles faced in resolving civil disputes in the District Court Class IB Pekalongan City (Verdict No. 13 / Pdt.G / 2019 / PN.Pkl) 2) Juridical review of mediation practices conducted in resolving civil disputes in the District Court Class IB Pekalongan (Verdict No.13 / P Dt. G/2019/PN.Pkl). Teknik data collection used is library materials according to object studies. As for analyzing the data obtained, the author uses content analysis techniques. The results showed that: The Mediation Process that took place in the Pekalongan City Court Class 1B in decision No. 13 / Pdt.G / 2019 / PN.Pkl has been done well. In mediation conducted by mediators successfully help the parties to the dispute resolve the problem through mediation by agreeing to make peace with evidence of a deed of peace.

Abstract

The main problem of this research is how Islamic housing financing based on murabahah bil wakalah contract at PT Bank BTN Syariah Pekalongan branch office and sharia housing financing based on Murabahah bil Wakalah contract at PT. Bank BTN Syariah Pekalongan Branch Office in Perspective of Fatwa DSN No.04/DSN- MUI/IV/2000. The purpose of this study was to determine Islamic housing financing based on the Murabahah bil wakalah contract at PT Bank BTN Syariah Pekalongan Branch Office and Islamic housing financing based on the Murabahah bil Wakalah contract at PT Bank BTN Syariah Pekalongan Branch Office in the Perspective of Fatwa DSN No.04/DSN- MUI/IV/2000. This type of research is a field research (field-research) with a qualitative approach. Sources of data in the form of primary and secondary data, primary data obtained by interview and observation techniques while secondary data obtained by documentation. The subject of this research is PT. Bank BTN Syarih Pekalongan Branch Office and Customers. while the object is the settlement in accordance with the DSN Fatwa No.04/DSN-MUI/IV/2000 in the Murabahah bil Wakalah contract. And data analysis using descriptive qualitative. This research can be concluded that the implementation of the Murabahah bil Wakalah contract fulfills the financing requirements and is not in accordance with the DSN Fatwa No.04/DSN-MUI/IV/2000 because in the practice of the Murabahah bil Wakalah contract, this financing performs the contract before the goods are fully owned by the bank.

Abstract

The Raṣdu al-Qiblah of the Moon is a night-time method for determining Qibla direction, but it can only be used once per night and not on specific dates due to natural limitations. This study introduces an innovation by applying azimuth difference values (+90°, +45°, -45°), allowing the method to be used multiple times a night. The research compares this enhanced method with theodolite measurements and the Raṣdu al-Qiblah of the Sun to test its accuracy. Using a qualitative approach with astronomical analysis, the study finds that this modified method results in a deviation between 0°9'32.96" and 0°57'17.43". These results fall within acceptable Qibla tolerance limits as defined by some experts, showing that this method is accurate and viable as an alternative for Qibla determination, especially at night.
