Abstract

Studi hukum tidak akan lepas dari sebuah kondi?kasi teks yang memiliki tujuan tertentu. Agar tujuan yang terkandung dalam makna teks secara hakiki dapat tercapai, diperlukan adanya dekonstruksi hukum. Melalui  dekonstruksi, upaya pembangunan hukum di Indonesia yang selama ini dikenal hanya sebatas hukum yang berlaku secara yuridis formal, perlu dimaknai kembali sehingga mencakup nilai-nilai kemaslahatan yang berlaku secara universal. Meskipun perlu diakui, bahwa nilai-nilai kemaslahatan tetap tidak akan mampu menciptakan kepastian hukum, kecuali melalui upaya supremasi hukum yang berupa teks-teks itu sendiri. Untuk menciptakan kepastian hukum (legal certainty), ajaran itu hampir pasti mutlak diperlukan, namun dalam  realitas empirisnya ajaran hukum modern tersebut tidak begitu saja dapat diterapkan begitu saja menjadi rule of law tanpa melihat sebagai rule of morality.The study of law coincides with the codi?cation of texts, and the deconstruction of law is considered necessary to understand the true meaning of the legal texts. Through the process of deconstruction, the legal development of the country which is merely focused on formal and juridical aspect of law needs to include new nuance of universal public bene?t, despite any doubt on its legal uncertainty. In order to achieve legal certainty, reference to the legal text is a necessity, even though in reality modern legal theory cannot operate as rule of law without implementing rule of  morality.Kata kunci: Teks, Dekonstruksi, Kemaslahatan, Kepastian hukum

Abstract

In the current era of globalization and easy access to information technology, people's beliefs that have developed and existed since time immemorial have not diminished, such as the myth of Nasi Punar Bride, this myth has developed and is still believed by the people in Gelang Village, Sumberbaru District, Jember Regency, this belief includes that This punar rice can improve the fortunes of brides and grooms, can quickly find a soul mate for those who are still single, can cause household harmony as well as cause separation. Starting from the facts that occur in society, the author is interested in researching the myth of the nasi punar bridal reviewed from the perspective of Islamic law. The aims of this research are as follows: firstly, to find out the law for people who believe in the myth of nasi punar bridal viewed from the perspective of urf, secondly, what are the legal consequences if they believe it? the myth of bridal rice punar from a urf perspective. This research is a type of empirical research / field research using the urf approach method. Data collection techniques were carried out by means of interviews, observation and documentation. Data analysis goes through the stages of data collection, data reduction, data presentation and drawing conclusions. In order to test the validity of the data, the author used a triangulation technique, so that the results of this research concluded that: the practice of nasi punar in Gelang village, Sumberbaru sub-district, Jember district is carried out by the entire community with the aim of respecting the cultural heritage of ancestors, the ingredients and procession do not violate the rules of Islamic law, Regarding the myths circulating about this tradition, it is only believed by some parents whose thinking is still old-fashioned. In terms of urf, this tradition is included in the category of urf authentic / good tradition because there is no harm found in it. This tradition is also carried out outside of marriage, and does not in any way harm the validity of the marriage contract, so this tradition is permissible or permissible to carry out and preserve.

Abstract

Five years after the amendment of Law No. 16 of 2019, applications for marriage dispensations have risen sharply, particularly in Jember Regency, which recorded the highest rate in East Java. This article examines whether this phenomenon reflects an increase in legal awareness or merely administrative compliance with the ongoing practice of child marriage. Using a juridical-sociological approach, this study combines normative analysis of legal regulations and concepts with empirical data obtained through observation, interviews, and documentation. The findings reveal that although Supreme Court Regulation (PERMA) No. 5 of 2019 provides clear guidelines for judges, Pandalungan cultural influences and socioeconomic factors continue to sustain early marriage practices. The surge in cases demonstrates a form of instrumental legal awareness—people understand the law but utilize it to maintain traditional norms. This research recommends strengthening evidentiary standards, implementing mandatory psychosocial and medical assessments, and promoting community-based prevention strategies.
