Abstract

The design constructed by the formulation in the Law No. 35 of 2009 concerning Narcotics is that addicts and victims of narcotics abuse are given punitive measures (i.e. medical rehabilitation and social rehabilitation), whereas non-addicted narcotics abuse is given a criminal penalty. Parameters of narcotic abuse victims in the Law No. 35 of 2009 are very restricted and they are difficult to prove. Therefore, in addition to using the law, law enforcement officials also use other rules to determine the parameters of victims of drug abuse. The Law No. 35/2009, and also the law enforcement officers, uses the positivist victimology paradigm that places narcotics abusers as both perpetrators of crimes and victims of their own actions (self-victimizing victims). Meanwhile, according to radical victimology paradigm, narcotics abusers belong to precipitative victims. Based on that, this study recommend that the law formulation need to be made on the definition of drug abuse victims with the concept of depenalization, i.e. future criminal law policy includes narcotics abusers into victims who are required to undergo medical and social rehabilitation.

Abstract

Hukum merupakan alat utama yang digunakan untuk mengatur tata kehidupan bermasyarakat dan bernegara. Namun demikian, disebabkan karena perkembangan masyarakat dan juga didesak oleh kebutuhan semakin kompleksnya kehidupan sosial di masa sekarang, terutama berkaitan dengan nilai-nilai keadilan gender, hukum harus mengikuti arah perkembangan masyarakat. Pembaharuan hukum tidak lepas dari konsep tentang reformasi hukum yang cakupannya sangat luas, karena reformasi hukum tidak hanya berarti pembaharuan peraturan perundang-undangan. Reformasi hukum mencakup sistem hukum secara keseluruhan, yaitu reformasi substansi hukum, struktur hukum, dan budaya hukum. Tulisan ini berusaha mengkaji bagaimana arah pembaharuan hukum pidana Indonesia yang berkeadilan gender sebagai upaya untuk menjawab tantangan zaman dan juga mengakomodasi aspirasi masyarakat Indonesia pada umumnya. Penanggulangan tindak pidana yang didasarkan atas ketimpangan gender, yaitu kekerasan seksual, dapat dilakukan dengan sarana penal (penal policy) melalui kebijakan formulasi, kebijakan aplikasi, dan kebijakan eksekusi. Kebijakan formulasi digunakan untuk mewujudkan hukum yang berperspektif gender dan mengutamakan keadilan gender. Undang-undang yang mengatur hukum pidana dapat dirancang menggunakan konsep khusus (lex specialis) yang mengatur tindak pidana kekerasan seksual, baik dari aspek hukum materiil maupun hukum formil. Adapun kebijakan aplikasi, model pembaharuannya dilakukan oleh aparatur hukum dan dapat bekerja sama dengan masyarakat, dengan memiliki komitmen bersama dalam melawan segala bentuk tindak pidana yang berbasis ketimpangan gender. Sedangkan dalam kebijakan eksekusi, pemerintah dituntut untuk tegas dan tanpa ada sikap diskriminatif berdasarkan gender maupun pandangan yang merendahkan perempuan dalam melaksanakan tuntutan hukum yang telah diformulasikan maupun yang diputuskan oleh pengadilan.

Abstract

Penegakan hukum terhadap kejahatan korupsi harus dilakukan secara tegas, komprehensif, berkesinambungan, dan dengan terobosan-terobosan hukum (dengan cara-cara luar biasa), mengingat korupsi yang terjadi selama ini yang dilakukan secara sistematis dan meluas telah menyebabkan negara sangat dirugikan baik dari segi keuangan maupun perekonomian dan di samping itu juga telah melanggar hak-hak sosial dan ekonomi masyarakat luas. Pemberntasan tindak pidana korupsi sebagai extra ordinary crime harus dilakukan secara luar biasa (extra ordinary). Dengan demikian implementasi asas retroaktif kiranya dapat dirasionalisasikan, walaupun bertentangan dengan asas legalitas. Dalam hukum pidana Islam penerapan asas retroaktif masih bisa dimungkinkan, walaupun dengan batasan yang sangat ketat, seperti harus menguntungkan korban dan untuk kepentingan umum (kemaslahatan umum), karena hal ini menyangkut hak asasi manusia agar tidak terjadi abuse of power.

Abstract

Penegakan hukum merupakan suatu keharusan yang dijalankan negara dalam melindungi warganya, karena penegakan hukum adalah menegakkan nilai-nilai kebenaran dan keadilan. Usaha penanggulangan kejahatan dengan hukum pidana pada hakikatnya adalah bagian dari usaha penegakan hukum pidana. Penegakan hukum pidana diwujudkan melalui suatu kebijakan hukum yang merupakan bagian dari politik hukum nasional. Hal ini melibatkan berbagai unsur dalam negara, mulai dari pembuat undang-undang, aparat penegak hukum, sampai warga negara. Fokus pembahasan makalah ini adalah bagaimanakah kebijakan penegakan hukum pidana terhadap penanggulangan kejahatan, dan faktor apakah yang dapat menunjang penerapan kebijakan penegakan hukum pidana terhadap penanggulangan kejahatan. Pembahasan makalah ini terdiri dari empat poin utama, yaitu kebijakan penegakan hukum, faktor perundang-undangan, faktor penegak hukum, dan faktor budaya hukum masyarakat. Kajian ini berkesimpulan bahwa kebijakan penegakan hukum pidana dapat dimulai dengan pembentukan produk hukum yang tepat dan sesuai dengan perkembangan masyarakat. Adapun kendala yang dihadapi penegakan hukum dapat bersumber dari perundang-undangan, aparat penegak hukum, dan budaya hukum masyarakat.

Abstract

The term of drug abuse victims in the Act No. 35 of 2009 on Narcotics refers to a person who inadvertently uses narcotics, for being persuaded, tricked, deceived, coerced, and/or threatened to use narcotics. However, both addicts and the individual self-use drug abusers are in factvictims of syndicates of illicit narcotics trafficking. In addition, the spirit contained in the Narcotics Act also implies that narcotics addicts and abusers are victims of criminal acts of others in the form of illegal drug trafficking.Therefore, the Narcotics Act stipulates the obligation to undergo medical rehabilitation and social rehabilitation for addicts and self-use of drug abusers.On the contrary, Islamic law does not distinguish the term addicts, narcotics abusers, or victims of narcotics abuse. Islamic law tends to equate all these categories as perpetrators of narcotics abusers except those who are truely forced by others. In Islamic law, the punishment for them according to some scholars is the sanction of h}udu>d which is equated with the khamr (alcohol) drinkers, that is whipped as much as eighty times. While the opinion of other ulema, the penalty is ta’zir, of which form submitted to the ruler/government/judge. Thus, this type of ta’zir sanction in Islamic law is more in line with the prevailing laws and regulations in Indonesia.

Abstract

The current position of victims in the criminal justice system has not been placed fairly, because victims in the judiciary are only represented by public prosecutors who base their charges on statutory rules and facts obtained from witnesses. This paper reviews and compares the Indonesian national criminal justice system and Islamic criminal law system in terms of protecting the rights of victims of criminal acts during and after undergoing the trial process. The study of victims in the Western criminal law system adopted by Indonesia has been so extensive and profound, that it raises its own science called victimology, which is parallel to the science of criminology. Meanwhile Islamic criminal law (al-Fiqh al-Jinayah) still refers to fiqh books written by medieval jurists, so that the study of Islamic criminal law is stagnant and without significant progress. However, both national criminal law and Islamic criminal law, in principle, emphasize that the protection of victims must be balanced between the interests of the victims themselves, the perpetrators of crime, society, the state, and the public interest.

Abstract

Indonesia is a Muslim-majority country that has enacted Law Number 1 of 2023 concerning the Criminal Code as a common ideal between the state and its citizens in creating harmony in life. In a democratic country, the law-making process must open to public participation as a form of manifestation of the determination of the society’s living values, and as providing legitimacy for the formation of a law. This study focuses on discussing how much the aspirations of Muslims are adopted by the state in drafting the new Criminal Code, especially on issues related to Islamic morality, such as pornography, displaying contraceptives, adultery, cohabitation, abortion, and blasphemy. This study uses qualitative research methods with maslaha theory approach. The data sources are in the form of laws and regulations, minutes of DPR sessions, and the aspirations of the Islamic community. This study concludes that the new Criminal Code shows an increase in meaningful participation, which includes three prerequisites: the public has the right to be heard, the right to have their opinions considered, and the right to receive an explanation. The drafting of the new Criminal Code is at the “partnership” level and is in the “degrees of citizen power” category in the ladder of citizen participation scheme. At this level, the public has direct access to interact with policy makers regarding the new Criminal Code.

Abstract

The significance of women in public life rises as Indonesia embarks on reforming its political institutions and processes due to democratization. This study examines women's public life in Banyumas Regency, Central Java, in the context of cultural and Islamic values. Both Islamic and Penginyongan cultural values endorse traditional gender roles, potentially limiting women's public participation. However, these values also foster social harmony, community involvement, and religious ethics, which may support women's political engagement. The research data includes the number of women in public roles, their effectiveness in advocating for women's interests, and the interpretation of Islamic and Penginyongan cultural values. Data collection methods encompass interviews, observations, and document analysis. This study concludes by utilizing a sociological approach based on David Easton's systems theory that Islamic and Penginyongan cultural values influence women's public life, and political representation in Banyumas is multifaceted and shaped by various interacting factors. Understanding these dynamics is essential for crafting strategies to advance gender equality and women's public life empowerment in the region.
