Abstract

Indonesia didominasi oleh penganut agama Islam yang tentunya tunduk kepada syari’at. Permasalahan pembagian waris antara anak kandung dan anak angkat merupakan fenomena yang sering ditemui di masyarakat. Permasalahan ini muncul salah satunya dilatarbelakangi karena kurangnya pemahaman masyarakat tentang bagaimana kedudukan dan bagian anak angkat dan anak kandung berdasarkan hukum Islam. Berangkat dari hal tersebut, Pengabdi sebagai mahasiswa hukum menginisiasi kegiatan penyuluhan tentang warisan antara anak kandung dan anak angkat di Desa Jatikuwung, Gondangrejo. Tujuannya dari penyuluhan tidak lain untuk memberikan pemahaman dan sosialisasi bagi masyarakat akan pembagian warisan berdasarkan Kompilasi Hukum Islam antara anak kandung dan anak angkat. Metode yang dilakukan sebelum melaksanakan penyuluhan kepada ahli waris Dipo Karyo dengan melihat dasar permasalahan para ahli waris dalam pembagian waris, setelahnya Pengabdi melakukan riset untuk mengetahui landasan normatif pembagian waris islam dalam Kompilasi Hukum Islam, kemudian Pengabdi memilih tempat dan waktu penyuluhan bagi para ahli waris, selanjutnya Pengabdi melaksanakan penyuluhan bagi ahli waris. Antara anak kandung dan anak angkat memiliki kedudukan yang berbeda di mata hukum dalam hal warisan. Dijelaskan dalam pasal 209 KHI bahwa anak angkat hanya berhak mendapatkan wasiat wajibah sebanyak maksimal 1/3 dari keseluruhan harta. Adapun produk akhir dari penyuluhan ini akan dituangkan dalam bentuk laporan dan artikel publikasi ilmiah.   Abstract Distribution of Inheritance of Biological and Adopted Children According to Islam (Counseling in Jatikuwung Village). The problem of inheritance division between biological children and adopted children is a phenomenon that is often encountered in the community. This problem arises, among others, due to the lack of public understanding of how the position and share of adopted children and biological children based on Islamic law. Departing from this, we as law students-initiated counseling activities on inheritance between biological and adopted children in Jatikuwung Village, Gondangrejo. The purpose of the counseling is none other than to provide understanding and socialization for the community on the division of inheritance based on the Compilation of Islamic Law between biological and adopted children. The method used before conducting counseling to the heirs of Dipo Karyo was to look at the basic problems of the heirs in the distribution of inheritance, after which we conducted research to find out the normative basis for the distribution of Islamic inheritance in the Compilation of Islamic Law, then we chose the place and time of counseling for the heirs, then we conducted counseling for the heirs. Biological children and adopted children have a different position in the eyes of the law in terms of inheritance. It is explained in article 209 KHI that adopted children are only entitled to get a will and testament as much as a maximum of 1/3 of the total assets. The final product of this counseling will be outlined in the form of reports and scientific publication articles.

Abstract

Allah SWT created humans as the most perfect beings and in pairs, instilling affection within the bonds of marriage to achieve the ultimate goal of attaining His pleasure. However, marriage is not without challenges, and one significant issue is domestic violence, where women are often the primary victims. Such occurrences highlight a disregard for women's rights, which are an integral part of human rights. This study aims to explore the position and rights of women as human rights in Islam and examine the legal protections available in cases of domestic violence. Using a normative research method with a statutory approach, this study relies on secondary data collected through literature review and analyzed qualitatively for descriptive presentation. The findings reveal that Islam accords women a high and equal status with men, granting them rights that are fundamental to their humanity. Domestic violence against women is a clear violation of the principles outlined in the Qur'an, As-Sunnah, and Indonesia’s positive law.
