Abstract

Based on research data, it is found that many teenagers in Indonesia have had sex before marriage. This behavior is not by the norms that apply in Indonesia, and of course, this deviant behavior will cause new problems in society. In Nagari Preparation Koto Gadang, West Sumatra, a social sanction was imposed on community members who violated Adat. This sanction is known as the social sanction "Ditinggian Janjang." But, it is not yet known how applying this sanction in the community can reduce the number of violations committed by the community, one of which is promiscuity. This study aims to determine the application and role of social sanctions in Ditinggi Janjang. The author's research method is sociological-normative with bibliographic sources and observes the characteristics of a community's behavior in an area in an aspect of social life, observation, interviews, and documentation. Based on the study results, it can be seen that the application of social sanctions is applied to the entire community. The role of ditinggan janjang’s social sanctions is to prevent and solve various problems, especially those related to free sex in the community, in preparation for Nagari Persiapan Koto Gadang, Baso District, Agam Regency, West Sumatra Province. Abstract

Business conspiracy or conspiracy is a form of cooperation carried out by businessactors with other business actors with the intention of controlling the relevant market forthe interests of the conspiring business actors. The Business Competition SupervisionCommission (KPPU) is tasked with examining alleged violations of Law Number 5 of1999 concerning the Prohibition of Monopolistic Practices and Unfair BusinessCompetition, and each decision uses a Per Se Illegal approach and a Rule of Reasonapproach. In the case of tender conspiracy, the Commission Council must apply the Ruleof Reason approach in its decision to analyze the case. However, the KPPU's decisionhas not been consistent in applying the Rule of Reason approach to the case of tenderconspiracy by the government. Therefore, the research objectives of this thesis are,firstly, to determine the variation of the application of the Rule of Reason approach to theKPPU's decision on the procurement of goods/services by the government. Second, tofind out the ideal indicators in the application of the Rule of Reason approach to theKPPU's decision. This study uses normative/legal research methods to analyze casestudies. This study uses secondary data sources by using primary legal materials,secondary legal materials, and tertiary legal materials. From the results of the studythere are 2 main things that can be concluded. First, the variation of the application ofthe Rule of Reason approach to the KPPU's decision on the procurement ofgoods/services by the government is contained in Decision Number 04/KPPU-L/2020,Decision Number 05/KPPU-I/2020 and Decision Number 35/KPPU-I/2020. Where in thedecision Number 04/KPPU-L/2020 and Decision No.05/KPPU-I/2020 the Rule of Reasonapproach has not been implemented perfectly, and in Decision Number 35/KPPU-I/2020the Rule of Reason approach has been implemented perfectly. Second, the ideal indicatorto apply the Rule of Reason approach is regulated in Article 22 of the 1999 Law on theProhibition of Conspiracy, which regulates indications of conspiracy in tenders. Indecision Number 04/KPPU-L/2020 the Commission Council did not apply the Rule ofReason approach perfectly. In decision Number 05/KPPU-I/2020 the CommissionCouncil has not implemented the Rule of Reason approach perfectly. Abstract

Melalui kajian terhadap peraturan hukum dan praktik peradilan, penelitian ini bertujuan untuk menyoroti perbedaan dan persamaan dalam kompetensi pengadilan perburuhan dan komposisi hakim, serta demonstrasinya terhadap perlindungan hak-hak warga negara dan memastikan praktik perburuhan yang adil. Penelitian ini menggunakan metode normatif dengan pendekatan hukum, pendekatan komparatif dan pendekatan konseptual. Jadi metodologi ini melibatkan tinjauan komprehensif terhadap literatur hukum, undang-undang, dan kasus hukum yang terkait dengan hukum perburuhan dan pengadilan hubungan industrial di Indonesia dan negara-negara Eropa terpilih. Selain itu, analisis komparatif akan dilakukan untuk mengidentifikasi pola, tren, dan praktik terbaik dalam menyelesaikan perselisihan ketenagakerjaan dan melindungi hak-hak pekerja. Hasil penelitian ini menunjukkan adanya variasi yang signifikan dalam kompetensi pengadilan hubungan industrial dan komposisi hakim di berbagai sistem hukum. Variasi ini mempunyai implikasi terhadap perlindungan hak-hak pekerja dan efektivitas mekanisme penyelesaian perselisihan perburuhan. Analisis komparatif ini mengungkap pengetahuan mengenai potensi reformasi atau perbaikan dalam kerangka hukum Indonesia untuk meningkatkan fungsi pengadilan hubungan industrial dan memastikan perlindungan yang lebih baik bagi pekerja. Kesimpulannya, penelitian ini menggarisbawahi pentingnya memahami titik temu antara Hukum Administrasi dan Hukum Perdata dalam konteks Pengadilan Hubungan Industrial. Dengan menganalisis peraturan hukum dan praktik peradilan di berbagai kewenangan, penelitian ini memberikan kontribusi pada pemahaman yang lebih mendalam mengenai kompleksitas penyelesaian perselisihan perburuhan dan perlindungan hak-hak pekerja. Laporan ini juga memberikan wawasan berharga bagi para pembuat kebijakan dan praktisi hukum di Indonesia untuk memperkuat kerangka hukum yang mengatur hubungan industrial dan mendorong praktik ketenagakerjaan yang adil dan setara.
