Abstract

Underage marriage is a marriage practices performed by couples in which one or both old and young in view of the present. This happens because of the provisions of Article 7 paragraph (2) of Law No. 1 of 1974 on marriage that give space to each person to perform underage marriage, because in the article or in the explanation of the Act does not explain the reason for the important for a person to perform underage marriage. The practice of underage marriage is in need of attention and setting clear, because there are even more people in Indonesia to underage marriage. The purpose of this thesis, namely: First, to determine the setting of underage marriage by Act No. 1 of 1974 concerning marriage are in accordance with Act No. 23 of 2002 on the protection of children, Second, to determine the legal protection of children who do underage marriage according to Law No. 23 of 2002 on the protection of children.Keywords : underage marriage- legal protection-children

Abstract

The song is included in the creation of objects protected by the Copyright Act as mentioned in Article 40 paragraph (1) letter d. The act of downloading songsthrough the site without paying or illegal adverse economic rights of copyright owners and contrary to Law Number 28 Year 2014 About Copyright.Problems in this thesis includes two (2) things are, how law enforcement action against downloading of songs through the site without paying on the internetbased on Copyright Act in District Sail, Pekanbaru. and how efforts to be made by the Regional Office of the Ministry of Justice and Human Rights Riau to overcome.The general objective of this study was to fulfill the terms andthesis in order to obtain a law degree at the Faculty of Law, University of Riau, broaden knowledge, especially in the field of civil law.This research is using this type of sociological research, meaning research by examining the legal aspects to see the legislation in forceand compared with that obtained in the execution of the field by way of a survey.Analysis of materials research in this thesis using qualitative methods, in order to draw conclusions using deductive method.This study shows that the enforcement of copyright laws in the District of Sail, Pekanbaru still not running properly marked still many actors downloading of songsThe District of Sail despite socialization. Efforts made by the Regional Office of the Ministry of Justice and Human Rights Riauis to conduct socialization to urge respect and prohibit copyright infringement and conduct investigations related to the reports submittedwhich is handled by the Civil Servants (investigators) and aided by police investigators conducted in accordance with the Copyright Act.Society should appreciate the creative works of others and does not violate the existing rules,Law enforcement officers must carry out their duties and obligations properly in order to reduce the particular song copyright infringement on the Internet.Keywords: Copyright Protection, Download Songs, World Without Pay.

Abstract

Electric power services being developed by PT. PLN (Persero) is currently the prepaidservices of electric power, the customers who use electric power prepaid services both newcustomers and migrated customers from electricity users postpaid to prepaid electricity usershave to register first to the nearest PLN office or to the official website of PLN. After registering,there will be an agreement between PLN with the customers to conduct the electricity purchase.However in fact, not all of the pre-paid electricity uses the purchase agreement, for examplethere are some customers who are late for 2-3 months late in paying accounts, and there is thetermination and replacement of electricity postpaid to prepaid electricity unilaterally performedby PLN without any notice and agreement first. Data collection technique used in this research isinterviews, questionnaires, and library research. The research findings concluded are: first, thepurchase agreements between customers and PT. Pekanbaru Area PLN (Persero) Rayon Panamis not purely a legal agreement because the process of installation of pre-paid electricity is donewithout notice and consent from the customer. Second, the effect of purchase agreement pre-paidbetween the customers and PT. Pekanbaru Area PLN (Persero) Rayon Panam is there is theobligation of the customer which is not fulfilled. It is by not paying the electric bill each monthwithin a predetermined time up to 2-3 months in a row causes the electrical disconnection by thePLN as a sanction, but by not paying the electricity bill for 2-3 months, it does not mean thatPLN electricity can replace it by electricity prepaid without the permission from PLN. The writersuggests that, First, PLN should give notice for the termination to the customers in order to avoidmake customers feeling disadvantaged, and for the installation of pre-paid electricity, thecustomer should have the agreement letter. Secondly, as the electricity users, customers shouldrealize for their rights and obligations, the PLN should give prior notice to the customer beforeperforming the electrical disconnection.Keywords: Sale Purchase Agreement - Pre-Paid Electricity - PT. Abstract

The understanding grant pursuant to Article 171 paragraph g Presidential InstructionNo. 1 of 1991 Compilation of Islamic Law in defining the grant is granting an objectvoluntarily without adaimbalan from one person to another are still alive to have. Compilationof Islamic Law stipulated that grant requirements, penghibah has also 21 years of age,sensible and based on voluntarism and much - much 1/3 of his property as provided for inArticle 210 Compilation of Islamic Law. While grants are made by parents to their children,their children can be taken into account as an inheritance, when her parents died as stipulatedin Article 211 Compilation of Islamic Law while regarding the withdrawal of the grant of thetreasure that has been granted is not possible for the withdrawal, unless the grant is donepeople parents to their children as stipulated in Article 213 Compilation of Islamic Law.Grant also has a social function in people's lives both given individuals andinstitutions, the function of the actual grant does not go accordingly. As one example the caseof a grant to Case Number: 168 / Pdt.G / 2009 / PA.Pbr, concerning the cancellation of a plotof land according to the Islamic law which is in accordance with the provisions of theapplicable law or is not appropriate and to determine how the consideration of the judges inCivil judge No. 168 / Pdt.G / 2009 / PA.Pbr, whether the judge's decision has met theprinciple of legal certainty in the cancellation of the grant a piece of land according to Islamiclaw ruling Case Number 168 / Pdt.G / 2009 / PA.Pbr. This type of research is a normativelaw, namely the study of the level of legal synchronization. In this study the authors used atechnique research literature (Library Research) supported by secondary data according to itspower divided into three Haban law, namely the primary legal materials, secondary law, andtertiary legal materials.From the results of research on the religious court decisions pekanbaru the casenomor168 / Pdt.G / 2009 / PA.Pbr. grants of land and buildings thereon permanent home withGrant Act No. 282/2008 on December 2, 2008, which has been granted or be declaredcanceled or revoked as the joint property of husband and wife, for the purpose ofpenghibahhan not materialize. Abstract

Already a nature of every human being in this world of the opposite sex to live together to continue the marriage and form a family that is happy with the goal of having offspring that human life is lost and can not be sustained .The desire to have a child is a human instinct , but the instinct is sometimes hampered by destiny , where the desire to have children is not reached. Adoption is an alternative to save marriage. The phenomenon of child adoption event is common in Indonesia society for both the outside and the family. Law number 1 of 1974 on the marriage does not regulate the issue of adoption or adoption agency but in customary law has been around a long time.In legal research, the researchers used a type of normative legal research. Methods of research in this paper is the research literature drawn from various sources of law. Source data used is primery data, secondary data and tertiary data.Research is the position adopted in the case of inheritance in Indonesia consists of 3 (three) legal systems, namely : customary law, positive law and Islamic law thethrid law has different rules of customary law requires each of the respective regions are some areas stipulate that adopted children have the same status as biological children in terms of inheritance and some areas do not provide equality in terms of inheritance so that adopted children are not entitled to inheritance. While the positive law stipulates that children adopted and biological children have the same position in terms of inheritance but are not regulated clearly in legislation and in Islamic law that arrangement contained in the law compilation islam states against adopted children who do not receive the inheritance given was borrowed as much 1/3 inheritance adoptive parents. The legal consequances of the adoption in terms of liability adoptive parents, they are required for the maintenance and education of the child until the child is capable of standing alone and adoptive parents be the legal guardian of the child since the court ruling setSuggestions writer , First , the government should establish a rule in the form of legislation or codification of the law governing the national adoption so that their legal certainty . Abstract

Reciprocal relationship between the air carrier in this case PT. Lion Air Office Pekanbaru and passengers as service users created rights and obligations of each party. However, in practice lost baggage that causes damage to passengers without the fulfillment of the rights of passengers as appropriate The purpose of this study, to investigate the implementation of the air carrier liability for lost baggage on the PT. Lion Air Representative Office Pekanbaru, to find remedies that can be taken by a passenger to lose baggage at. Lion Air Office Pekanbaru This type of research is a sociological study, because in this study the authors directly conduct research on the location or place under study in order to provide a complete and clear picture of the problem under study. This research was conducted at PT. Lion Air Office Pekanbaru, while the population and the sample is a whole party relating to the issues examined in this penelitiaan, data source used, primary data, secondary data and data tertiary, data collection techniques in this study with interviews, filling the questionnaire, and literature. Implementation responsibilities lost baggage by PT. Lion Air Office Pekanbaru based on the presumption of innocence which responsibilities according to this concept the air carrier was found guilty and will pay compensation for the loss of checked baggage. Remedy which can be carried by the passenger is through non-litigation and litigation provisions are based on legislation. To the PT. Lion Air Pekanbaru Representative Office in order to further improve the monitoring of goods baggage belonging to passengers and provide transparency of procedures regarding the efforts that can be taken by passengers in the event of loss of baggage. To the government in order to further improve the oversight of the air carrier to provide legal protection and guarantees the fulfillment of the right of every citizen. Abstract

traffic accident is an incident on the road that can not be known when and where it will happen. Traffic accidents are a matter that could give rise to rights and obligations for each party for damages. Traffic accident that causes damage to a third party in the civil responsibility of employers or owners dikerenakan bus driver or bus wardens to supervise. It can be seen from the provisions of Article 1367 of the Civil Code and Article 234 paragraph (1), (2) of Law No. 22 of 2009 on Road Traffic and Road Transport. Abstract

Government regulates consumer protection explicitly in Act Number 8 of 1999 on Consumer Protection. The problem formulation of this thesis: First, the implementation of the tasks of Food and Drug Supervisory Agency in monitoring food containing harmful ingredients in Pekanbaru, Second, barriers to the implementation of the tasks of Food and Drug Supervisory Agency in monitoring food containing harmful ingredients in Pekanbaru.In this study, the authors use a kind of sociological research the nature of descriptive research that accurately describe the nature of an individual, phenomenon, studied. This research was conducted in BPOM Pekanbaru, while population and sample an entire party related to the problem under study, data collection techniques interview with the head section of the examination, questionnaire data collection methods make a list of questions that have a correlation with the problems studied by the author to consumers and businesses, namely data collection study literature library reading literature, qualitative data analysis is based on the description of sentences and draw conclusions deductively that from the general to the particular, the date source used, primary date, secondary and tertiary.The results obtained from this study, first, the implementation of the tasks BPOM Pekanbaru refers to the Minister of Trade Regulation Number 44 Year 2009 concerning Procurement, Distribution and Monitoring of Hazardous Materials. Second, barriers, industries that use harmful ingredients not listed on Industry and Trade and the Department of Health, the people's habits, lack of human resources BPOM Pekanbaru.Based on the research results, there are two basic problems that can be inferred. First, the implementation of the tasks BPOM Pekanbaru refers to the Minister of Trade Regulation Number 44 Year 2009 concerning Procurement, Distribution and Monitoring of Hazardous Materials. Second, barriers, lack of implementation of duties and functions, because the vast working area, the lack of human resources. Suggestions author, first, to optimize the duties and functions of BPOM Pekanbaru by increasing human resources. Abstract

Consumer protection is a term used to describe the Legal Protection givento consumers in their efforts to meet the needs of the things that could harmconsumers themselves. Consumer protection law exists to protect the consumerthemselves. Consumers are required to be critical using product with considering"needs" rather than "desire". Consumers should be aware of the good’s conditionprovided by businesses. Here the wisdom required consumers to be careful inchecking the condition of the goods as well as a description of the composition, andan expiration date to avoid things that can harm consumers itself when using goods.In order to achieve the objective of consumer protection laws to increaseawareness, ability and independence of the consumers to protect themselves. Thisresearch objective are: First, to determine why consumers do not implement theirobligations in order to protect themselves as consumers, Second, obstacles thatoccur so that consumers do not carry out its obligations, Third, efforts should bedo to raise awareness of consumer.The result of this research are, First, the implementation of the obligationsof consumers in order to protect themselves as consumer has not been fullyimplemented by the consumer, Second, obstacles that occur caused by lack ofconsumer awareness, the lack of information and the dissemination of governmentabout becoming a smart consumer , Third, attempts to do is to conduct counselingto increase knowledge, awareness, and independence of consumers with the help ofrelevant institutions, such as the Institute For Consumer Protection Organization.Suggestions,First, community should to be more active and intelligent and criticalas consumers. Abstract

Since the internet was first introduced it never suspect that impact is more intense. Internet bring the world economy enters a new phase like trading via internet. Indonesia through legislation Nomor 11 tahun 2008 Tentang Informasi dan Transaksi Elektronik regulating the trade via the internet, like sale and purchase agreement. Sale and purchase agreement via the internet is considered to have a high risk because of the difficulty in reaching the parties to a tort action in the transaction. Therefore it necessary legal protection and legal certainty for legislation yet not accommodate, thus should be pursued to achieve a balance of law remain in these conditions.The purpose of this thesis, as: first, to determine the legal protection of the parties in the implementation of the agreement via internet. Second, to determine the inhibiting factors in the purchase agreement via internet.This kind of research can be classified in sociological juridical research, because it done by analyzing data in laws and compare with the facts obtained through interviews. Overall population and sample related to the issues examined in this study, the data source used primary data, secondary data and tertiary data, collection data techiniques in this study with interviews and literature study.Of the research problem, there are two main things that can be concluded. First, legal protection for consumen in the purchase agreement via internet, including protection laws agreed upon by both parties as well as on electronic evidence set forth in pasal 5 ayat 1 Nomor 11 tahun 2008 Tentang Informasi dan Transaksi Elektronik. Second, inhibiting factor in internet transactions specifically the barriers, obstacle due the distance, space and time, the general of obstacle, data authenticity of obstacle, the presence of items and in proving the prowerss of the parties. Advice author, first, users expect buyers in particular need to be more cautious in making transactions via internet, buyers should also be carefully and thoroughly to avoid losses due to the irresponsible parties.
