Abstract

An employment agreement that doesn’t contain balanced rights and obligations between the parties will bring losses to one of the parties. The imbalance in the rights and obligations in the employment agreement is because the employer usually uses standard clauses. Thus eliminating the opportunity for workers to participate freely in determining the contents of the agreement. The freedom left for the workers is in the form of a choice between accepting or rejecting. This study aims to identify how the position of standard clauses in employment agreements based on the principle of freedom of contract. This research is a normative research conducted by examining library materials or secondary data. The research show that the existence of standard clauses in the agreement does limit the essence of the principle of freedom of contract. Standard clauses in employment agreements are made because of business efficiency which is also possible to arise due to an unequal position between the  parties. The principle of freedom of contract in an employment agreement isn’t included in the four legal conditions that must be met in an agreement. So that the validity of employment agreements that made without the principle of freedom of contract will remain valid.

Abstract

Daily workers often express concerns about whether their wages are sufficient to provide them with a decent standard of living. Government Regulation Number 36 of 2021 regarding Wages states that the calculation of minimum wage is determined based on economic and employment conditions, which differs from the previous regulation that emphasized setting the minimum wage according to a decent living standard. This change has had a significant impact on wage determination. This study aims to examine how the latest wage policy can contribute to ensuring a decent living for daily laborers in Indonesia. The study adopts a normative legal research method and provides analytical descriptive data. It involves analyzing legal materials and comparing them with the main issues at hand. The calculation of wages for daily laborers is based on factors such as working hours, working days, or work results. However, it is important to note that the mandatory wage component for daily workers is solely the minimum wage, excluding allowances and non-wage income components. This confirms that the current wage structure for daily workers falls short of meeting the needs of a decent life for both workers and their families, as it solely relies on working hours. Therefore, it is crucial to prioritize efforts to improve the standard of living for daily workers in Indonesia.

Abstract

Arus keluar masuk tenaga kerja asing dewasa ini terjadi di Indonesia dan Malaysia sebagai dampak dari  program Asean Economic Community (AEC). Salah satu dampak negatif program in bagi negara berkembang adalah arus tenaga kerja asing yang semakin mudah untuk masuk. Sebagai negara serumpun Indonesia dan Malaysia harus melangkah bersama untuk memberikan perlindungan bagi warga negaranya. Permasalahan yang akan diangkat dalam program ini yang pertama adalah fenomena arus masuknya tenaga kerja asing yang membuat kesempatan bagi para pekerja lokal terutama generasi muda menipis. Karena kesempatan kerja yang menipis maka akhirnya calon pekerja hanya menerima pekerjaan apapun walaupun hak-hak mereka tidak terjamin. Masalah kedua yakni keterbatasan pengetahuan mengenai ketenagakerjaan  bagi calon pekerja. Terutama mengenai hak-hak dasar pekerja yang sesuai dengan peraturan perundang-undangan. Tujuan kegiatan ini adalah untuk memberikan ilmu terkait dengan dunia ketenagakerjaan baik yang berlaku di Indonesia dan Malaysia, terutama hukum ketenagakerjaan sebagai bekal untuk mempersiapkan masa depan generasi muda sebagai calon pekerja di Negeri kedah. Program ini dilaksanakan dengan metode penyuluhan atau penyampaian materi yang diakhiri dengan sesi diskusi. Progra ini memberikan hasil berupa pemahaman calon pekerja mengenai hak-hak dan perlindungan yang diatur dalam berbagai regulasi. Pengetahuan ini dapat digunakan sebagai bekal untuk mempersiapkan diri peserta sebagai pekerja dikemudian hari.
