Abstract

 As a public servant goverment especially distric goverment must show representation the will of center goverment, in this case quality of the hard work from district goverment must be evaluated, so it will reach the essence of a goverment as a public servant, but this is not an easy work because this evaluation must have abasic condition and it include many institutions, such like goverment institution or a non goverment institution but although it hard to realize doesnt mean it cannot be realize, it must be begin with a one focus evaluation and it increased to became two, three evaluation and more. Key Note : Evaluation of goverment as a public servant

Abstract

Pidana Penjara merupakan pidana yang dikenakan terhadap terdakwa berupa menghilangkan kemerdekaannya untuk sementara waktu atau seumur hidup. Pasal 1 ayat (1) Undang-Undang Nomor 12 Tahun 1995 Tentang Pemasyarakatan, menegaskan pemasyarakatan adalah kegiatan untuk melakukan pembinaan warga binaan pemasyarakatan berdasarkan sistem kelembagaan dan cara pembinaan yang merupakan bagian akhir dari sistem pemidanaan dalam tata peradilan pidana. Lembaga Pemasyarakatan menurut Departemen Kehakiman Republik Indonesia adalah unit pelaksana teknis pemasyarakatan yang menampung, membina narapidana agar dapat diterima kembali ke dalam  lingkungan masyarakat dan tidak kembali mengulangi suatu perbuatan  tindak pidana yang pernah dilakukan di masa terdahulu. Hak asasi yang erat kaitannya dengan para terpidana salah satunya adalah remisi, remisi merupakan pengurangan masa pidana, remisi diatur dalam Undang-Undang Nomor 12 tahun 1995 tentang Pemasyarakatan pada Pasal 14 ayat (1) menyatakan salah satu hak terpidana adalah mendapatkan pengurangan masa pidana (remisi). Pemberian remisi yang menjadi hak terpidana juga harus dilihat dalam konteks sifat kejahatannya, konteks sifat kejahatan ini dapat dilihat apakah menyangkut kelangsungan kehidupan manusia atau tidak sehingga pemberian hak remisi yang menjadi kewenangan dan tugas pemerintah tidak melukai keadilan masyarakat dan tidak memberikan peluang bagi terpidana kasus korupsi berlindung dibawah pembenaran hukum. Remisi atau pengurangan masa pidana dalam sistem pelaksanaan pidana khususnya menyangkut sistem pemasyarakatan sangatlah penting. Dalam pelaksanaan sistem pidana remisi para narapidana haruslah memenuhi syarat yang diberlakukan untuk narapidana itu sendiri, jika tidak maka hak remisi tidak akan diberikan. Terhadap kasus korupsi dapat menimbulkan dampak yang sangat luas, walaupun terdapat pula ketentuan lain yang menegaskan bahwa persyaratan untuk mendapatkan hak remisi haruslah bersedia bekerjasama dengan penegak hukum untuk membantu membongkar perkara tindak pidana yang dilakukannya, telah membayar lunas denda dan uang pengganti sesuai dengan putusan pengadilan untuk Narapidana yang dipidana karena melakukan tindak pidana korupsi serta bersedia bekerjasama dengan penegak hukum untuk membantu membongkar perkara tindak pidana yang dilakukannya.. Tindak pidana korupsi jelas menimbulkan akibat yang membahayakan dan meresahkan masyarakat, lebih khususnya keuangan dan perekonomian negara, atau dampaknya berwujud pada publik dapat menghancurkan efektivitas potensial dari semua program pemerintah, dapat mengganggu pembangunan, serta menimbulkan korban individual maupun kelompok masyarakat.

Abstract

This paper discuss about whether the ratification of the ASEAN Charter in accordance with Indonesian sovereignty. Results of this study indicate that a treaty is apply before it was officially implemented in Indonesia. This is because UU (the Act) of Ratification is interpreted as approval's DPR (House of Representative) that given to President to ratify a treaty or a charter. That's why, ASEAN Charter applies first before it was enacted in Indonesia. Result of this construction is illogical, how can be possible, Indonesia is bound to a treaty or a charter which hasn't applied yet. Although Indonesia has been engaged in a treaty, but as a sovereign country, Indonesia still has the right to independently (unilateral) to withdraw from the treaty if it is detrimental to the sovereignty of the Indonesia state. Therefore, as the State supremacy of the constitution, a new foundation need to be formalized in UUD 1945 (the Constitution of the Republic of Indonesia of 1945) by amending Article 11 of the UUD 1945.Keywords: Ratification, Treaty, ASEAN Charter, Article 11 UUD 1945

Abstract

The existence of law No. 8 of 1981 on the book of the law of Criminal Procedure Law in the life of the law in Indonesia have been demanding a new era, that of the era of revival of national laws that give priority to the protection of the rights of a suspect in the criminal justice system mechanisms.Pretrial is essentially an institution to conduct surveillance against acts horizontally attempts forcibly against the suspect for being in the process of investigation and prosecution. Institutions that carry out the functions of the pretrial is the District Court. so it is only found in pretrial Court level alone. Pretrial is one of apparition of Habeas Corpus as a prototype, i.e. as a place to denounce violations of human rights ("HAM") in a criminal proceeding process (andi hamzah) pretrial legal Effort itself basically aims to protect the rights of suspects in connection with the acts of forced efforts that might be undertaken by investigators against the suspect. With the lawsuit regarding pretrial status of a suspect, it can expand the authorities of the institutions of the pretrial, can also make law enforcement more professional and more careful in setting a person becomes suspect.Keyword : fulfillment, the suspect, judicial

Abstract

Non-Smoking Areas stipulates that non-smoking areas include public places, workplaces, places of worship, playgrounds, public transportation, teaching and learning process environments, health facilities and sports facilities, but in reality there are still many people who violate these provisions, including educated circles such as lecturers, teachers, students and so on. The purpose of this study was to obtain information about the level of educated people's perceptions of Jambi City as a smoke-free area and want to measure the participation of educated people in making Jambi City a smoke-free area. as the primary data source is the source of data obtained from interviews with selected samples and while the secondary data sources are books and journals and other research results, the approach used is the sociological aspect approach, namely to reveal social phenomena and phenomena that occur in the community. the field, while the data collection technique used is interview technique, the sampling technique is done by random sampling and purposive sampling, the data used is qualitative data, the results of the study show that the level of student knowledge Wa about Jambi City as a smoke-free area is quite good and optimistic about the implementation of Jambi City as a smoke-free area.

Abstract

This paper discusses about the problem of disclosure in capital market and the sanction of infraction. The result shows that the investor is requested to be more careful and in-depth into capital market analysis, a good and adequate transparency from the issuers, and also responsibility from institution or other support profession toward losses suffered by investor due to incorrect and misleading information. Sanction can be given by Bapepam as one way of completion through administration or civil law before taking legal action, besides doing its function to fulfill principle “disclosure” adequate.Keywords    : Disclosure, Transparency, Capital Market

Abstract

The purpose of this researc is to describe the roles and implementation of confiscation in Jambi court. The sample was taken by purpisive sampling technique and tha date was analysed by qualitative-descriptve technique. From the analysis it is concluded that the roles and the implementation of confiscation in Jambi court depend on the litigants and the accused. It is also found out that the litigants feel assissted during the process of the confiscation. Another finding is that third party frequently take over the ownership of the goods in the dispute. Effor that has been taken to solve this problems is tha the goods are carefully recorded. Besides, there should be collaboration with RT or Kelurahan.

Abstract

The purpose of this study is to apply the Business Model Canvas (BMC) to the business of oil palm farmers owned by young people in Jambi Province. This study used qualitative research methods through a descriptive approach and case studies. The analytical tool in this study used the Business Model Canvas (BMC). An in-depth analysis is carried out on business activities and the environment. The research sample amounted to 5 people determined by the purposive sampling method. Primary data was obtained through surveys, observations, and interviews, while secondary data was obtained through literature review. The results of the analysis with 9 components of BMC show that in general, oil palm farmers experience limited resources in plantation management to the selling process. The business development strategy that can be carried out is to look for Key Partners to support all fulfillment of the limited resources of Farmers in running a plantation business in a better and optimal manner. Key Partners in the form of “Support System” can be found or formed with the help of other parties. Synergistic Government, Companies, Educational Institutions (GCE) are needed, both at the policy level, as well as technically in an applicable and sustainable manner. The future research can be developed into qualitative and quantitative research, on different objects, with more complex models, involving more than one general business strategy development method such as SWOT Analysis and Blue Ocean Strategy, to marketing strategy, marketing mix, and promotion mix. for more in-depth and complex analysis.

Abstract

This study aims to identify and identify: (1) the implementation of fiduciary guarantee registration at the law and human rights office through the Notary Nurhasanah, SH, M.Kn office, (2) online obstacles in registering fiduciary guarantees at the law and human rights office through Notary office of Nurhasanah, SH, M.Kn and (3) solutions and solutions in overcoming obstacles in registering fiduciary guarantees at the law and human rights office through the office of Notary Nurhasanah, SH, M.Kn. This research is an empirical research research using a sociological juridical approach, which is a type of research that emphasizes field research based on data obtained from field research or certain places. The resource persons of this research are Notary Nurhasana, SH, M.Kn. The sampling technique used is purposive sampling. The analytical method used in this research is qualitative analytical thinking method and the conclusion is drawn using inductive thinking method. The results of this study indicate that the registration of fiduciary guarantees with this online system makes it easier for notaries to register fiduciary guarantees and does not take a long time where registration can be completed within a few minutes within a period of 30 (thirty) days from the signing of the fiduciary guarantee deed in order to obtain the legal force of the fiduciary guarantee deed. Obstacles in the electronic fiduciary registration process are incomplete data provided by the bank, and the unprepared Information Technology (IT) device to support the implementation of national electronic fiduciary registration. new fiduciary guarantee and immediately register the fiduciary guarantee online through a notary.
