Abstract

Forests in Indonesia are known to have Biodiversity Very High, but the forests of Indonesia Resources Turns Very Fast And worsens From year to year, singer caused illegal logging practices,  forest fires and encroachment And Peladang That move.  According to PT data. Ecosystem Restoration Indonesia (PT. REKI) Reached More Than 16,000 Hectares Of The 101.355 hectare land being restored OR restored to review so natural forests Back. Operating aggressive encroachers The land has to change their power unilaterally to review Operates Illegal logging and  Also planted with oil palm crops. Many diagnostic factors affecting the Land Conflicts BETWEEN lying on Economic, Social, Ecology And Needs agricultural land. Abstract

“Human rights could generally be defined as those rights which are inherent in our nature and without which we cannot live as human biengs”Understanding as mentioned above, it is a human rights as something that became a standard of achievement for all people and nations of the world Milestones of Human Rights begins with the initiation of the Magna Carta in England in 1252 and more significantly after the initiation of the Universal Declaration of Human Rights (UDHR 1948 )Therefore, as an independent country and dignity , the rights incorporated into the formulation of Pancasila and the 1945 Constitution , and after the inclusion of human rights into  the 1945   material     certainly   a consequence that human rights is a constitutional right guaranteed by law in Indonesia .       Human Rights initiated by the western world and has been incorporated into the 1945 Constitution there are certainly differences with the Islamic concept of human rights ; among others, Human Rights in Islam Tawheed and Aqeedah born of appreciation by Allah to perfect Insan over creation. Besides, it also looked at the man in Islam similarity in accordance with his nature .keyword :   Human Rights in Indonesia seen in Islamic Perspective.

Abstract

Pelaksanaan penegakan hukum tindak pidana penebangan liar di   Cagar Alam Durian Luncuk I telah dilaksanakan oleh aparat penegak hukum berdasarkan peraturan perundang-undangan yang berlaku, Akan tetapi saat di peradilan antara hakim dan jaksa penuntut umum tidak ada persamaan persepsi dalam menilai kerugian yang ditimbulkan oleh pelaku tindak pidana Penebangan liar. Sulitnya pelaksanaan penegakan hukum terhadap penebangan liar oleh  PPNS   Kehutanan Balai KSDA Jambi disebabkan oleh adanya permasalahan antara lain penyidikan dalam tindak pidana penebangan liar yang tidak hanya melibatkan Polri sebagai penyidik tetapi juga PPNS Kehutanan dan polhut yang diberi kewenanagn oleh undang-undang, hal ini yang sering menyebabkan  terjadi tumpang tindih kewenangan dan pelaku utama yang sulit terjerat, karena pelaku utama merupakan pemodal dari tindak pidana penebangan liar ini serta keterbatasan sarana dan prasarana yang dimiliki aparat penegak hukum menjadi faktor penghambat dari pemberantasan tindak pidana penebangan liar.
