Abstract

ABSTRAK Kabupaten Pekalongan merupakan lokasi yang memiliki potensi tinggi dalam penggunaan Surat Kuasa Membebankan Hak Tanggungan (SKMHT), hal ini disebabkan oleh gencarnya pembangunan oleh masyarakat yang membutuhkan dana besar yang antara lain berasal dari kredit yang diperoleh dengan menggunakan lembaga Hak Tanggungan yang selanjutnya menimbulkan berbagai masalah seperti apabila debitor wanprestasi. BTN selaku kreditor dalam pemberian KPR bersubsidi kepada debitor umumnya tidak menguasai benda yang menjadi jaminan kredit secara fisik, tetapi hanya memiliki hak kebendaan secara administratif. Pengikatan obyek jaminan yang berupa tanah, yaitu Hak Milik, Hak Guna Bangunan dan Hak Guna Usaha, prosesnya hanya sampai dengan Surat Kuasa Membebankan Hak Tanggungan (SKMHT) saja, dengan tidak dibebankan Hak Tanggungan atas obyek jaminan tersebut, maka BTN belum memiliki hak kebendaan atas jaminan tersebut secara faktual.Tujuan dari penelitian ini adalah untuk mengkaji dan menganalisis peran notaris dalam hal debitor wanprestasi, penggunaan SKMHT yang tidak diikuti APHT dalam hal debitor wanprestasi terkait dengan pemberian fasilitas Kredit Pemilikan Rumah Subsidi pada Bank Tabungan Negara serta upaya pihak Bank Tabungan Negara dalam hal debitor wanprestasi terhadap pemberian fasilitas Kredit Pemilikan Rumah. Metode yang digunakan dalam penelitian ini adalah metode analisis kualitatif, yaitu data yang diperoleh disusun secara sistematis kemudian dianalisis secara kualitatif agar dapat diperoleh kejelasan masalah yang akan dibahas.Dalam penelitian ini disimpulkan bahwa dalam menghadapi debitor wanprestasi Bank BTN mengambil langkah melakukan penjualan kembali dengan menggunakan kuasa menjual yang tercantum dalam akta “Pengakuan Hutang”, serta peningkatan SKMHT ke APHTkepada calon debitor, dan peran notaris yang hanya sebagai pembuat akta sehingga tidak turut serta jika terjadi wanprestasi.Kata kunci: Notaris, SKMHT, APHT, wanprestasi ABSTRACTPekalongan Regency is a location that has a high potential in the use of Power of Attorney Charging the Guarantee Right (SKMHT), this is caused by incessant development by people who need big fund which among others comes from the credit obtained by using the Mortgage Institution which further cause various problems such as if the debtor is defaulted. BTN as a creditor in the granting of subsidized KPR to the debtor generally does not control objects that become credit for physical security, but only have the right of property administratively. The binding of the object of collateral in the form of land, namely Right of Ownership, Building Rights and Cultivation Right, the process is only up to the Power of Attorney Charging the Guarantee Right (SKMHT) only, without the burden of the Guaranteed Fund on the object of the guarantee, BTN has no material right the guarantee is factual.The purpose of this study is to examine and analyze the role of a notary in the case of debtor wanprestasi, the use of SKMHT not followed APHT in the case of debtor wanprestasi associated with the provision of Subsidized House Ownership Credit in the State Savings Bank and the efforts of the State Savings Bank in the case of debt defaulting to the grant Housing Loan facility. The method used in this study is the method of qualitative analysis, the data obtained is arranged systematically and then analyzed qualitatively in order to obtain clarity of issues to be discussed.In this study it is concluded that in the face of debtor wanprestasi Bank BTN take steps to resell by using the power of sale which stated in deed "Recognition of Debt", and increase SKMHT to APHT to debitor candidate, and notary role which only as deed maker so do not participate if there was a default.Keywords: notary, SKMHT, APHT, wanprestasi

Abstract

ABSTRAKKekuatan Hukum Sertifikat Hak Tanggungan dalam hal musnahnya objek Hak Tanggungan karena bencana alam di Kabupaten Grobogan menjadi menarik untuk dibahas penulis, karena menimbulkan dampak bagi pihak kreditur. Dimana kreditur kehilangan objek atau benda jaminan yang sedang dibebani hak tanggungan. Dalam hal ini debitur tidak dapat disalahkan karena musnahnya objek atau benda yang dibebani hak tanggungan musnah oleh bencana alam, karena kapan terjadi dan dimana terjadinya bencana tidak dapat diduga dan diluar kekuasaan para pihak, hal ini merupakan keadaan memaksa atau overmacht/ forje majeur. Sehingga penulis merumuskan beberapa permasalahan, yang pertama adalah bagaimana kekuatan hukum sertifikat hak tanggungan dalam hal musnahnya objek hak tanggungan karena bencana alam, lalu permasalahan yang kedua adalah bagaimana perlindungan hukum terhadap pemegang sertifikat hak tanggungan yang musnah karena bencana alam.Pada penulisan tesis ini, penulis menggunakan metode pendekatan yang digunakan dalam penelitian ini adalah metode yuridis sosiologis (socio legal research) yang berarti mengidentifikasi suatu persoalan hukum dari sudut pandang sosial. Untuk menjawab permasalahan seputar hukum perdata terkait tentang Hak Tanggungan. Hasil penelitian yang dilakukan oleh penulis, pertama didapatkan bahwa kekuatan sertifikat hak tanggungan hapus apabila objek hak tanggungan telah musnah oleh bencana alam walaupun hal ini merupakan keadaan yang tidak disengaja dan di luar kekuasaan para pihak. Permasalahan kedua bahwa perlindungan hukum terhadap pemegang hak tanggungan, di dapatkan melalui prosedur pemberian kredit oleh pihak kreditur/ pemegang hak tanggungan, dengan melaksanakan prinsip kehati-hatian sehingga pihak kreditur dapat memperkecil resiko debitur cidera janji/ lalai/ wanprestasi. Adanya formulir syarat umum yang diberi stempel Notaris atau PPAT dibaca dan apabila disetujui oleh debitur, tanda tangan diatas materai. Kemudian, adanya prosedur penerbitan akta hak tanggungan baik itu SKMHT maupun APHT hingga pendaftaran sertifikat hak tanggungan di BPN hal ini untuk mendapatkan kekuatan hukum secara otentik dan mutlak sehingga apabila terjadi sesuatu dapat ditangani berdasarkan dasar hukum dan ketentuan yang telah disetujui oleh para pihak.Kata kunci :Sertifikat Hak Tanggungan, Objek Hak Tanggungan, Bencana Alam ABSTRACTThe Legal Strength of the Certificate of Mortgage Right in the event of the disappearance of the object of Mortality Right due to natural disaster in Grobogan district becomes interesting to be discussed by the author, because it has an impact for the creditor. Where a creditor loses an object or collateral item that is being burdened with a mortgage. in this case the debtor can’tbe blamed for the disappearance of objects or objects burdened by the mortgage is destroyed by natural disasters, because when and where the occurrence of disasters can’t be expected and beyond the power of the parties, this is a state of coercion or overmacht / forjemajeur. So the authors formulate some problems, the first is how the legal power of dependent certificates in the event of loss of mortgage objects due to natural disasters, then the second problem is how the legal protection of the dependent certificate holder who destroyed by natural disasters.In writing this thesis, the author uses the approach method used in this study is sociological juridical method (socio legal research) which means identifying a legal issue from a social point of view. which is a scientific research that has a function to answer the problems surrounding civil law. In the results, the first problem can be concluded that the strength of the mortgage certificate is deleted if the object of mortgage rights has been destroyed by natural disasters even though this is an unintentional situation and outside the power of the parties. In second case, it can be concluded that the legal protection of the mortgage holders is obtained through credit lending procedure by the creditor / holder of mortgage, by implementing the prudential principle so that the creditor can minimize the risk of the default / negligent debtor. The existence of a general terms form to be readed, and stamped by Notary or PPAT and signature by the debtor. Abstract

In this globalization era, competition among businesses in the relevant market is very tight. The businesses still struggle to compete with business competitors in the relevant market. The formulation of the problem show the application of Competition Law Against The Business Communities Using Disruptive Innovation. The method used is doctrinal and non-doctrinal. The data used are primary data is data obtained directly from the source and the respondents and secondary data is data obtained from the literature. Analysis of the data used is the qualitative analysis.Research results are. Application of competition law to businesses that use disruptive innovation is disruptive innovation has a major impact on competition in the market concerned, namely the consumers, consumers can be prosperious, and against the competition, then the conventional business operators must improve in order to compete. The first step that must be carried out by the Commission in analyzing whether the behavior of taxi online or not anti-competitive conduct in the market concerned, the Commission specifically define the relevant market definition in advance. Even when the market changed or created by a disruptive innovator, competition authorities (Commission) faced with the need for the existing market segmentation or determining a new market. Determination of the relevant market is very important to analyze whether a taxi online anti-competitive conduct and whether it has market power and dominant position which may misuse. Model law relationship triangle in the transport line between online app provider producers and consumers should be clarified first. Limitation of liability as a legal subject of legal entities in the transportation business online application the extent of the responsibility. Under the laws relating to the legal entity must sphere of responsibility of legal entities is regulated and contained in the constitution of the legal entity itself. The scope and responsibilities of legal entities governed the rights and obligations of legal entities in the statutes and households (AD / ART entity). The online system of transportation is honest and does not impede competition there is no dominant position in the online business of transportation in producing and market share as qualification monopolistic practices and unfair business competition. Other online transport entrepreneurs to enter the market is not hampered transport other online who want to enter the transportation market online.
