Abstract

Indonesia has a vision World Maritime Poros. The government's agenda corresponds with the vision include the construction of a maritime culture, maritime resource management, infrastructure development and connectivity maritime, maritime security and defense diplomacy. Marine resources has great potential for the development of the national economy in order to realize Indonesia as the shaft maritime world, however, the setting and its use should be undertaken with caution in order to avoid destruction of the population, habitat and ecosystem. As a developing country, Indonesia must establish closer cooperation with technologically advanced countries to explore the marine resources. In addition, to realize the ideals of Indonesia as the World Maritime shaft must be able to ensure that safety and security in the sea area a top priority.

Abstract

Abstrak         Penelitian tindakan kelas ini bertujuan untuk mengetahui  peningkatan kemampuan mengenal konsep  bilangan yaitu menyebutkan lambang bilangan 1-20, menggunakan lambang bilangan 1-20 untuk menghitung, dan mencocokkan bilangan 1-20 dengan lambang bilangan, melalui media monopoli   modifikasi. Subyek penelitian ini adalah anak usia 5-6 tahun berjumlah 16 anak. Teknik pengumpulan data dan teknik analisis data menggunakan deskriptif kuantitatif. Hasil penelitian siklus I aktivitas guru sebesar 75% dan pada siklus II mengalami peningkatan sebesar 87.5%. Aktivias anak pada siklus I sebesar 59.4%, pada siklus II mengalami peningkatan sebesar 84.4%. Hasil penelitian pada sikuls I menunjukkan  bahwa hasil kemampuan mengenal konsep bilangan anak sebesar 41.5% dan pada siklus II mengalami peningkatan menjadi 81.15%. Berdasarkan hasil penelitian tersebut dapat disimpulkan bahwa kegiatan pembelajaran melalui media monopoli modifikasi dapat meningkatkan kemampuan dalam mengenal konsep bilangan di TK Al Virtue Sidoarjo.         Kata Kunci: Mengenal Konsep Bilangan, monopoli modifikasi Abstrack This classroom action research aims to determine the increase in the ability to know the concept of numbers, says the emblem of numbers 1-20, use symbols to count numbers 1-20, and 1-20 match numbers with the symbol number, through the media monopoly modifications. The subjects of this study is children aged 5-6 years amounted to 16 children. Data collection techniques and data analysis techniques using quantitative descriptive. The results of the first cycle studies teacher activity by 75% and the second cycle increased by 87.5%. Activities of children in the first cycle of 59.4% on the second cycle increased by 84.4%. The results of the study in the first cycle results show that ability to know the number of the concepts of 41.5% and the second cycle increased to 81.15%. Based on these results it can be concluded that the learning activities with monopoly media modifications can improve the ability to recognize the concept of numbers in kindergarten Al Virtue Sidoarjo.  Keyword: to know the concept of number, modification monopoly

Abstract

The purpose of this study was to determine: 1) The role of the Land Deed Official (PPAT) in registration of rights to land conversion of agricultural to non-agricultural to residential in Tegal. 2) The procedure of registration of land rights over the function of agricultural to non-agricultural to residential in Tegal. 3) Obstacles and solutions of conversion rights over agricultural land into non-agricultural to residential in Tegal. This study uses empirical juridical approach or socio-legal research. Data collected through literature, observation and interviews. Based on data analysis concluded that: 1) The role of PPAT in enrollment over the function of rights over agricultural land into non-agricultural to residential houses which provide information on the law relating to the procedure of land conversion and registration of land rights after deters conversion and the making of letters or deeds relating for their particular legal acts such as the breakdown of plot, behind the name, as well as buying and selling land. 2) The procedure of registration of land rights over the function of agricultural to non-agricultural to residential implemented through several stages of the formation of the assessment team, the assessment of land use change object, the trial of the determination, the recommendations and the issuance of a decision on approval of land use changes. 3) Obstacles and solutions in the conversion of agricultural land rights into non-agricultural to residential namely population growth, land agricultural diminishing and changing the status of land use. The solution in the conversion of rights over agricultural land into non-agricultural to residential houses of government is more emphasis on the rules on agricultural land and non-agricultural order later on agricultural land does not decrease faster than society itself should be aware of the importance of agricultural for food security community own.Keywords: Notary / PPAT; Role; Registration; Transfer Function; Land.

Abstract

A Notary is a Public Officer authorized to make an Authentic Agreement which has other powers as regulated in UUJN or under any other Law. Authentic Agreement aims to be used as powerful or perfect evidence if there is any occurrence of a dispute between the parties or there is a lawsuit from the parties. The method used in this study was sociological juridical method with descriptive analytical research specification, while the data analysis method used qualitative analysis. Based on the results of research and discussion, it can be concluded that the legal protection to the Notary in conducting a call by the investigator is conducted through the process in accordance with applicable legislation. Notary's call by the investigator shall be made with the prior approval of the Notary Honorary Council. It is as regulated in Article 66 UUJN. Other forms of legal protection that can be granted to a Notary are by supervision, attaching fingerprints and legal protection provided by the Indonesian Notary Association as the sole organization of Notary in Indonesia. Constraints faced by the Notary in executing summoning by the investigator are, the calling process which requires a long process and must be through the priority of the Notary Honorary Council in advance resulting in less effective time. So the solution is to conduct a more effective investigation by doing a good cooperation between the investigators, Notaries, Notary Honorary Council, and the Indonesian Notary Association.Keywords: Legal Protection; Public Notary; Agreement; Investigator

Abstract

Research on "The Role of Notary and PPAT in Preventing the Occurrence of Function of Selling Authority for Tax Evasion" aims to know what can be done Notary and PPAT in facing the problem of tax evasion often done by society by using power of sale.The results of this study can be concluded, that the first power sales serve as the basis for land transactions and / or building that has the potential to be abused to avoid the obligation to pay taxes. Secondly, every transaction on acquisition of land and / or buildings subject to income tax (VAT) and Customs Acquisition Rights to Land and Buildings (BPHTB), efforts to tax evasion in land transactions, particularly the Income Tax (VAT) and Customs Acquisition Rights to Land and building (BPHTB) by making a Power of Sale before a Notary.The author suggests the need for awareness of the importance of tax is expected with a high public awareness, it will minimize tax evasion, the efforts made by the Government party c.q. National Land Agency should be emphasized related to the certainty the existence of the deed of power sold in the manufacture of Sale and Purchase Agreements relied upon registration of transfer of rights over land because factually legal acts often occur in the community, but normatively has not been set definitively linked the lawfulness of the manufacture of the power to sell in order to avoid circumvention of the Income Tax and BPHTB.Keywords: Tre Role of Notary and PPAT, Sell Counsel, Tax

Abstract

Apabila ada tanah yang tidak digunakan secara efektif (oneffectief gebruik) atau ditelantarkan oleh pemiliknya, maka tanah itu akan dikuasai oleh negara. Tujuan pokok dari UUPA tidak hanya untuk memberikan kepastian hukum dan perlindungan hukum mengenai kepemilikan hak atas tanah bagi rakyat, tetapi UUPA juga mengatur mengenai macam-macam hak atas tanah yang dapat diberikan dan dipunyai oleh perseorangan, baik sendiri maupun bersama-sama dengan orang lain ataupun badan hukum.Terkait pemberian kepastian dan perlindungan hukum bagi pemegang sah hak atas tanah yang sudah mendaftarkan tanah haknya, sebagai tanda bukti hak diterbitkan sertipikat yang merupakan salinan register.Penelitian ini berkaitan dengan Kepastian Hukum Dalam Penyelesaian Sengketa Timbulnya Tumpang Tindih Sertifikat Hak Milik (SHM) Atas Tanah (Studi Kasus Di Kantor Pertanahan/Agraria Dan Tata Ruang Kota Pontianak). Dengan metode penelitan yang menggunakan metode pendekatan yuridis/normatif dan kepustakaan, ditunjang dengan pendekatan sosio-legal.Penelitian ini bertujuan: 1) untuk menemukan dan menganalisa bentuk kepastian hukum bagi pemegang sah hak atas tanah yang sudah memiliki alat bukti (sertifikat), 2) mengungkapkan dan menganalisis bagaimana penyelesaian sengketa  dan 3) mengungkap dan menganalisis bagaimana akibat hukum yang ditimbulkan sengketa tumpang tindih Sertifikat Hak Milik (SHM).Upaya penanganan dan penyelesaian sengketa pertanahan di Kantor Pertanahan Kota Pontianak tidaklah mudah untuk proses penyelesaiannya karena ada kendala-kendala yang dihadapi. Untuk membuktikan sahnya kepemilikan sertifikat Hak Atas Tanah yang telah dikeluarkan oleh Kantor Pertanahan Kota Pontianak, Kantor Pertanahan Kota Pontianak tidak mempunyai kewenangan dalam melakukan uji materil dan meneliti kebenaran dalam sertipikat tersebut. Pihak yang mempunyai kewenangan untuk membuktikannya adalah pihak pengadilan dalam hal ini Hakim berdasarkan proses peradilan.Solusi dari penyelesaian sengketa tanah tersebut diupayakan melalui mediasi atau non litigasi, akan tetapi apabila ada masing-masing pihak bersikukuh pada pendiriannya, maka untuk mendapatkan kepastian hukumannya, wajib dilaksanakan penyelesaian sengketa secara litigasi melalui pengadilan yang sudah mendapat putusan dari pengadilan.Kata kunci : Kepastian hukum, Sengketa tanah

Abstract

Notaris/PPAT adalah pejabat yang diberi kewenangan untuk membuat akta otentik yang dapat dipercaya. Pemisahan harta waris dilaksanakan dalam suatu akta dimuka seorang Notaris yang berupa Surat Keterangan Waris. Pembagian harta warisan bagi ahli waris dapat menjadi hak masing-masing pemegang hak bersama tersebut berdasarkan Akta Pembagian Hak Bersama yang dibuat oleh Pejabat Pembuat Akta Tanah (PPAT). Pewarisan dalam Islam menganal adanya keberadaan yang sama terkait agama pewaris dan ahli waris.Permasalahan dalam penelitian ini: Bagaimana peran Notaris/PPAT dalam pembuatan APHB terhadap pembagian waris beda agama? Apakah kendala-kendala dan solusi terhadap pembuatan APHB terhadap pembagian waris beda agama? Bagaimana akibat hukum jika ada ahli waris yang berbeda agama yang tidak mau hadir menandatangani APHB dihadapan notaris?Tujuan dari Penelitian ini adalah (1) Untuk menganalisis peran Notaris/PPAT terhadap pembuatan APHB pembagian waris beda agama. (2) Untuk menganalisis kendala-kendala dan solusi terhadap pembuatan APHB terhadap pembagian waris; dan (3) Untuk mengetahui akibat hukum jika ada ahli waris yang tidak mau hadir menandatangani APHB di depan Notaris.Penelitian yang penulis lakukan yakni di Provinsi Jawa Tengah yaitu di Kota Semarang. Adapun metode penelitian yang digunakan dalam penelitian ini adalah metode pendekatan studi non doktrinal.Hasil penelitian ini adalah: 1) Peran Notaris/PPAT adalah membuat Akta pernyataan ahli waris yang dibuat dalam bentuk tulisan yang ditandatangani oleh notaris/PPAT sebagai alat pembuktian yang sah. 2) Kendala dalam pembuatan APHB terhadap pembagian waris beda agama atas tanah dan bangunan adalah masyarakat pribumi masih berorientasi pada Hukum Adat yang berlaku umumnya. Solusi Kantor pertanahan lebih banyak melakukan sosialisasi peraturan kepada masyarakat. 3) Akibat hukum jika ada ahli waris yang berbeda agama yang tidak mau hadir menandatangani APHB dihadapan notaris adalah kedudukan akta Notaris dapat dibatalkan demi hukum, dan mempunyai kekuatan pembuktian sebagai akta dibawah tangan.Kata kunci : Peran Notaris/PPAT, Akta Otentik, Pembagian Waris

Abstract

The purpose and this study is to know the Legal Protection for Good-Strong Parties in Cancellation of Sale and Purchase Agreement of Land and Banguan (Study of PN Decision No. 29 / Pdt.6 / 2014 / PN.wsb). This research is empirical law research, that is research based on implementation in effort to get primary data preceded by library research to obtain secondary data. The research was conducted at Notary Office / PPAT, and all data obtained were analyzed quantitatively. Based on the analysis, the authors conclude several things Legal protection against the good-willed (buyer) in the sale and purchase agreement of land and building if the seller cancel the agreement, then for the signature of partial signing by the parties is a must.Judge's Consideration on Legal Protection for Good-Predicted Parties In Cancellation JuaL Purchases Land and Buildings where the Public Prosecutor should be thorough and careful in preparing the indictment, since the indictment is the basis for the judge to impose or not to bring down the defendant faced beforehand the court, in addition, must also have knowledge or knowledge of the law well, not only the law in formal, but also the law materially so as not wrong in determining where the deeds in accordance with the elements that are indicted. As for constraints and solutions Legal Protection Both parties who are intent on canceling Land and Building Sell To know whether the buyer has good intentions or not, then there must be a way of measuring it, that is by finding out the activeness of the buyer, where the buyer is obliged to examine the material facts and the juridical facts of the object of the transaction. If the buyer has been actively researching related to the material facts of the object of the transaction, then he can be considered as a good-faith buyer who gets legal protection, To know whether the buyer is well or not, then there must be a way of measuring it, that is by finding out the liveliness of the buyer where the buyer is obliged to examine the material facts and juridical facts of the object of the transaction. Abstract

       Fiduciary transfer of ownership rights is an object that made the object of a guarantee on the basis of trust with the provisions fiduciary objects remain in the possession of the owner of the object. However, the implementation of Act No. 42 Of 1999 on Fiduciary for this still requires attention, especially for the protection of creditors. Aiming to analyze the legal protection acquired by the creditor against the acts committed by the debtor, namely the transfer of fiduciary security object without the consent of creditors as well as to determine the legal consequences arising method used in analyzing these issues is normative juridical research. The method is a normative legal research done by researching library materials or secondary materials. Through this method is expected to provide a comprehensive understanding of the relevant legal protection for creditors.       Based on the analysis showed fiduciary creditors as the recipient requires legal certainty to the object as collateral because it will hinder the process of execution when security object transferred by the debtor without the consent of the creditor. Article 23 paragraph (2) of the Act Fiduciary that the debtor may assign without the prior written consent of the Receiver fiduciary. So from these provisions can be considered that the debtor has committed an unlawful act that clearly there are provisions in article 36 of Law Fiduciary related penalties obtained by the debtor. Keywords: Legal Protection; Creditor; Fiduciary Transfer.

Abstract

The aims of this research were to looking for and analyzing: 1) Company registration procedure by online sysem, 2) Notary’s role and responsibility in the company registration by online system, if had error inputing data, 3)  the law effect of notary’s role and responsibility if had been error inputing data, from UU ITE sight and 1365 KUHPerdata chapter sight. Data using was primary data, secoundary and tersier as supporting data, and then analized by quantitative-descriptive methode.Based on nalizing result had some conclusion that: 1) Registratin company procedure by online system that in generally beginning from company name order and been follow up with making the companies act as the SABH forms in electronics by notary. If the data input was complete and right also had been agree by Law and human Right Ministery so been had Decission Letter of law entity legalacyby Minister. 2) Role of the notary in company registration with online system was since client ask to registration the company until Decission Letter of law entity legalacyby Minister was out. The notary responsibility if done guilty like error inputing data, no related with UU ITE because no chapter about, but with 1365 BW chapter where doing of error inputing data was harming another person so hane to re the harmed with repairing the data and make act changing. Keywords: Notary, Company Resgistration, Online
