Abstract

Awak sarana perkeretaapian terdiri dari masinis dan asisten masinis yang mengoperasikan sarana kereta api di jalur kereta api. Di Indonesia telah terjadi beberapa kali kecelakaan perkeretaapian. Awak sarana perkeretaapian seringkali disalahkan sebagai penyebab terjadinya kecelakaan tersebut. Tujuan dari penelitian ini untuk menganalisis pertanggungjawaban pidana dari awak sarana perkeretaapian sesuai dengan KUHP, UU Nomor 23 Tahun 2007 dan UU Nomor 11 Tahun 2020 Pasal 56. Sanksi Pidana sesuai pasal 359 dan 360 KUHP dapat dikenakan jika awak sarana perkeretaapian terbukti melakukan kesalahan berupa kealpaan yang menyebabkan orang lain meninggal, luka berat ataupun luka ringan. Namun tetap memperhitungkan adanya praduga tak bersalah sesuai amanat HAM serta Pasal 203 UU Nomor 23 tahun 2007 sebagaimana telah diubah dalam pasal 56 UU nomor 11 tahun 2020 dalam pasal 203. Hakim dalam memberikan putusan harus mempertimbangkan hasil penyelidikan PPNS perkeretaapian, Penyelidikan dan Penyidikan Kepolisian, penyidikan terhadap penyelenggara prasarana perkeretaapian yang digunakan untuk perjalanan kereta api, dan penyelenggara sarana perkeretaapian yang merupakan instansi tempat awak sarana perkeretaapian bekerja. Penyelenggara sarana perkeretaapian wajib untuk memperkerjakan seorang awak sarana perkeretaapian yang kompeten dibuktikan dengan mempunyai sertifikasi kecakapan sebagai awak sarana perkeretaapian. Abstract

Train accidents consist of train-to-train collisions, derailments, rollovers, and fires. Legal protection for train accident victims has an essential role so that the victims' rights are protected. The method used in this research is the Legal Research Method with Juridical Review. Legal protection for train accident victims is contained in the 1945 Constitution, and regulations from the Ministry of Transportation include Law No. 23 of 2007, Government Regulation No. 62 of 2013. There is also a separation of powers between the government and train operators related to their duties and authority in responsibility for train accidents and train accident victims. The results obtained were that apart from the statutory regulations governing railway accidents, there was a need for a unified system between technical operations, human resource capabilities in the railway sector, and public awareness as train users.
