Abstract

This state is basically recognized as a rich state, either in term of ecological side or in term of cultural potency and ideological varieties, as the inheritance of motherland. However, this is so sad when we ironically saw a bunch of tragedies which are tragically occurred, start from tsunami, and other issues such as the scandal of century that seems to be unsolved! Moreover, nowadays, the environmental problem has occurred and reached its highest culmination point. The environmental destruction and pollution process have uncontrollably happened. Noting so many catastrophes happened anywhere in this state; such as floods, landslides, earthquakes, lapindo mud tragedy, roads vanishing, illegal logging, forest function shift, and many others, is so an ironic thing. These all catastrophes become such a sign  of  inharmonic  relationship exist between the state, human and the environment. Then, should we always blame these disaster s for the governments’ fault that, in such this multidimensional crises and demoralization that full of utopia and ironical images, seems to be unaware of their main position? The law is neutered and naked from its constitutional essence. This terrible condition can be impossibly happened when our representatives in the government are loyally take taken a side of the important of their party through the political campaign appointments which seem to face stagnation in its implementation and not loyal to the true mandator. Perceiving this such phenomenon, we need not only a kind of law penetratin that progressifely and integratifally can become an elegant problem solving for achieving of the aims of ongoing developmnet that  can fully protect the importance of the environment and human life intentions but a moral forces and people power that should be continuallly implemented. Hence, the urgency of law management, ecological tutorial awaraness and the success of environmetal living management in term of national law development, becomes a final destination of this writting. Moreover , this writing is a kcorrection of the unclear control and maintenanceof the law of environmental   administration.

Abstract

Pemisahan agama dan kepercayaan dalam konstitusi adalah suatu kebijakan yang menimbulkan beragam permasalahan. Seringkali para penghayat kepercayaan mengalami intimidasi ataupun hal-hal lain yang mengganggu pelaksanaan hak sipilnya untuk menganut dan mengamalkan ajaran kepercayaan yang dianutnya. Dengan dalih kepercayaan bukan agama, para pelaku anarkisme seringkali melakukan pelarangan dan kekerasan terhadap para penganut kepercayaan. Kajian ini menggunakan metode penelitian hukum normatif. Sedangkan hasil penelitiannya ialah bahwa 1) Alasan hukum pemisahan pengaturan antara agama dengan aliran kepercayaan disebabkan oleh politik pembedaan pendefinisian keduanya dimana kepercayaan diamsusikan sebagai tradisi dan ajaran luhur masyarakat yang bersumber dari budaya yang keberadaannya di luar agama. 2) Pemisahan agama dan kepercayaan berakibat hukum tidak diakuinya aliran kepercayaan sebagai agama resmi negara, padahal status aliran kepercayaan merupakan agama lokal yang diyakini sebagai agama oleh para penganutnya. Pemisahan ini juga mengakibatkan hadirnya beragam sikap diskriminatif yang berpotensi mengganggu dan merampas hak setiap warga negara dalam meyakini suatu agama, dalam hal ini hak beragama yang diganggu dan dirampas ialah hak untuk meyakini agama lokal sebagai agama warisan leluhur bangsa Indonesia. The separation of religion and indigenous religion in the constitution is a policy that causes various problems. Often the beliefs of the indigenous religion are intimidating or other things that interfere with the exercise of civil rights to embrace and put into practice the beliefs embraced. Under the pretext of non-religious convictions, the perpetrators of anarchism often make prohibitions and violence against believers. This research uses normative legal methods. The results of the research are: The first, the legal reason for the separation of rules between religion and indigeneous religion is caused by the politics of defining both of them in which beliefs are interpreted as traditions and noble teachings of society originating from cultures which are outside of religion; The second, that the separation of religion and indigenous religion that is caused in the law does not recognize the indigenous religion as the official religion of the state, while the status of the indigenous religion is a local religion that is considered as a religion by his believers. This separation also makes several of discriminatory attitudes come up to have potency in disrupting and robbing every citizen’s right to believe in a religion. In this case, the right which is bullied is the right to believe in local religion as the religion of the Indonesian ancestral heritage.

Abstract

The poor people's difficult access to formal judicature system, in fact, has been a national problem, as indicated with previous studies. Although the largescale change of justice access has been made by government through a variety of policies such as justice program for everyone including poor people and marginalized group in Presidential Instruction Number 3 of 2010, mobile justice system, in fact, has not been able to give the way out. This study was a nondoctrinal/ socio legal research law taken place in Madura area. The objective of research was to formulate A Three-Pillar Synergism Reinforcement Model in Judicial Function Policy at Village Level as one of juridical instrument or legal basic argument for formulating and developing policy at village government. The result of research showed that in Madura area, considering inventorying and identification, the legal problem encountered by poor people in village included trading, inheritance, land, debt-loan disputes, drugs, domestic violence, murder, chicken fighting and different faiths. Law Number 6 of 2014 about Village Government, Article 28 obliges the Village Head to resolves a variety disputes occurring in village, it is also supported by Republic of Indonesia Police Head Regulation (Peraturan Kapolri) Number 7 of 2008 about Basic Guideline of People Policing Strategy and Implementation in Organizing Polri's Duty, and furthermore followed up with Telegram Letter of East Java Local Police Head Number: ST/38/I/2014/ DITBINMAS on January 2014 about the optimization of Pre-emptive activity by empowering the three pillars existing at village (bhabinkamtibmas, babinsa, and village head/lurah as well as society leader). Polri Institution's initiative to empower the community in Kamtibmas (society orderliness and security) field should be appreciated, as it will encourage the creation of justice access at village level cheaply, quickly, and simply. This three pillar legitimacy can be formulated in government policy model at village level with the reinforcement through Village Regulation.

Abstract

This study aims to estimate (the possibility) the inflation convergence among regionals in Indonesia and also analyze the determinant/source factor of the regional inflation. The population of this study consists of 31 provinces by using secondary data of the 2008-2017 period. Consumer Price Index becomes the dependent variable while Gross Regional Domestic Product, Provincial Minimum Wage, credit and Open Unemployment Level become the independent variable. This research uses panel data analysis and Fixed Effect Model regression estimation approach. The result showed that inflation convergence happened among regionals in Indonesia that can be seen through the X1 variable coefficient value of -0.635457 since the value of β < 0. While for the convergence speed calculation, the measurement result showed that the duration needed by the inflation to return to the initial balance or its natural value is 68 months. The study result also showed that Gross Regional Domestic Product, Provincial Minimum Wage, credit and Open Unemployment Level have significant influence on the Indonesia’s regional Inflation in 2008-2017.

Abstract

Pembatasan kegiatan pembelajaran di masa Covid-19 telah menghadirkan ragam permasalahan, baik bagi guru, orang tua, ataupun siswa. Utamanya terhadap tingkat pemahaman peserta didik terhadap materi pembelajaran. Persoalan ini harus segera ditanggulangi mengingat anak adalah aset bangsa yang dituntut memiliki pemahaman keilmuan yang mumpuni sebagai bekal dalam mewujudkan Indonesia tangguh di masa depan. Untuk itu tim pengabdian masyarakat menyusun dan melatih strategi yang bisa dilakukan untuk memudahkan para pihak dalam memenuhi hak-hak anak di masa pandemi ini, dengan cara memaksimalkan massa Muslimat NU sebagai kepanjangan tangan guru di tingkat keluarga, baik dalam pendampingan ataupun pemantauan kegiatan pembelajaran. Selain itu aksi-aksi Muslimat NU dalam menyelenggarakan kegiatan pembelajaran di luar sekolah dengan memanfaatkan entitas kuktural nyatanya mampu menjadi sarana dalam melahirkan generasi tangguh di bidang keilmuan pada masa pandemi Covid-19. Hasil yang diperoleh dalam kegiatan ini ialah adanya peningkatan pemahaman masyarakat, khususnya anggota Muslimat NU dalam memberikan layanan pendidikan kepada anak melalui optimalisasi peran kelompok kemasyarakatan.

Abstract

This study will focus discuss to changes in the authority of the constitutional court in indonesia. That since given authority decide a dispute the outcome of an election both at the central and local the constitutional court as if stuck to the award political reasons and there are several judge involved a corruption scandal decisions dispute the outcome of an election . So the establishment of judicial special election into a the substance of things not cleared by the formation of function constitutional court (M.K) as a squire the constitution where whose main duty is interpret the act. This research uses the method juridical normative by comparing function m.k in some countries and how the application of ideal in Indonesia.

Abstract

The occurrence of several land ownership claims for salt ponds in several areas in Pamekasan initiated the Community Service Team to carry out legal counseling activities related to the importance of certifying ownership rights to salt pond land belonging to salt farmers in Pagagan Village, Pademawu District, Pamekasan Regency for which currently still has the status of girik land. This activity uses the method of presenting material about the urgency and benefits of land certification, as well as providing assistance to the community in the process of land certification. The results obtained in this community service activity are increasing public understanding regarding the importance of salt pond land certification. This activity provides benefits for the community to avoid ownership disputes over salt pond land.
