Abstract

Tujuan dilakukannya penelitian ini adalah untuk mengetahui  bagaimana bentuk-bentuk larangan bagi korporasi untuk mencegah terjadinya pemalsuan uang rupiah dan bagaimana pemberlakuan sanksi pidana terhadap korporasi apabila melakukan pemalsuan mata uang rupiah. Metode penelitian yang digunakan dalam penelitian ini adalah menggunakan metode penelitian yuridis normative dan dapat disimpulkan, bahwa: 1. Bentuk-bentuk larangan bagi korporasi dan orang persorangan untuk mencegah terjadinya pemalsuan uang rupiah selain melarang memalsu rupiah, dilarang menyimpan secara fisik dengan cara apa pun yang diketahuinya merupakan Rupiah Palsu atau mengedarkan dan/atau membelanjakan Rupiah yang diketahuinya merupakan Rupiah Palsu. 2. Sanksi pidana terhadap korporasi dalam pemalsuan mata uang rupiah dijatuhkan terhadap korporasi berupa pidana denda dengan ketentuan ancaman pidana denda maksimum ditambah 1/3 (satu per tiga). Dalam hal terpidana korporasi tidak mampu membayar pidana denda, dalam putusan pengadilan dicantumkan perintah penyitaan harta benda korporasi dan/atau harta benda pengurus korporasi. Abstract

 Abstract: This study aims to examine the legal culture in the practice of online lending (pinjol) services in Indonesia, particularly in ensuring a balance between business interests of service providers and consumer protection. The research question addressed is: how can challenges in legal culture help create a balance between consumer protection and business interests in online lending practices, especially concerning inhumane collection methods and the misuse of personal data by illegal lenders. This research employs a normative legal method with a conceptual and statutory approach. The data used are derived from primary legal sources such as the Indonesian Civil Code (KUH Perdata), the Consumer Protection Act, and Financial Services Authority Regulation No. 77/POJK.01/2016 on Information Technology-Based Lending Services, as well as secondary sources such as scholarly literature. The findings indicate that the weakness of legal culture among society and business actors is a key factor behind widespread violations by illegal online lenders. Collection practices involving intimidation and the unlawful dissemination of personal data not only breach positive law but also violate consumers' rights and inflict psychological distress. The study concludes that strengthening legal culture plays a critical role in reinforcing the effectiveness of existing legal norms. Therefore, firm law enforcement, the elimination of illegal lending services, and improvement in public legal literacy are essential to build a fair, safe, and sustainable digital financial ecosystem.Keywords: P2P Lending, Pinjol, Digital

Abstract

Abstract: This study aims to analyze the position and supervisory mechanism of the supervisory judge over the curator in the management of bankruptcy assets in Indonesia. Based on Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations, the supervisory judge plays a crucial role in ensuring the accountability and integrity of the curator’s actions. However, in practice, such oversight has not been carried out optimally. This research employs a normative juridical approach with a descriptive-qualitative analysis method, using primary legal materials in the form of legislation and court decisions, as well as secondary legal sources from academic literature. The findings reveal that the supervisory judge faces various juridical, technical, and practical obstacles, including ambiguous legal norms, lack of digital infrastructure, and excessive judicial workload. Therefore, regulatory reform, digital integration of reporting systems, and technical capacity-building for supervisory judges are necessary to strengthen the oversight function. With these improvements, Indonesia’s bankruptcy system can operate more transparently, fairly, and efficiently.Keywords: supervisory judge, curator, bankruptcy assets, bankruptcy law, judicial oversight
