Abstract

The main problem in this article is how the implementation of halal product guarantees creates a barrier to entry based on Law Number 33 of 2014 concerning Halal Product Guarantee according to the Dispute Settlement Body Decision number 484. The research method uses a juridical normative approach. Juridical normative research has two sources of law, namely primary and secondary sources of law. Primary sources of law refer to the Dispute Settlement Body Decision Number 484 and Law Number 33 of 2014 concerning Halal Product Guarantee. The secondary source of law refers to the book by Huala Adolf entitled International Trade Law. The results of the study indicate that the Dispute Settlement Body decision has binding power for the Indonesian state because Indonesia is part of the WTO. This decision also gave the impact of creating uncertainty in the law, especially regarding the Halal Product Guarantee. The efforts of the Indonesian state to protect the Halal Product Guarantee by making an appeal to the Dispute Settlement Body, although the results are still not in accordance with what Indonesia wants.

Abstract

Modern financial transactions are increasingly complex and some of them are new things that did not exist in the past. The existing contracts in fiqh are not able to accommodate these transactions so that scholars try to combine several contracts for one transaction. The combination of these contracts gave birth to multiple contracts. By analyzing the opinions of scholars, it is found that the multi-contract law is debated among scholars. The majority of scholars view it as a justified innovation but some other scholars forbid it based on the hadith of the Prophet. This difference in scholars has an impact on the permissibility of using these multi-contracts in modern transaction activities.Keywords: Multi Contract; Law; Usury; Muamalah Fiqh Abstrak: Transaksi keuangan modern semakin kompleks dan sebagiannya merupakan hal baru yang tidak ada di zaman dulu. Akad-akad yang ada dalam fikih tidak mampu mewadahi transaksi tersebut sehingga ulama berupaya melakukan kombinasi beberapa akad untuk satu transaksi. Kombinasi akad tersebut melahirkan multi akad. Dengan menganalisis pendapat ulama ditemukan bahwa hukum multi akad diperdebatkan di kalangan ulama. Mayoritas ulama memandangnya sebagai inovasi yang dibenarkan namun sebagian ulama lainnya mengharamkan berdasarkan hadis Nabi. Perbedaan ulama ini berdampak pada kebolehan penggunaan multi akad tersebut dalam kegiatan transaksi modern.Kata Kunci: multi akad, hukum, riba, fikih muamalah

Abstract

Both directly and indirectly, Sharia banking regulations in Indonesia are heavily influenced by the Fatwa of the National Sharia Council-Indonesian Ulema Council. In its fatwas, the National Sharia Council-Indonesian Ulema Council cites many fiqh principles as one of its legal foundations which shows that fiqh rules occupy a crucial position in the fatwas issued by the National Sharia Council-Indonesian Ulema Council. But unfortunately, research and scientific studies related to fiqh principles are currently still relatively few and receive less attention from academics. Therefore, this study aims to find out how fiqh principles are used in the National Sharia Council-Indonesian Ulema Council fatwas related to sharia banking to fill the void in scientific studies and attract scientific interest in this field. This research is normative legal research/legal research. The data used in this study were obtained from the Sharia Banking Fatwa Association compiled by the National Sharia Council-Indonesian Ulema Council. The data is then analyzed using a qualitative content analysis technique, which analyzes the contents of various texts and then systematically transforms them into a very organized and concise main summary. The results of this study indicate that from 2000 to 2018, the National Sharia Council-Indonesian Ulema Council issued 90 fatwas related to Islamic banking. Of the 90 fatwas, 87 fatwas used fiqh principles as one of their legal foundations. Overall, the fiqh principles used in the National Sharia Council-Indonesian Ulema Council Fatwa regarding Islamic banking total 39 principles with a frequency of use of 266 times. Where the rule "Basically, all forms of muamalah may be carried out unless there is an argument that forbids it" is the rule most often used with a frequency of use of 85 times and Fatwa 118/DSN-MUI/II/2018 concerning Guidelines for Guaranteeing Deposits for Customers of Sharia Banks is a fatwa that the most use of fiqh rules is as many as 11 rules. Then, the generalization of the 39 fiqh principles used in the National Sharia Council-Indonesian Ulema Council Fatwa regarding sharia banking has at least produced several theories, namely the theory of origin law, the theory of maslahat, the customary theory, the Khilafah theory, the wasilah theory, the promise theory, the majority theory, and several another theory. In addition, the National Sharia Council-Indonesian Ulema Council fatwas related to sharia banking has also made a positive contribution to the development of sharia banking in Indonesia. Finally, for future researchers, we provide suggestions in the form of future research related to the principles of fiqh and the National Sharia Council-Indonesian Ulema Council Fatwa.

Abstract

Down payment is commonly practiced in society. Islamic law recognizes the concepts of ‘urbūn and ḥāmish jiddiyyah, which have a similar meaning to a down payment. However, the concepts of customary law and Islamic law are somewhat different. There are differences in ulama’s opinions concerning the permissibility of a down payment. This article aims to analyse the correlation between the concepts of down payment, ‘urbūn, ḥāmish jiddiyyah, and the legal status of a down payment in Islamic law. Using a normative legal approach, this topic is is examined by considering the uṣūl al-fiqh-based views of the classical and contemporary ulama. This study shows that scholarly debate about down payments starts from the ownership status of the money and the impact when the sale and purchase are canceled. Besides, the aspect of its prohibition and benefit are intertwined. Contemporary fatwas allow the practice of down payment with the consideration of modern needs and maṣlaḥah. This finding implies that down payment will become more widespread among the public and the Islamic finance sector. Therefore, A monitoring scheme is needed to avoid the violation of sharia in down payment implementation. Abstrak: Uang panjer lumrah dipraktikkan di masyarakat. Hukum Islam mengenal konsep ‘urbūn dan ḥāmish jiddiyyah yang memiliki kemiripan makna dengan uang panjer. Namun konsep hukum adat dan hukum Islam tersebut tidak seluruhnya sama. Ada perbedaan dan status hukumnya pun berbeda di kalangan ulama. Artikel ini bertujuan menganalisis korelasi konsep uang panjer dan ‘urbūn dan ḥāmish jiddiyyah dan status hukum uang panjer dalam perspektif hukum Islam. Dengan metode pendekatan hukum normatif, tema ini dikaji dengan mempertimbangkan pandangan fikih yang dicetuskan ulama masa lalu dan kontemporer serta mempertimbangkan pertimbang ushul fikih. Hasilnya, perdebatan ulama tentang uang panjer berawal dari status kepemilikan uang tersebut dan dampaknya ketika jual beli batal dilakukan. Di sisi lain, sisi keharaman dan kemaslahatan saling berkelindan. Fatwa kontemporer mengambil pendapat boleh dengan pertimbangan kemaslahatan dan kebutuhan modern. Implikasi dari temuan ini, penggunaan uang panjer akan semakin luas di kalangan masyarakat dan sektor keuangan syariah. Diperlukan skema pengawasan agar praktik uang panjer tersebut tidak melanggar ketentuan syariah.
