Abstract

AbstractThis research is motivated by sanda transactions carried out by the Banjar community which are not free from disputes. This study aims to find out how the types of disputes that occur in sanda transactions are and how the settlement mechanism is. The method used in this research is descriptive method. The results of this study indicate that there are three cases of dispute in the sanda transaction, namely; disputes due to the party "menyandakan" in default, disputes due to the party "menyandai" in default, and disputes among heirs due to unclear status of sanda. The dispute resolution steps taken are through non-litigation channels by negotiating or by presenting village elders as judges. This kind of dispute resolution is in accordance with customary law, Islamic law, and positive Indonesian law. In addition, the dispute on the sanda transaction does not result in the cancellation of the first sale and purchase.AbstrakPenelitian ini dilatarbelakangi oleh transaksi sanda yang dilakukan oleh masyarakat Banjar yang tidak luput dari masalah sengketa. Penelitian ini bertujuan untuk mengetahui bagaimana sebenarnya jenis-jenis sengketa yang terjadi dalam transaksi sanda dan bagaimana mekanisme penyelesaiannya. Metode yang digunakan dalam penelitian ini adalah metode deskriptif. Hasil dari penelitian ini menunjukkan bahwa ada tiga tiga kasus sengketa pada transaksi sanda, yaitu; sengketa karena pihak yang menyandai wanprestasi, sengketa karena pihak yang menyandakan wanprestasi, dan sengketa di kalangan ahliwaris  karena tidak jelasnya status sanda. Adapun langkah penyelesaian sengketa yang diambil adalah melalui jalur non-litigasi dengan melakukan perundingan atau dengan menghadirkan tetuha kampung sebagai pengadil. Penyelesaian sengketa semacam ini sesuai dengan hukum adat, hukum Islam, dan hukum positif Indoensia. Selain itu, sengketa pada transaksi sanda tidak mengakibatkan batalnya jual beli pertama.

Abstract

AbstrakRealitas bahwa Indonesia adalah negara hukum sekaligus negara dengan jumlah penduduk muslim terbesar di dunia, seringkali memunculkan upaya untuk “mengislamkan” hukum di Indonesia yang memicu pertentangan dan perdebatan antara konsep negara Islam dengan negara bangsa. Penelitian ini merupakan penelitian normatif yang bertujuan untuk mengetahui apakah sistem hukum dan bentuk negara Indonesia sudah sesuai dengan konsep negara syariah dari Arskal Salim yang ditulis dalam bukunya yang berjudul Challenging the Secular State: The Islamization of Law in Modern Indonesia. Hasil penelitian ini menunjukkan bahwa sistem hukum di Indonesia tergolong syariah, namun desonansi harus dihindari dengan benar-benar membedakan antara syariah (nizamul ilahiyyat), fiqih (nizamul insaniyyat), serta aspek keadilan dan aspek legitimasi dari suatu peraturan. Konsep politik negara syariah yang terdiri dari ummah (komunitas), khalifah (umara), dan syariah (ulama) telah dipenuhi oleh Indonesia. Di mana di indonesia, antara agama dan negara dipisahkan namun tetap saling berhubungan, di mana Indonesia yang terdiri dari beragam suku dan agama (ummah) dipimpin oleh presiden (khalifah/umara) sebagai pemegang pemerintahan dan MUI/Majelis Ulama Indonesia (ulama)  mengurusi masalah agama.

Abstract

This research was motivated by the revelation of cases of online trading applications which turned out to be gambling and illegal binary options. Worse yet, this case also involved a number of influencers who were alleged to have facilitated these applications by helping to promote and hold various trainings. The type of research chosen in this research is library research using qualitative methods. The data used is secondary data, namely data that is not obtained directly from the source. The results of this study indicate that in the case of binary options in Indonesia there are at least four aspects that are contrary to sharia economic law, namely; (1) the binary option is illegal, (2) contains elements of gambling,  Penelitian ini dilatarbelakangi oleh terungkapnya kasus aplikasi-aplikasi trading online yang ternyata merupakan binary option yang bersifat judi dan ilegal.Lebih parahnya lagi, kasus ini juga melibatkan sejumlah influencer yang diduga telah memfasilitasi aplikasi-aplikasi tersebut dengan membantu melakukan promosi serta mengadakan berbagai pelatihan. Jenis penelitian yang dipilih pada penelitian ini adalah penelitian kepustakaan (library rersearch) dengan menggunakan metode kualitatif. Data yang digunakan adalah data sekunder, yaitu data yang tidak didapat langsung dari sumbernya. Hasil dari penelitian ini menunjukkan bahwa pada kasus binary option di Indonesia setidaknya terdapat empat aspek yang bertentangan dengan hukum ekonomi syariah, yaitu; (1) binary option tersebut ilegal, (2)mengandung unsur perjudian, (3)terdapat banyak penipuandidalamnya, dan (4) dampaknya sangat merugikan.

Abstract

Research aims: This study aims to explore the extent of studies related to Islamic bank spin-offs in reputable journals indexed by Sinta and Scopus to map important findings regarding Islamic bank spin-offs.Design/Methodology/Approach: This study employed a systematic literature review method consisting of three stages: collection, assessment, and presentation. The collection stage was conducted using the Publish or Perish search engine with the Google Scholar and Scopus databases. The assessment stage was performed using the websites https://sinta.kemdikbud.go.id and https://www.scimagojr.com/. The presentation stage was carried out to find three objectives: research background, methods, and findings related to the Islamic bank spin-off.Research findings: Since 2010, at least 24 papers indexed by Sinta and ten papers indexed by Scopus have discussed the issue of the Islamic bank spin-off. These studies were oriented toward two disciplines: law and economics. The most widely used method was quantitative. Broadly speaking, the findings from the spin-off study of Islamic banks can be generalized into four discourses: policy, the market for Islamic banks, performance/efficiency of Islamic banks, and several other matters. Lastly, from the four discourses above, the authors suggest eight future studies that are still interesting to study.Theoretical contribution/Originality: By mapping important findings related to the Islamic bank spin-off along with eight suggested future studies, this research’s results are expected to be a reference and inspiration for scholars in conducting further research related to the Islamic bank spin-off.

Abstract

Both directly and indirectly, Sharia banking regulations in Indonesia are heavily influenced by the Fatwa of the National Sharia Council-Indonesian Ulema Council. In its fatwas, the National Sharia Council-Indonesian Ulema Council cites many fiqh principles as one of its legal foundations which shows that fiqh rules occupy a crucial position in the fatwas issued by the National Sharia Council-Indonesian Ulema Council. But unfortunately, research and scientific studies related to fiqh principles are currently still relatively few and receive less attention from academics. Therefore, this study aims to find out how fiqh principles are used in the National Sharia Council-Indonesian Ulema Council fatwas related to sharia banking to fill the void in scientific studies and attract scientific interest in this field. This research is normative legal research/legal research. The data used in this study were obtained from the Sharia Banking Fatwa Association compiled by the National Sharia Council-Indonesian Ulema Council. The data is then analyzed using a qualitative content analysis technique, which analyzes the contents of various texts and then systematically transforms them into a very organized and concise main summary. The results of this study indicate that from 2000 to 2018, the National Sharia Council-Indonesian Ulema Council issued 90 fatwas related to Islamic banking. Of the 90 fatwas, 87 fatwas used fiqh principles as one of their legal foundations. Overall, the fiqh principles used in the National Sharia Council-Indonesian Ulema Council Fatwa regarding Islamic banking total 39 principles with a frequency of use of 266 times. Where the rule "Basically, all forms of muamalah may be carried out unless there is an argument that forbids it" is the rule most often used with a frequency of use of 85 times and Fatwa 118/DSN-MUI/II/2018 concerning Guidelines for Guaranteeing Deposits for Customers of Sharia Banks is a fatwa that the most use of fiqh rules is as many as 11 rules. Then, the generalization of the 39 fiqh principles used in the National Sharia Council-Indonesian Ulema Council Fatwa regarding sharia banking has at least produced several theories, namely the theory of origin law, the theory of maslahat, the customary theory, the Khilafah theory, the wasilah theory, the promise theory, the majority theory, and several another theory. In addition, the National Sharia Council-Indonesian Ulema Council fatwas related to sharia banking has also made a positive contribution to the development of sharia banking in Indonesia. Finally, for future researchers, we provide suggestions in the form of future research related to the principles of fiqh and the National Sharia Council-Indonesian Ulema Council Fatwa.

Abstract

ABSTRACT This study aims to determine the extent to which the role of Islamic banks in the economy in Indonesia. The method used in this research is a systematic literature review which begins with data collection using the Publish or Perish search engine, the assessment is carried out through the websites https://sinta.kemdikbud.go.id/ and https://garuda.kemdikbud.go .id/, to presentation using content analysis techniques, mapping with Vosviewer, and ending with analysis using Biddle's Role Theory. Based on a systematic literature review conducted on 22 Sinta-indexed national journals for the 2017-2022 period, it was found that Islamic banks have an important role in Indonesia, namely as; driving economic growth, assisting the development of MSMEs, assisting the development of the halal industry, helping to tackle the Covid 19 pandemic, and several other roles. Judging from Biddle's Role Theory; 1) Structurally, Islamic banks in Indonesia have played their role as financial institutions through raising investment funds from third parties and channeling financing, 2) Functionally, Islamic banks in Indonesia function as drivers of national and regional economic growth, providers of capital for MSMEs, providers of financing and supporting facilitators for the halal industry, to help tackle Covid 19 through digitalisation of Islamic banking, services that implement health protocols, assistance in procuring Personal Protective Equipment (PPE), assistance with KUR distribution, providing relief for customers affected by the pandemic, and maximizing CSR programs, 3) Interactionally, the role of Islamic banks in Indonesia has not been very effective due to interaction problems in the form of a lack of socialization, promotion, community literacy, and access to Islamic banks which are relatively difficult to reach.

Abstract

Financial literacy is the most important indicator in financial management. With good financial literacy, people are believed to be able to manage their finances properly. Conversely, without good financial literacy, people will not have enough provisions to make the right financial decisions and end up with various financial problems. The Sharia Financial Education community service activity carried out at the Muhammadiyah Al-Muhajirin Mosque was carried out as an effort to increase financial knowledge in order to improve the financial literacy of the community. This activity consists of a preliminary stage, main stage, and closing stage. The implementation of the Sharia Financial Education community service activity has gone well and has succeeded in improving the financial literacy of the community. This is evidenced by the increase in the test points of the participants after listening to the material provided and through a series of question and answer sessions.
