Abstract

Abstract:The problem examined in this study is related to the Dissenting Opinion of Judges in the Supreme Court's Decision in the Famous Brand Case of Yumi Katsura and PRADA. Problems related to the judges' consideration that stated dissenting opinions in famous trademark cases at the cassation level were seen from the Trademark Law, the Law on Judicial Power and the implications of the dissenting opinion on the famous brand case of Yumi Katsura and PRADA. This study uses qualitative research that is the type of data and analysis that is used is narrative, in the form of statements that use reasoning. The results of the study showed that the judges' consideration that stated dissenting opinion was more correct and correct, in the decision No. 310 K/Pdt. Sus-HKI/2013 based on the Law on Trademarks and facts at the hearing, while in the decision Number 164 K/Pdt . SUS-HKI/2016 besides based on the Trademark Law, also based on the Supreme Court Jurisprudence Number 2279/PK/Pdt/1992 and Number 1596 K/Pdt/1983. Then the implication of the judge's dissenting opinion on the case of a famous brand can provide knowledge about the interpretation of the phrase equality in essence and the interpretation of the criteria of a well-known brand as well as to the verdict handed down while still taking the most votes.Keywords: Dissenting Opinion, Famous Brand, Yumi Katsura and PRADA

Abstract

AbstractIn apartment selling, there are developers who are not open and transparent about the given information on marketing and selling with pre project selling system. There are also unclear informations about agreement between business actor and consumer that written in Sale and Purchase Agreement (PPJB) which given by developer. This case is certainly contrast to Pasal 7 Undang-undang Nomor 8 Tahun 1999 about Consumer Protection. In fact, pre project selling system often places consumers into weak situation and prone to default act by business actors. According to the researcher, the result from judge’s council is fair enough and appropriate according to existing regulation, but Law Number 20 of 2011 concerning Flats still ineffective because it had not implement regulation act of the law.Keywords: Information Disclosure, Sale and Purchase Agreement, Apartment, and Pre Project Selling

Abstract

AbstractThis study aims to examine the indications of violations according to Article 20 of Law Number 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. In this case there are allegations from the online motorcycle taxi company Grab and the Ovo online financing transaction company that is alleged to violate the unfair business competition provisions. There are indications of payment that does not make sense in using ovo when paying a grab rate of one rupiah. This study uses a type of empirical and qualitative juridical research. The results showed that no violations were found because there were no dead companies and Grab and Ovo were not in a dominant position and did not make them dominate the competitive market. Although basically the price of one rupiah is considered below the minimum price and can cause violations.Keywords: Predatory Pricing, Indications, Business Competition

Abstract

Criminal law in a general sense has the same aims and objectives in all systems universally. However, in its application, there are differences in methods and methods apart from being bound by standard rules which are the main basis as the basic norms of a country. The research method used in this study is a qualitative research method with a comparative studies approach. The results of the study state that there are similarities in the objectives of the criminal law system in several countries. However, in Indonesia, the legal system is based on the values of Pancasila and the 1945 Constitution and aspires to justice for all its people. The legal system in Indonesia recognizes the existence of legal pluralism, Islamic law, and customary law. This is not found in the legal system of other countries.Keywords: Legal System; Ratio; Criminal law Abstract:Hukum Pidana dalam pengertian umum memiliki kesamaan maksud dan tujuan pada semua sistem secara universal. Namum dalam aplikasinya, terdapat perbedaan cara dan metode selain terikat pada aturan baku yang menjadi landasan utama sebagai norma dasar suatu negara. Metode penelitian yang digunakan pada penelitian ini adalah metode penelitian kualitatif dengan pendekatan comparative studies. Hasil penelitian menyatakan bahwa ada kesamaan tujuan pada sistem hukum pidana pada beberapa negara. Namun pada negara Indonesia, sistem hukumnya berdasarkan nilai-nilai Pancasila dan UUD 1945 serta mencita-citakan keadilan bagi seluruh rakyatnya. Sistem hukum di Indonesia mengakui adanya pluralisme hukum, hukum Islam, dan hukum adat. Hal inilah yang tidak terdapat pada sistem hukum negara lain.Kata Kunci: Sistem Hukum; Perbandingan; Hukum Pidana

Abstract

The enactment of Law Number 33 of 2014 concerning Halal Product Assurance (JPH) changed the implementation of Halal Certification in Indonesia where halal certification which had been carried out by MUI for 30 years (since 1989) changed to the Halal Product Assurance Organizing Agency (BPJPH) of the Ministry of Religion of the Republic of Indonesia. With this provision, a new era in the administration of Halal Product Guarantee by the government begins. This research uses qualitative research with juridical-normative and comparative approach. The author makes a comparison with Thailand and Malaysia. The results of the study state that the implementation of halal certification in Malaysia is carried out entirely by a state institution called JAKIM, while in Thailand it is carried out by non-governmental organizations (NGOs).Keywords: Halal Product Certification; Non-Governmental Organizations (NGOs); Ratio Sertifikasi Halal Melalui Pemerintah dan Organisasi Non-Pemerintah: Analisis Perbandingan Indonesia, Malaysia, dan Thailand Abstrak:Lahirnya Undang-undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal (JPH) mengubah pelaksanaan Sertifikasi Halal di Indonesia dimana sertifikasi halal yang telah dijalankan MUI selama 30 tahun (sejak 1989) berubah ke Badan Penyelenggara Jaminan Produk Halal (BPJPH) Kementerian Agama RI. Dengan ketentuan ini maka dimulai era baru penyelenggaraan Jaminan Produk Halal oleh pemerintah. Penelitian ini menggunakan penelitian kualitatif dengan pendekatan yuridis-normative dan perbandingan. Penulis melakukan perbandingan dengan negara Thailand dan Malaysia. Hasil penelitian menyatakan bahwa pelaksanaan sertifikasi halal di Malaysia dilakukan sepenuhnya oleh lembaga negara yang bernama JAKIM, sedangkan di Thailand dilakukan oleh lembaga non pemerintah (NGO).Kata Kunci: Sertifikasi Produk Halal; Organisisasi Non Pemerintah (NGO); Perbandingan Халяльная сертификация в государственных и негосударственных организациях: сравнительный анализ Индонезии, Малайзии и Таиланда Аннотация:Принятие Закона № 33 от 2014 г. о Гарантии на халяльный продукт (JPH) изменило внедрение халяльной сертификации в Индонезии, где халяльная сертификация, которая проводилась MUI (Советом Индонезийских Богослов) в течение 30 лет (с 1989 г.), была преобразована в Организационный орган по обеспечению халяльной продукции (BPJPH) Министерства по делам религии Республики Индонезии. С этим положением начинается новая эра в управлении гарантией на халяльный продукт со стороны правительства. В данном исследовании используются качественные исследования с юридически-нормативным и сравнительным подходами. Автор проводит сравнение с Таиландом и Малайзией. Результаты исследования показывают, что внедрение халяльной сертификации в Малайзии полностью осуществляется государственным учреждением под названием JAKIM, а в Таиланде - неправительственными организациями (NGO).Ключевые слова: Сертификация халяльной продукции; Неправительственные организации (NGOs); Соотношение

Abstract

Constitutional law is characterized in a broad sense as the legal laws controlling state structures, the interaction between vertical and horizontal state instruments, and the position of citizens and their human rights. Nevertheless, there are variations in the techniques and methods of applying the state system, in addition to the standard regulations that serve as the state's fundamental standards. This study employed a qualitative research strategy with a comparative study design. According to the findings of the study, the aims of the constitutional law systems of many nations are comparable. In contrast, Indonesia's legal system is founded on Pancasila and the Constitution of 1945 and seeks fairness for all its citizens. In Indonesia, the constitutional legal system recognizes legal plurality, Islamic law, and customary law. This is not found in other countries legal systems.Keywords: Legal System; State Administration; Legal Comparison Abstract:Hukum Tata Negara dalam pengertian umum diartikan sebagai sekumpulan peraturan hukum yang mengatur organisasi dari negara, hubungan antar alat perlengkapan negara dalam garis vertikal dan horizontal, serta kedudukan warga negara dan hak-hak asasinya. Namum dalam aplikasinya, terdapat perbedaan cara dan metode pelaksanaan sistem bernegara, selain terikat pada aturan baku yang menjadi landasan utama sebagai norma dasar suatu negara. Metode penelitian yang digunakan pada penelitian ini adalah metode penelitian kualitatif dengan pendekatan comparative studies. Hasil penelitian menyatakan bahwa ada kesamaan tujuan pada sistem hukum tata negara pada beberapa negara. Namun pada negara Indonesia, sistem hukumnya berdasarkan Pancasila dan UUD 1945 serta mencita-citakan keadilan bagi seluruh rakyatnya. Sistem hukum tata negara di Indonesia mengakui adanya pluralisme hukum, hukum Islam, dan hukum adat.
