Abstract

Dalam artikel ini akan mendeskripsikan bagaimanakah konsep ius ad bellum dan ius ad bello dalam perspektif Hukum Islam dan Hukum Humaniter. Selama ini, ius ad bellum dipahami sebagai alasan yang dibenarkan secara yuridis-konstitusional bagi sebuah negara untuk menggelar perang. Sedangkan ius ad bello diartikan sebagai hukum yang berlaku dalam perang. Sementara dalam literatur fikih klasik, ada sejumlah alasan yang dibenarkan secara yuridis bagi Negara Islam (dar al-Islam) untuk berperang melawan Negara kafir (dar al-kufr), yaitu untuk mempertahankan diri dari serangan luar, bukan dimaknai semangat agresi. Namun dalam era poskolonialisme, alasan-alasan fikih tersebut sudah tak dapat dibenarkan lagi. Yang berlaku justru pengaturan hukum perang melalui Hukum Humaniter. Lalu bagaimanakah titik temu antara keduanya? Metode yang digunakan dalam penulisan ini adalah metode komparatif yang bertujuan untuk membandingkan pandangan hukum Islam klasik dengan pandangan Hukum Humaniter. Teknik pengumpulan data yang digunakan oleh penulis adalah telaah pustaka (library research) yang bersumber dari berbagai literatur seperti buku-buku, kitab dan artikel jurnal. Penelitian sejenis ini belum banyak diteliti, yang pernah meneliti dengan topik yang sejenis antara lain Carsten Stahn (2007), Jasmine Moussa (2008) dan Khaled Abou El-Fadl (2017).Kata Kunci: ius ad bellum, ius ad bello, Hukum Humaniter, Hukum Islam.

Abstract

The act of terrorism involving children certainly raises its own concerns. How not, if the child is faced with a formal justice process then besides he will lose his independence, he will also lose his future because of stigmatization as a terrorist who is attached for life. However, if the model of diversion through restorative justice is adopted, the legal process will be blocked by the provisions of Article 7 paragraph (2) of Law No. 11 of 2012 concerning the Child Criminal Justice System. Then what is the meeting point between the two? How is this diversion approach in the perspective of Maqashid al-Shari'ah? This article tries to describe the diversion model through a restorative justice approach in the perspective of maqashid al-shari'ah. The type of method used in this study is a qualitative method. The data collection technique used is library research sourced from various literatures such as books, books and journal articles. After the data is collected, an analysis will be carried out using descriptive-analytical methods. This study concludes that restorative justice through a diversion model is in line with the principles of maqashid al-syari'ah, this legal approach aims to help children of terrorists realize, feel and restore humanitarian relations that were damaged between the perpetrators and victims. This is due to the fact that the child of the terrorist is not an actor in the real sense, but he is the real victim of the results of his parents' indoctrination or other parties.

Abstract

Along with the increasing use of the internet throughout the world, the number of disputes that have arisen continues to increase. Many web sites have been formed to help resolve this internet dispute, as well as to facilitate settlement of disputes that occur offline so that they are more transparent, accountable and more practical through the Online Dispute Resolution (ODR). Then, what is the actual practice of e- commerce dispute resolution through ODR in the view of Islamic Law? The approach method used in this study is a normative juridical approach and descriptive analytical. The data collection technique used by the author is library research sourced from various literatures such as books, kitab and journal articles. After the data is collected, an analysis will be carried out using the descriptive-analytical method, which is systematically describing the facts or characteristics of the phenomena found in factually and carefully in the field, and carried out qualitatively to get an understanding of the problems studied in more depth. This study concludes that the practice of ODR, which is an extension of ADR practice has a strong historical and legal basis, so the practice of ODR in Islamic law is permitted with the exception of contracts which include elements prohibited by Islamic teachings, such as elements of obscurity (gharar), the object is forbidden, indicated fraud (tadlis), gambling (maysir), and usury.
