Abstract

The inclusion of the ’physically healthy’ requirement in recruiting job vacancies has led to various interpretations. This practice has been going on for a long time and often violates persons with disabilities' rights to obtain equal employment opportunities. This study aims to analyze the interpretation of physical health requirements in the recruitment of job vacancies. Sources of research data are employers, disabled workers, and the Yogyakarta Provincial Government. Researchers analyzed legal norms and qualitative data, then presented descriptively. The study concluded that there had not been one interpretation from the employer, disabled workers, and the government about ‘being physically healthy.’ The term is often interpreted as ‘being physically complete.’ This biased interpretation discriminates against disabled workers entering the workforce.[Keberadaan syarat ‘sehat jasmani’ dalam rekrutmen lowongan kerja menimbulkan berbagai penafsiran, khususnya bagi tenaga kerja difabel. Praktik ini sudah berlangsung lama dan melanggar hak difabel untuk memperoleh kesempatan yang setara dalam lapangan pekerjaan. Penelitian ini bertujuan menganalisis penafsiran syarat sehat jasmani dalam rekrutmen lowongan kerja. Sumber data penelitian adalah pihak pemberi kerja, tenaga kerja difabel, dan Pemerintah Provinsi Yogyakarta. Penelitian dilakukan dengan menganalisis norma hukum dan data kualitatif, kemudian disajikan secara deskriptif. Penelitian menyimpulkan bahwa belum ada kesatuan penafsiran dari pihak pemberi kerja, tenaga kerja difabel, dan pemerintah tentang kriteria sehat jasmani. Syarat sehat jasmani sering diartikan sebagai fisik yang lengkap. Hal mendiskriminasi tenaga kerja difabel dalam memasuki lapangan pekerjaan.]

Abstract

Food is one of the primary needs of humans. In terms of producing food, it cannot be completely separated from the use of Food Additives. Article 1 paragraph (1) of Law Number 33 Year 2012 concerning Food Additives determine Food Additives are ingredients added to food to affect the nature or form of food. This indicates that Food Additives may affect the quality of the product. In practice, not all Food Additives are used by sellers safe for consumers' health. In fact, Article 4 letter a of Law Number 8 of 1999 concerning Consumer Law determines that consumers have the right to conveniences, security and safety in consuming goods and/or services. This is also in line with the seller's obligations that specified in Article 7 of the Consumer Law. A several cases of chlorine additives on mi soun at Klaten, Jember, and Jambi show a lack of awareness of sellers and consumers in recognizing which food additives are harmful for health. Consumer law as a progressive law strives to be a legal means that establish consumer awareness and sellers awareness in order to realize their rights and obligations. Progressive consumer law also indicates a balance between sellers and consumers in harmonizing the principles of caveat venditor and caveat emptor.

Abstract

Abstract: Article 67 of The Law of The Republic of Indonesia Number 41 year 1999 concerning Forestry stated that Affirmation of existence and extinction of indigenous law shall be stipulated in Regional Regulation. Local governments play essential roles in making a Regional Regulation to provide recognition of the traditional rights of indigenous peoples. In fact, political will of the local governments is not powerful enough to provide the protections intended. There are so many indigenous people who become the victims of endless agrarian conflicts, especially regarding customary forests. This paper uses normative approach that focuses on examining the forestry law and the existence of the indigenous people. At the end of this article, there are some alternative ways that local government could apply to handle the conflicts, namely encouraging the local governments to have powerful political will in order to create regulations regarding indigenous people recognition. Government should hasten the process of creating a bill concerning Indigenous People Protections and therefore there will be a legal certainty of the indigenous people in Indonesia. Keywords: Agrarian Conflicts, Indigenous People, Regional Regulation, Political Will Intisari: Pasal 67 Undang-Undang Kehutanan mensyaratkan bahwa instrumen pengukuhan mengenai keberadaan masyarakat adat adalah melalui Peraturan Daerah. Pemerintah daerah memegang peranan penting dalam mengeluarkan kebijakan berupa regulasi daerah untuk memberikan pengakuan terhadap hak-hak tradisional masyarakat adat. Faktanya, political will yang dimiliki oleh pemerintah daerah  belum cukup kuat untuk memberikan perlindungan hukum yang dimaksud. Banyak masyarakat adat yang menjadi korban dari konflik agraria yang tak berkesudahan, khususnya mengenai hutan adat. Tulisan ini merupakan tulisan hukum normatif yang berfokus menelaah regulasi hukum terkait kehutanan dan posisi masyarakat adat sebagai suatu dinamika sosial. Pada akhir bagian tulisan akan diberikan beberapa alternatif yang dapat dilakukan oleh pemerintah dalam menghadapi konflik masyarakat adat, pemerintah, dan perusahaan, yakni mendorong agar pemerintah daerah memiliki strong political will untuk mengeluarkan kebijakan berupa Peraturan Daerah yang mengakui keberadaan masyarakat adat. Pemerintah juga harus segera melakukan pengesahan terhadap Rancangan Undang-Undang Perlindungan Masyarakat Hukum Adat untuk memberikan kepastian hukum bagi masyarakat adat dan hak-hak tradisonalnya. Kata Kunci: Konflik Agraria, Masyarakat Adat, Peraturan Daerah, Political Will.
