Abstract

Penyuluhan narkoba dilakukan agar masyarakat di Desa Tete B Kecamatan Ampana Tete Kabupaten Tojo Una-una bisa memahami betapa mengerikan dan berbahayanya akibat penyalahgunaan narkoba. Metode pelaksanaan dari kegiatan ini di lakukan untuk mewujudkan luaran yaitu metode partisipatif, dimana seluruh kegiatan pelaksana kegiatan ini adalah masyarakat. Adapun pelaksana kegiatan ini meliputi penyuluhan mengenai dampak dari akibat penyalahgunaan narkoba. Program penyuluhan ini mampu menambah pengetahuan tentang bahaya Narkoba terhadap kehidupan masyarakat dalam kalang sosial sehingga masyarakat menyadari bahaya narkoba itu sendiri. Output kegiatan ini, selain menambah pengetahuan masyarakat tentang bahaya narkoba di Desa Tete B Kecamatan Ampana Tete juga memberikan informasi dan solusi yang sangat berharga bahwa narkoba selain berdampak pada pelanggaran hukum juga berdampak pada persoalan medis dan spikis. Kata kunci : Penyuluhan Narkoba, Upaya Preventif

Abstract

Penelitian ini mengkaji pengaturan tindak pidana lingkungan hidup dalam Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup serta sistem pertanggungjawaban pidana dalam tindak pidana perlindungan dan pengelolaan lingkungan hidup. Penelitian ini menggunakan metode penelitian yaitu penelitian hukum normatif. Tindak pidana yang diatur dalam Undang-Undang Nomor 32 Tahun 2009 Tentang Perlindungan dan Pengelolaan Lingkungan Hidup (UUPPLH) pada umumnya terbagi bagi delik materil dan delik formil. Dalam ketentuan Pasal 97 UUPPLH disebutkan bahwa tindak pidana lingkungan adalah merupakan kejahatan (misdrijven) bukan pelanggaran (overtredingen). Unsur kesalahan merupakan jantung dari pertanggungjawaban pidana. Tidak seorang pun yang melakukan tindak pidana, dijatuhi hukuman pidana tanpa kesalahan. Pertanggungjawaban yang pada awalnya selalu dikonsepsikan hanya hanya dapat dijatuhkan pada perorangan, namun dalam tindak pidana lingkungan hidup telah dapat pula dijatuhkan pada korporasi. Pertanggungjawaban pidana lingkungan hidup yang dilakukan korporasi berdasarkan kesalahan (liability based on fault). Kata Kunci : Pertanggungjawaban, Tindak Pidana Lingkungan ABSTRACT This research examines the setting of environmental crime in the Law Number 32 Year 2009 on the protection and management of the environment as well as the system of criminal liability in the criminal act of protection and management of the environment. This research uses research methods i.e. normative legal research. A criminal offence provided for in Act No. 32 of the year 2009 on the protection and management of the environment (UUPPLH) are generally divided for material and formyl delik delik. In the provisions of article 97 UUPPLH mentioned that environmental crime is a crime (misdrijven) rather than offense (overtredingen). The error element is the heart of criminal liability. No one who commits a criminal offence, was sentenced to a criminal without any errors. Abstract

Artikel ini bertujuan untuk menganalisis hak-hak pemegang saham minoritas dan bentuk pengaturan tentang perlindungan hukum terhadap pemegang saham minoritas.  Metode penelitian yang digunakan dalam artikel ini adalah yuridis normatif, dengan metode analisis adalah deskriptif kualitatif. Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas mengatur hak pemegang saham minoritas yaitu hak perseorangan dan hak derivatif. Sedangkan Perlindungan hukum bagi pemegang saham minoritas saat ini sudah diatur dalam Undang-Undang Nomor 40 Tahun 2007 Tentang Perseroan Terbatas. Dimana pemegang saham minoritas dapat memintah Pengadilan untuk menetapkan diadakanya RUPS dan meminta dilakukannya Pemeriksaan atas Perseroan apabila merugikan pemegang saham

Abstract

AbstractThere is an increace of environmental problem every day. This indicates that environmental policies have not yet succeeded. Exploitation of natural resources and environment has caused deterioration of the quality of natural resources, especially in monitoring and development of life mechanism. Aligned with the Regional Autonomy, in terms of authority to manage natural resources and environmental preservation, there is a need to inprove the role of local community in environment protection and management. This role of community can guarantee the dynamics of environment protection and management so that this activity can answer those challenges. Mechanism of community participation needs to be invested in daily life through mechanism of democracy. It is safe to say that one of the strategies to effectively manage environment within the frame of regional autonomy is by involving participation of the community in environment protection and management. Policies from regional autonomy regarding environment have impacted on the growth of resolution concept towards environmental problems that highlights more on the dimensions of local wisdom of each community rather than environmental resolution based on high tech. the regional autonomy can be seen asa astrength of Indonesia to implement decentralization of environmental management as an alternative to resolve environmental problems.  AbstrakPermasalahan lingkungan hidup semakin hari menunjukan peningkatan. Hal ini mengindikasikan bahwa kebijakan lingkungan hidup belum berhasil. Eksploitasi sumberdaya alam dan lingkungan hidup telah menyebabkan semakin buruknya kualitas lingkungan sumberdaya alam, khususnya dalam masalah pengawasan dan pengembangan mekanisme hidup. Sejalan dengan Otonomi Daerah, dalam hal ini pelimpahan wewenang kepada pemerintah daerah di bidang pengelolaan sumber daya alam dan pelestarian lingkungan mengandung maksud untuk meningkatkan peran masyarakat lokal dalam Perlindungan dan pengelolaan lingkungan hidup. Peran serta masyarakat inilah yang dapat menjamin dinamisme dalam Perlindungan dan pengelolaan lingkungan hidup sehingga kegiatan ini mampu menjawab tantangan tersebut. Mekanisme peran serta masyarakat ini perlu termanifestasikan dalam kehidupan sehari-hari melalui mekanisme demokrasi. Sehingga dapat dikatakan bahwa salah satu strategi pengelolaan lingkungan hidup yang efektif di daerah dalam kerangka otonomi daerah adalah dengan melibatkan peran serta masyarakat dalam Perlindungan dan pengelolaan lingkungan hidup. Kebijakan otonomi daerah dalam  Lingkungan Hidup berimbas kepada tumbuhnya konsep penyelesaian masalah lingkungan yang lebih menitikberatkan dimensi kearifan lokal yang dimiliki setiap masyarakat lokal daripada penyelesaian masalah lingkungan berbasiskan teknologi tinggi. Dengan adanya otonomi daerah, merupakan modal bagi Indonesia untuk mengimplementasikan desentralisasi tata kelola lingkungan hidup sebagai upaya alternatif menyelesaikan permasalahan lingkungan.

Abstract

The existence of village secretaries from civil servants is expected to make the village government management more effective, especially in the service to the community. However, as mentioned above, expectations in other perspectives need to be tested in the field. The village perspective as a community unit which is having an original autonomy based on its origin and custom, the presence of village secretaries from civil servant is certainly subjects to the norms of personnel in carrying out their duties and responsibilities. In the northern Banggai in Luwuk district, the village secretaries from civil servants are very helpful and have the ability to administer the public service administration and governance. But in the preparation of the annual work program and the village budgets, every year the village secretary is not optimal in carrying out their duties. The labor relation and the village secretary relationship with other tools in other villages in assisting the village head in order to strengthen the village autonomy and in order to improve the public services and in the development of village has proceeded well.
