Abstract

Abstrak Implikasi putusan mahkamah konstitusi terkait penggunaan KTP dan paspor dalam pemilihan presiden dan wakil presiden dalam kerangka menjamin hak memilih dalam pemilihan umum. Terkait dengan ini maka memunculkan permasalahan terkait implikasinya. Bagaimana implikasi baik secara langsung maupun tidak langsung putusan Mahkamah Konstitusi terkait penggunaan KTP dan Paspor dalam pemilihan umum. Mahkamah Konstitusi sebagai lembaga pelaksana kekuasaan kehakiman yang salah satu kewenangannya adalah menguji Undang-Undang terhadap UUD Negara Republik Indonesia Tahun 1945 dalam rangka mewujudkan negara demokrasi yang berdasarkan hukum sebagaimana termaktub dalam Pasal 1 UUD Negara Republik Indonesia Tahun 1945. Hasilnya adalah implikasi langsung yang terdiri dari penerapan KTP dan Paspor sebagai ganti DPT, Memunculkan putusan yang bersifat self executing, mengesampingkan Peraturan Pemerintah Pengganti Undang-undang, mengesampingkan keputusan dan peraturan KPU terkait aturan baru akibat putusan MK dan Implikasi tidak langsung yang terdiri dari Mengurangi terjadinya perselisihan hasil Pemilihan Umum Presiden, KPU bekerja ekstra. Tujuan ke depan penelitian ini adalah untuk mengetahui dan memberikan sumbangsih dalam dunia akademik terutama terkait tentang penjaminan hak asasi manusia terutama hak memilih dalam pemilihan presiden dan wakil presiden. Penelitian ini menggunakan metode kajian peraturan perundang-undangan yang sesuai dengan metode ilmu hukum. Kata Kunci: Putusan Mahkamah Konstitusi, Pemilu, Kartu Tanda Penduduk Abstract The implications of the constitutional court's decision regarding the use of resident identity cards and passports in the election of president and vice president in the framework of guaranteeing the right to vote in general elections. Related to this, problems arise regarding their implications. What are the implications of either directly or indirectly the decision of the Constitutional Court regarding the use of Identity Cards and Passports in general elections. The Constitutional Court as the executing agency of judicial power whose authority is to examine the Law against the State Constitution of the Republic of Indonesia of 1945 in order to realize a democratic state based on law as stipulated in Article 1 of the Constitution of the Republic of Indonesia of 1945. The result is implications directly consisting of the application of Identity Cards and Passports in lieu of the Permanent Voters List, Raising decisions that are self-executing, overriding Government Regulations Substituting the Law, overriding the decisions and regulations of the General Election Commission regarding new rules due to the Constitutional Court ruling and indirect implications consisting of Reducing the disputes over the results of the Presidential General Election, the Election Commission works extra. The future goal of this research is to know and contribute in the academic world, especially related to guaranteeing human rights, especially the right to vote in the presidential and vice presidential elections. Abstract

This study examines the juridical implications related to the free retribution of public toilets at gas stations in the city of Yogyakarta based on the Circular Letter of the Minister of SOEs Number SE-16/MBUT11/2021 concerning Quality Improvement of Public Facilities and SOE Social Facilities. The retribution made by several gas stations has become a separate polemic among the public, especially since the Minister of SOEs conducted inspections at several gas stations, so that not long after, a Ministerial Circular Letter appeared regarding the quality of service for public facilities and social facilities in SOEs. The impact of the Circular is also on the City of Yogyakarta which has 16 gas stations in collaboration with SOEs. So that raises the formulation of the problem what are the implications of the Circular Letter of the Minister of SOEs SE-16/MBUT11/2021 regarding Quality Improvement of Public Facilities and Social Facilities of SOEs and what are the legal implications of free retribution for toilets based on the Circular of the Minister of SOEs Number SE-16/MBUT11/2021 and the constraints faced in the implementation of the Circular of the Minister of SOEs Number SE-16/MBUT11/2021. The purpose of this study was to determine the juridical implications of the application of free retribution toilets at gas stations in Yogyakarta City and can be used as material for evaluating the implementation of the SOE Ministerial Circular.

Abstract

The Indonesian state has a firm and constitutional obligation to advance national culture as mandated in Article 32, paragraph (1) of the 1945 Constitution. This article guarantees the freedom of the community to preserve and develop cultural values. Indonesian culture, reflecting the noble values of the nation, must be embraced by all citizens to strengthen national identity, enhance dignity, and reinforce unity to achieve the nation's future goals. The preamble of the 1945 Constitution of the Republic of Indonesia outlines the national goals of protecting all Indonesians and their homeland, promoting general welfare, educating the nation's life, and participating in maintaining world order based on freedom, eternal peace, and social justice. The diversity of ethnic groups, customs, languages, local knowledge and technology, traditions, local wisdom, and arts are valuable cultural heritages that shape the nation's identity amid global development. According to various articles in the 1945 Constitution of the Republic of Indonesia, the country possesses extraordinary artistic and cultural wealth that must be protected. Local governments, as the forefront of governance, have an obligation to preserve culture to strengthen the nation's identity. Purworejo Regency, with its rich local traditions, has the responsibility to preserve regional cultural expressions through protection, development, utilization, coaching, and cultural supervision. Copyright protection of traditional art works is considered an economic asset and a national identity. The Purworejo Regional House of Representatives (DPRD) has taken the initiative to draft regional regulations to protect and preserve traditional cultural expressions, demonstrating the local government's commitment to safeguarding cultural heritage and promoting the development of local cultural wealth for the welfare of the community and regional advancement.

Abstract

Indonesian culture, reflecting the nation's noble values, must be embraced by all citizens to strengthen national identity, enhance dignity, and reinforce unity to achieve the nation's future aspirations. Historical objects, structures, and buildings are crucial to preserve to provide an understanding of current social and physical realities. In Paser Regency, rapid development has negatively impacted efforts to protect and preserve historical traditions and culture. Cultural heritage, such as Cultural Heritage Objects, Cultural Heritage Buildings, and others, have not been officially recognized as cultural heritage by the local government. The management of valuable historical traces has not been comprehensive, with current management more oriented towards tourism and religious activities. An academic draft of a Regional Regulation on the Protection, Preservation, and Management of Cultural Heritage is needed to optimize the management and preservation of cultural heritage in Paser Regency. This would enable the community to better understand history and support overall community empowerment.
