Abstract

Financing system used in gold pawn transactions in Indonesia are conventional and shar’i. Conventional system is employed only by pawnshops owned by the government, namely “Pegadaian”. Meanwhile,the sharia system is employed by sharia private banks, sharia business units, and sharia pawnshops. Gold mortgage finance at pawnshops is calculated based on the loan amount multiplied by interest multiplied the number of days. Meanwhile, gold mortgage finance at sharia pawnshops and sharia banks as well as Islamic business is calculated based on the estimated value (collateral/gold) multiplied by the interest multiplied by the number of days. The results obtained for the amount of financing (loans) is the same, but smaller nominal interest is obtained when it calculated using the Islamic system. However, the numberof shariadebtors is still very small compared to the conventional debtors.

Abstract

The development of syariah banks in Manado city as the capital of North Sulawesi province which has a large number of non-moslem population is quite fast. The bank has many non-moslem customers, even one of the subsidiaries has more non-moslem customers than Moslem customers. This present study aims to describe the perception of non-moslem customers towards bank syariah in Manado city. This research uses a case study approach which is part of qualitative research. Data collection was carried out by participant observation, interviews and documentation. After the analysis was conducted, the result of the study revealed the perception of non-moslem customers toward bank syariah in Manado city was dominated consecutively by the affective (emotional), cognitive (perceptual) and conative (action) components.

Abstract

Tetetana tourist attraction is one of the destinations for tourists who want to enjoy the natural scenery with a cool and comfortable climate. This object is located in Tomohon city, precisely in the vilĺage of Suluan. Although there are many tourist attractions that offer natural views and coolness in Tomohon City, the Tetetana tourist attraction remains a favourite destination for tourists. It is proven that there are so many tourist visits to this place, especially during holidays. This research was carried out using a quantirative descriptive method. Tourists' perception of this attraction was based on attractions consisting of the beauty of the Tetetana tourist attraction ,followed by friendliness. Tourists'perception of the Tetetana Tomohon tourist attraction based on accessibility( transportation) to the site shows that transportation to the location is very easily dominated. Tourists' perception based on amenities( facilities) are in the first place toilets, followed by gazebos and then parking lots. Meanwhile, the factors that encourage the tourists to visit the Tetetana Tomohon tourist attraction are the natural beauty, accompanying family and friends , followed by relaxation and rest and finally, see something different

Abstract

The imposition of guarantees carried out by Islamic banks in the practice of mudharabah financing in Indonesia is still a discussion and polemic that has been discussed until now because in sharia implementation the practice of mudharabah financing does not require guarantees, but now Islamic banks apply guarantees in mudharabah financing. In this study using normative juridical research, with an approach to legislation and fatwas from the Indonesian Ulema Council, the purpose of this research is to be able to find solutions to problems regarding the application of guarantees in miudharabah financing in Islamic banks. The results of this study found that the purpose of enactment of guarantees in Islamic banks according to the fatwa is to be able to suppress mudharib to explain their obligations to shaibul maal correctly, also to apply guarantees on the basis of the precautionary principle in Islamic banks in order to minimize risk in the financing, but this is contrary to with sharia principles because mudharaba was born on the basis of profit-sharing cooperation, not debts as in conventional banks. The imposition of guarantees on Islamic banks seems to give the impression of mixing the rules and principles of Islamic banks with conventional banks, this occurs due to the absence of a clear legal basis regarding the imposition of guarantees on mudharabah financing in Islamic banks.
