Abstract

Criminal sanctions against perpetrators of corruption crimes require extraordinary breakthrough according to the penal objectives, which is not only to provide a deterrent effect for the perpetrators, but also to provide benefits to the community by optimizing the competencies held by the perpetrators, since perpetrators of corruption are competent either in the aspects of social, economics and politics. The current criminal sanctions do not lead to the utilization of the potential possessed by the perpetrators of criminal acts. The focus still leads to deter the perpetrators only by providing severe criminal sanctions, namely by accumulating criminal sanctions in prison and fines, as well as other additional sanctions that focus on perpetrators, not on to interests of the state and society. The result of the research is to conceive the concept of social work sanctions that utilize the competence/expertise of the perpetrators to be able to provide great benefits to the community directly which implementation is based on the values ​​contained in Sundanese customary law, so that the objectives of the punishment are not only to correct the conduct of the perpetrators, but also to restore state financial losses, and to provide great benefits for the community. Abstract

A number of criminal laws in Indonesia impose capital punishment including the KUHP. Death penalty has raised pros and cons in its imposement while countries around the world has abolished the penalty. Indonesia, however, seems to keep this provision applies as seen in the articles of the RUU KUHP that imposes capital punishment even though it is slightly different in nature from what is in KUHP. This writing aimed to learn about the existence of the capital punishment through its development from it is in the KUHP and in RUU KUHP. The findings of this research showed that death penalty regulated in the KUHP is punishment for major crimes while in RUU KUHP it is specified for crimes with alternative enforcement. The capital punishment, therefore will remain imposed by Indonesian authority even though the future application will be different. Keywords : KUHP, Death Penalty, RUU KUHP.

Abstract

Optimizing social work crime for convicted corruption is interpreted as an effort to provide positive value to the community in addition to reducing the burden on the state, both the burden of costs incurred by the state in fostering convicts and the burden of coaching, because the convicted person has more specific competencies both in the scientific field, authority as well as in other fields compared to the competency of the guiding apparatus without intending to play down the capabilities of the coaching apparatus, besides the security burden that must be carried out by the state, because given the provision of criminal work, the obligation to carry out criminal offenses is transferred to convicts not to the state , and the benefits felt not only for the country but also for the people ,because the competency of the perpetrators can be useful, and it becomes a legal effort in actualizing local wisdom, because the sanctions applied are more concentrated on the needs of the community and community-based coaching, and prison is no longer the only coaching institution for perpetrators of corruption, so It is expected that the recommendations for the renewal of the Criminal Code and the Corruption Law can achieve the goal of punishment, namely providing deterrence for perpetrators and also providing positive benefits for the community while reducing the burden on the state.

Abstract

A mixed marriage is a marriage between two people from different countries or cultures. This can give rise to various legal issues, especially related to the status of children born from the marriage. Mixed marriages have become increasingly common in this era of globalization. However, when couples with different nationalities This article examines various legal issues that often arise from mixed marriages, especially related to the status of children born from the marriage, both related to family law, civil law, and children's rights. This article aims to contribute to understanding the legal complexities that arise from mixed marriages such as the legal aspects of mixed marriages, the rights and obligations of mixed marriage couples, the implementation of the legal aspects of mixed marriages in Indonesia, and the challenges and solutions in the implementation of the legal aspects of mixed marriages and provide insights that can be used to formulate improvements in legal policies and protection of children's rights at the national and international levels. In compiling the article, the researcher chose to use a normative legal approach method, by searching for regulations and literature related to issues regarding the status of children in mixed marriages. The results or findings of this article are that there are rights and obligations of mixed marriage couples, for example, they have the right to obtain citizenship from their husband/wife and must ensure that their marriage complies with the provisions of Indonesian marriage law.
