Abstract

Pancasila is the state fundamental norm that is not formed by a higher norm. The highest expectation of justice seekers is fair verdict. The criticisms addressed to the judges persist due to gap between the judge's verdict and the values of justice the public hoped for. Viewed from the philosophical perspective, the first principle is vertical dimension (hablumminallah) while the second one is horizontal dimension (hablumminnas). This paper examines transcendental value in judge's decision. This research uses qualitative approach method through inductive conceptualization approach. The research intended to investigate the judges' rulings subsequently opposed to the juridical, sociological and philosophical transcendental values found its relevance to the rechtidee of the Indonesian nation. The results show that in practice, there is a tendency that judges' rulings emphasize on procedural justice rather than substantial justice. Whereas, if we comprehend the State Policy and the constitution, the judges verdicts ideally cannot be separated from its base namely transcendental values.Keywords: Judge's Verdict, Pancasila, Transcendental Value

Abstract

Diversion is the transfer of the settlement of a Children's case from the criminal justice process to the process outside of criminal justice. The provision of diversion in the Law on the Juvenile Justice System, can only be applied to criminal offenses under sentence of imprisonment under 7 (seven) years in prison. The diversion model, based on the Juvenile Justice System Law, does not protect children if there are cases of sexual violence with child offenders and child victims. Based on research, the police with discretionary authority can apply the Indev Model. If applying the Indev Model, the parties forget the legal framework, and assume that a case is an interpersonal conflict, not a legal conflict. So that efforts to protect child offenders and victims of sexual violence can be realized through the Indev Model.

Abstract

Public opinion of the poor quality of the judge’s decision is caused by many factors, one of which is not integrated with the judge’s riling basis of spiritual values as stated in the first principle of Pancasila as the state is about the value of Almighty God. Even within each head judge’s decision is always listed irah-irah decision reads “for the sake of justice based on God” which if interpreted contained values are very deep spirituality, which should be the basis of any decision of the judge.

Abstract

Tourism plays a key role in boosting economic growth, improving prosperity and reducing poverty. Pekalongan city has great opportunities for religious tourism i.e. sightseeing at the Tomb of Ahmad bin Abdullah bin Tolib al-Arasas. • Religious tourism at the tombs of al-Arathas, ie religious tourism has great opportunities. Religious travel is a journey aimed at gaining pleasure, satisfaction and knowledge. Religious tourism can lead to mosques, great figures, historical figures, or tombs of figures. The purpose of this study was to analyze strategies for developing religious tourism potential and the impact of religious tourism on improving the economy of communities. The research method is a qualitative analysis using the SOAR analysis method, that is, an analysis that identifies internal and external factors. In this case, the author analyzes strategies for developing religious tourism potential. Based on the research results, the first conclusion is that four alternative strategies, namely SA strategy (strengths and aspirations), OA strategy (opportunities and aspirations), SR strategy (strengths and consequences), and OR (opportunities) strategy. Second, the existence of religious tourism is evidenced by an increase in UMKM and a decrease in unemployment, as well as the opening of new jobs.  Keywords: Strategy, religious tourism, economy
