Abstract

This article is questioning the problems of formulating criminal sanction in administrative act to solve legal problems in economic activities. This discussion is important, particularly with respect to the heterogeneity of regulations in economic activities. This research argues that this heterogeneity creates legal uncertainty which in turn broader discretion in resolving legal problems in economic activities. This paper will identify the criteria of the offense, which should have criminal sanctions and/or administration in practice law by conducting a review of development of the offenses and sanctions that will influence criminal law in the future.

Abstract

The enactment of Law Number 20 of 1946 has added pidana tutupan in the list of criminal sanction in Article 10 a of Penal Code. This article provides new sanction to sentence the criminal who has done the actions driven by honorable purpose with pidana tutupan. It is historically written that pidana tutupan has been sentenced once by Military Supreme Court in Yogyakarta on 1948. This study uses normative legal research methods conducted to find solutions to existing legal problems. However, pidana tutupan has never been applied anymore in Indonesia, neither by general courts or the military courts. The absence of parameter to identify the honorable purpose has obscured its objectivity as a crime punishment. Nevertheless, the drafter of the New Penal Code argues that the existence of pidana tutupan is needed in Indonesian criminal law. The results of this study are trying to figure out the definition of honorable purpose in the Law Number 20 of 1946 about Tutupan Punishment and in the new draft of Indonesian Penal Code through analyzing court decision, historical records, and interview to related parties as to complement other data. In addition, this thesis also compared the concept of pidana tutupan with similar punishments in Germany and Japan.

Abstract

This article discusses the imposition of fines for environmental crimes cases in Indonesia. Due to the absence of law, there are explanations gaps concerning indicators that can be considered when imposing fines on environmental crimes. This study discusses three research questions using the desk research: First, how has Indonesia regulated the application of fines for environmental crimes in Indonesia; Second, what are the indicators to be considered to determine proportional fines as sentencing for environmental crimes in Indonesia; and Third, how has Indonesia applied fines as sentencing for environmental crimes within Indonesian courts. In answering these questions, the study conducts a comparative analysis between the practices of the UK and Singapore regarding environmental crimes. The results of this study indicate that sentencing was ultimately imposed by fulfilling the elements required in the article, added with aggravating and mitigating factors associated with the facts in the trial. In addition, the judgment did not provide further explanation as to how the fine was determined. Therefore, this creates urgency for the Supreme Court to formulate a particular sentencing guideline for handling environmental crimes. The guideline must include provisions on what indicators and stages need to be considered by judges while imposing fine in factual cases. Abstrak: Artikel ini membahas tentang penjatuhan pidana denda dalam kasus tindak pidana lingkungan hidup di Indonesia, mengingat undang-undang tidak memberikan penjelasan lebih lanjut mengenai indikator yang dapat dipertimbangkan oleh hakim manakala menjatuhkan pidana denda dalam tindak pidana lingkungan hidup. Dengan menggunakan metode penelitian normatif, penelitian ini membahas permasalahan yang dituangkan dalama tiga pertanyaan penelitian: Pertama, bagaimana pengaturan mengenai sanksi pidana denda dalam tindak pidana lingkungan hidup di Indonesia; Kedua, apa saja indikator yang dapat dipertimbangkan untuk menentukan penjatuhan pidana denda yang proporsional dalam pemidanaan atas tindak pidana lingkungan hidup di Indonesia; dan Ketiga, bagaimana penerapan penjatuhan sanksi pidana denda tindak pidana lingkungan hidup dalam praktik peradilan di Indonesia. Penelitian ini turut membandingkan ketentuan, pedoman pemidanaan, dan penerapannya di Inggris dan Singapura terkait tindak pidana lingkungan hidup. Temuan penelitian ini menunjukkan bahwa pemidanaan dalam kasus pada akhirnya dijatuhkan dengan pemenuhan unsur-unsur pasal semata, ditambah dengan faktor memberatkan dan meringankan yang dikaitkan dengan fakta dalam persidangan. Putusan Hakim juga tidak mencantumkan penjelasan lebih lanjut tentang bagaimana besaran pidana denda itu ditentukan. Karenanya, terdapat suatu urgensi bagi Mahkamah Agung untuk menyusun suatu pedoman pemidanaan khusus untuk penanganan tindak pidana lingkungan hidup. Pedoman pemidanaan ini mencakup ketentuan tentang indikator apa saja yang perlu dipertimbangkan oleh hakim dalam menjatuhkan pidana beserta tahapan yang perlu dilalui dalam hal pemidanaan. Abstract

Criminalization in Indonesia has changed its philosophy from "prison" to "correctional." Unfortunately, in practice, correctional system in correctional institution still cannot be called rehabilitative because of problems such as overstaying of the inmates, high recidivism rates, overcrowded, riots in prisons and detention house, frequent prison escapes, narcotics transactions in prisons, to illegal levies. To overcome this, the Ministry of Law and Human Rights then came up with the idea of "Revitalization of the Correctional System" through the Ministry of Law and Human Rights Regulation Number 35 of 2018. The revitalization prioritizes changes in the behavior of inmates and turns overcrowding into the opportunity to create superior human resources through four stages: super-maximum security, maximum security, medium security, and minimum security. To develop the Correctional System in Indonesia, this research also used comparative studies with other countries in the penitentiary institution. The research concluded that the revitalization of the correctional facilities had not caused significant changes because there are several obstacles, so structural and systemic changes are needed to help the success of this revitalization. Abstrak: Paradigma pemenjaraan di Indonesia telah berubah menjadi pemasyarakatan, tetapi dalam praktiknya, ternyata tidak banyak yang berubah. Pemasyarakatan masih belum dapat disebut rehabilitatif karena masih banyak permasalahan seperti overstaying, tingkat residivisme yang tinggi, overcrowded, kerusuhan yang seringkali terjadi di Lapas dan Rutan, sering kaburnya warga binaan, maraknya peredaran narkotika di dalam Lapas dan Rutan, hingga terjadi pungutan liar. Untuk mengatasinya, Kementerian Hukum dan HAM kemudian memunculkan suatu ide “Revitalisasi Penyelenggaraan Pemasyarakatan” melalui Peraturan Menteri Hukum dan HAM Nomor 35 Tahun 2018. Revitalisasi pemasyarakatan mengutamakan perubahan perilaku warga binaan dan mengubah tantangan overcrowded Lapas dan Rutan menjadi peluang untuk menciptakan SDM yang unggul melalui empat tahapan pembinaan, yaitu super maximum security, maximum security, medium security, dan minimum security berdasarkan tingkat risiko yang dimiliki oleh warga binaan. Penelitian ini bersifat normatif dengan mengutamakan studi kepustakaan, didukung oleh wawancara dan observasi yang penulis lakukan di berbagai UPT Pemasyarakatan untuk mengonfirmasi data yang penulis temukan dari studi dokumen. Untuk menemukan solusi atas permasalahan pemasyarakatan, diadakan pula perbandingan dengan negara-negara yang sukses di bidang pemasyarakatan. Berdasarkan hasil penelitian, dapat disimpulkan bahwa revitalisasi pemasyarakatan belum menimbulkan perubahan yang cukup berarti karena terdapat beberapa hambatan, sehingga diperlukan perubahan dari segi struktural dan sistemik untuk membantu menyukseskan revitalisasi ini. Abstract

The borderlines between core criminal law and administrative law developed in such a way that it became increasingly difficult to draw a clear and a firm category while dividing line between those. The category of a measure as administrative or criminal is far from being theoretical as it preconditions the applicable legal regime and especially the level of procedural safeguards benefiting to those sanctioned. This paper is questioning the gray area belonging to something in between criminal and administrative law and discussing the rule and the role of criminal law and administrative law in action when the later comprehend punitive administrative sanctions. Several circumstances need to be considered in order to determine the appropriate sanction to fill the gap. This article also suggests the use of “una via principle” as an approach to unpack the gray area in the role of criminal and administrative law, specifically in tax law case.

Abstract

Human Trafficiking is considered as a crime against humanity. To conduct the due process of law towards cases related with human trafficking, the law enforcement officers cannot work by themselves. They really need assistance from many parties – such as active report from the society – as a valuable information to disclose such cases. Law enforcement conducted towards woman and child trafficking is still ineffective. It is proven by many existing cases, that low number of processed cases before the court and minimum sanction convicted to the perpetrators is clearly evident. Factors which are deemed to have correlation with low attempt of law enforcement towards legal case on this case, among others are: Lack of the Government’s commitment to fight against the crime of human trafficking, in the event that the ineffectiveness in utilization of prevailing laws and regulation; Lack of capacity of professionalism of law enforcement agency (and relevant parties) in handling women and child trafficking at the field. This may be caused by lack of knowledge on infringed regulation. For that matter, those law enforcement agency shall be given socialization and an SOP (standardized operational procedure), so that there will be no inconsistency in handling the existing cases.

Abstract

The use of marijuana in medication has been criminalized in Indonesia since 1997. Twenty years after, Fidelis Arie Sudewarto violated the rule by administering marijuana as an alternative means of medication for his spouse, Yeni Riawati. Various public opinions emerged, indicating a shift of paradigm on the use of marijuana for medication, and this affects the fulfillment of "unlawful nature" which is expressly stated as one of the elements in the formulation of offense as stipulated in Article 116 paragraph (2) Law Number 35 of 2009, especially in assessing the material unlawfulness nature (materieele wederrechtelijkheid) of the act. This study discusses the case of Fidelis from the perspective of criminal law, namely how the fulfillment of the element of unlawful nature and whether there is a basis which then abolish the unlawful nature in the acts committed by Fidelis Arie Sudewarto.

Abstract

An election is a democratic process, which is both costly and cumbersome for anyone who wishes to participate. Existing practices, precisely in Indonesia, show that both political parties as well as candidates often need to raise funds to finance their campaign and/or their programs, as well as to ensure the sustainability of their political parties. The Indonesian law states various financial resources in which a political party can raise. Nevertheless, it does not set the limitations and restrictions, particularly on ways to identify and monitor where funds come from. Hence, there has been a fear that political parties may use this loophole to conduct money laundering. It is argued that while the money laundry regime can be used to prevent conspicuous practices related to political financing, a legal framework has yet to be designed and implemented.

Abstract

The rise of narcotics smuggling crimes is a challenge for the Indonesian nation to deal with crimes that are transnational in nature and are extraordinary crimes. Law enforcement against the eradication of nakotika crimes so far has not been effective and has not caused a deterrent effect for perpetrators even though the death penalty has been formulated as an ultimum remedium in criminal law. This study aims to the extent of the effectiveness of law enforcement against narcotics crimes in Indonesia. The methods used in this study are normative research methods and qualitative data analysis. The result of the study is the need for situational law enforcement efforts in dealing with the criminal act of narcotics smuggling to strengthen every component of law enforcement both from the legal component, law enforcement officials, facilities and facilities, society, and culture.Keywords: Law Enforcement; Smuggling; Narcotic. AbstrakMaraknya tindak pidana penyelundupan narkotika menjadi tantangan bagi bangsa Indonesia untuk menangani kejahatan yang bersifat transnasional dan merupakan kejahatan luar biasa. Penegakan hukum terhadap pemberantasan tindak pidana narkotika selama ini ternyata masih belum efektif dan tidak menimbulkan efek jera bagi para pelaku sekalipun telah dirumuskan pidana mati sebagai ultimum remedium dalam hukum pidana. Penelitian ini bertujuan untuk sejauh mana efektivitas penegakan hukum terhadap tindak pidana narkotika di Indonesia. Metode yang digunakan dalam penelitian ini ialah metode penelitian normatif dan analisis data secara kualitatif. Hasil dari penelitian ialah diperlukannya upaya penegakan hukum situasional dalam menangani tindak pidana penyelundupan narkotika untuk memperkuat setiap komponen penegakan hukum baik dari komponen hukum, aparat penegak hukum, sarana dan fasilitas, masyarakat dan budaya.Kata Kunci: Penegakan Hukum; Penyelundupan; Narkotika.

Abstract

Sexual assault against children is an phenomenon that often occurs in Indonesia. The statistic shows that the number of sexual assault against children doesn't decrease significantly. Punishment is not the only way to control the number of sexual assault against children. Then, the goverment passed new regulation that regulating of chemical castration in hope of reducing the number of sexual crimes against children. However, the presence of chemical castration raises objections and differences of opinion in various circles. This research aims to determine the sentencing purpose of chemical castration and the proper sanction for imposing chemical castration in Indonesia. This research is a normative study using documentary studies in the form of secondary data with interviews as a complement. The research was found that the purpose of punishment from chemical castration was for rehabilitation, with notes that the chemical castration treatment is dropped for the sexual offender against children with pedophilia.
