Abstract

Local people in the North Semarang area continue to aggregate and articulate critical political thoughts, pressing political thinking, and having a strong influence on the ruling elite's political decisions in the city of Semarang. This has been done by local people starting in 2004 until now—for example, Kanjengan Mall in the Johar market area, which investors from PT contracted. Pagar Gunung Kencana, in 2004 has expired. However, Jamaah Peduli Dugder in the North Semarang who always monitor the area say, there is still a development of the Johar market area, the Kauman area, and Malay villages that are not right and lack the attention of local elites and slow development. This research problem formulation is how does the community build the strength of its political thinking? The purpose of this study is to analyze the results of local people's political thinking on changes in elite political decisions and to analyze them with the approach of the power of civil society. This research's methodology was qualitative methodology, which was supplemented by descriptive analysis, including conducting in-depth interviews. In addition to primary data collection, secondary data collection from relevant documents was then analyzed. The conclusion of the political thinking of the local community on the Dugderan tradition is very strong. This resulted in a change in the political decisions of the elite who were then pro-local people.

Abstract

Buying and selling transaction through internet makes people everywhere and at any time easy to make buying and selling agreement without face-to-face encounter. By electronic buying and selling transaction, people can buy and sell effectively and efficiently everywhere and at any time. In transacting, people keep referring to the existing legal norms. In buying and selling transaction through internet, various legal problems that can inflict a loss upon the other parties will appear. By the existence of the Law No. 11/2008 on Information and Electronic Transaction, it is hoped that the emerging dispute among the parties in the buying and selling transaction through internet can be settled.

Abstract

Local governments seek to enforce regional regulations and have a role as law enforcement officers through the Civil Service Police Unit (Satpol PP). This is contained in Government Regulation (PP) Number 16 of 2018 concerning the Civil Service Police Unit. The regional government of Blora Regency through the Civil Service Police Unit of Cepu Subdistrict is also optimizing efforts to enforce Regional Regulations (Perda). So far, in practice in the field, many violations are found on the shoulder of the road and the sidewalk is not functioning at several points in Cepu District, as stated in Regional Regulation 01 of 2017 concerning Public Order. The purpose of this study is to analyze the constraints and find solutions to the role of Satpol PP in Cepu District, Blora Regency in law enforcement against Street Vendors (PKL) who sell on the sidewalks of the Cepu PLN office. This type of research is normative juridical. The results of this study 1. Law enforcement of street vendors who occupy the sidewalks of the PLN Cepu unit. The role of the Cepu District Civil Service Police Unit is to demolish the permanent stalls belonging to street vendors. This will create an orderly society against the rule of law. 2. The solution is to have regular discussions or socialization regarding Regional Regulation 01 of 2017 concerning public order and Regional Regulation number 20 of 2018 concerning the Arrangement and Empowerment of Street Vendors to PKL and former PKL associations.

Abstract

The existence of a guarantee object is that it still is in the hands of the fiduciary giving debtor in fiduciary guarantees often experience problems, including the fiduciary giving does not carry out its obligations to pay its debts resulting in default. therefore, the purpose of this study is to look at the legal consequences of defaulting on fiduciary debtors at Pegadaian companies and the obstacles faced in a study using a normative juridical approach with descriptive research specificationsThe results of the study show that in KREASI credit that has been registered in accordance with the provisions of the Fiduciary Law where if the debtor is in default, persuasive subpoena efforts will be made, the act of withdrawing the goods in the hands of the debtor until carrying out the execution in accordance with the provisions of Article 15 paragraph (1) of the UUF and the Constitutional Court Decision No. 18/PUU-XVII/2019. Whereas those who are not registered according to the provisions of Article 1155 paragraph 1 of the Civil Code Pawn companies can directly sell collateral objects that are in their control. Obstacles faced by PT Pegadaian if the debtor defaults, namely the debtor does not voluntarily hand over the collateral object, the collateral object has been damaged and no longer functions, and the collateral object is intentionally transferred by the debtor to a third party.

Abstract

The aim of this research is to find out the implementation of a complete systematic land registration arrangement at the Grobogan District Land Office and to find out the supporting and inhibiting factors that arise in the complete systematic land registration activity at the Wates Land Office. The method used in this study is a normative juridical research method through a direct survey in Wates supported by secondary data. The method for analyzing data is a qualitative method. Research results show the implementation of complete systematic land registration (PTSL) arrangements in 2022 at the Wates Land Office. the implementation of PTSL is carried out with the following stages and implementation of activities: a. planning; b. preparation; c. location determination; d. Establishment and determination of the adjudication committee and task force; e. Extension; f. certificate issuance process; g. research on juridical data to prove rights; h. Announcement of physical data and juridical data and their ratification; i. Affirmation of conversion, recognition of rights, and grant of rights; j. bookkeeping and issuance of certificates of land rights; k. submission of the certificate of land rights; l. Reporting; m. Digitization. Supporting factors; a. Participatory maps which are very supportive in planning activities for implementing juridical measurements and implementation; b. Wates Village officials who actively participate in filing PTSL activities; c. Communities who participate assist in delineating the boundaries of land parcels in measurement activities. Factors that become obstacles; a. Misunderstanding of village officials when applying for PTSL files; b. There are still many land boundary disputes between residents in Wates Village, Kedungjati District; c. The stakes or boundary markers for the land parcels that will be registered with the PTSL certificate have not been installed; d. Abstract

This article delves into the crucial significance of protecting the environment against damage and the legal enforcement concepts, both civil and criminal, against environmental offenders. The research employs a juridical-normative approach, utilizing legislative regulations. The findings of the study indicate that the importance of safeguarding the environment against damage is manifested in endeavors to realize human health, economic aspects, global climate stability, and global responsibility. In sustainable development, environmental protection is considered a foundation for achieving these goals. Awareness of the close relationship between law and sustainable development is pivotal for success. The concept of legal enforcement comprises two main perspectives: civil law and criminal law. Civil law emphasizes the responsibility for compensation and absolute liability, while criminal law involves processes of investigation, prosecution, and the implementation of judicial decisions. Criminal sanctions can be applied at the individual or corporate level, emphasizing deterrence effects and corporate responsibility. In conclusion, to enhance environmental law enforcement, the government needs to intensify surveillance and the application of criminal sanctions. Effective coordination among relevant institutions, such as sectoral authorities, in permitting and environmental monitoring is crucial. Active community involvement in reporting environmental violations and supporting conservation policies is highly essential.

Abstract

This research will attempt to provide an analysis regarding the Legal Protection of Debtors in Fiduciary Guarantee Execution both before and after the Constitutional Court Decision Number 18/PUU-XVII/2019. This study employs the juridical normative legal research method, with secondary data being utilized, which consists of pre-existing data. The analytical technique employed is descriptive analytical analysis. The research findings indicate that the Legal Protection of Debtors in Fiduciary Guarantee Execution before the Constitutional Court Decision Number 18/PUU-XVII/2019 Equalizing the fiduciary guarantee certificate in Article 15 paragraph (2) and (3) of the Fiduciary Law resulted in the constitutional rights of debtors being infringed upon. The Fiduciary Receiver (creditor) may carry out execution in the form of private sale of the fiduciary collateral objects pursuant to Article 29 paragraph (1) letter c in conjunction with paragraph (2) of the Fiduciary Law based on an agreement between the fiduciary grantor and the fiduciary receiver. In POJK Number 29 of 2014 Article 14, creditors are prohibited from withdrawing fiduciary collateral objects, with conditions stipulated in the fiduciary law also being agreed upon by the parties in the agreement. The execution of fiduciary collateral objects must be based on the determination that the debtor has defaulted and cannot be unilaterally permitted by the creditor, in the a-quo decision of the Constitutional Court, the creditor is not allowed to forcibly withdraw unilaterally, even though the creditor has a fiduciary guarantee certificate. The creditor and debtor parties must agree in advance on the existence of default as stipulated in the agreement

Abstract

Digitalisasi dan platform online telah mengubah landscape ekonomi global, membuka peluang baru namun juga menimbulkan tantangan bagi hukum anti monopoli. Perusahaan teknologi besar yang menguasai platform digital dapat menciptakan dominasi pasar melalui kontrol data dan algoritma, yang dapat mengurangi persaingan dan merugikan konsumen. Penelitian ini mengkaji dampak digitalisasi terhadap penerapan hukum anti monopoli, dengan fokus pada bagaimana regulasi saat ini menghadapi tantangan baru yang dibawa oleh ekonomi digital. Penelitian ini menemukan bahwa hukum anti monopoli tradisional belum sepenuhnya mampu menangani kompleksitas model bisnis berbasis data dan teknologi. Dibutuhkan pembaruan regulasi yang lebih responsif, serta pengawasan yang lebih adaptif dan berbasis bukti ilmiah untuk menghadapi dominasi pasar oleh platform digital. Kolaborasi internasional dan peningkatan pemahaman tentang ekosistem digital juga sangat penting untuk memastikan terciptanya pasar yang kompetitif dan sehat di era ekonomi digital.

Abstract

Fintech syariah merupakan inovasi yang mengintegrasikan teknologi keuangan modern dengan prinsip-prinsip syariah, seperti keadilan, transparansi, dan tanggung jawab sosial. Indonesia, sebagai negara dengan populasi Muslim terbesar di dunia, memiliki potensi besar dalam pengembangan fintech syariah. Dukungan regulasi, seperti Fatwa DSN-MUI No. 117 Tahun 2018 dan POJK No. 77 Tahun 2016, menjadi landasan penting bagi industri ini. Akad-akad syariah, seperti mudharabah, musyarakah, dan wakalah bil ujrah, menjadi fondasi utama yang menjamin terpenuhinya nilai-nilai Islam. Namun, industri ini menghadapi tantangan berupa rendahnya literasi keuangan syariah, keterbatasan sumber daya manusia, dan persaingan dengan fintech konvensional. Solusi yang diusulkan meliputi inovasi teknologi, peningkatan literasi keuangan syariah, dan kolaborasi antar pemangku kepentingan. Dengan pendekatan yang holistik, fintech syariah dapat menjadi pilar utama dalam sistem keuangan Islam yang berkelanjutan dan inklusif.
